This probably belongs as a "sticky" but I felt the necessity to post this info as I found it. So as Not to ruffle anyones feathers I'm only linking the search engine info I found here.

But only might work with judicial foreclosures not for non judicial where no practical access to the Courts.

Gary - thanks for the advice. I did go to the recorders office but never printed anything out. Will do that next week. It could help (or not) in a Class Action Suit (read Moe's post). But I think till we know more we should be accumulating everything we can.

Gary, this is GREAT. I actually received a phone call from a gentleman who was explaining this VERY THING to me. It is helpful to understand that in most of the securitized mortgages, not only was the borrower a victim, but so was the INVESTOR. They were lied to about what they were buying. It may seem a new idea to some to have any sympathy for them, but they are not guilty of SCREWING borrowers. They are investors. The true culprits in this mess are the people who constructed these financial products, WITH FULL KNOWLEDGE that they were screwing BOTH the borrowers, AND the investors.

In my blog, I referenced a very GOOD stick-figure cartoon that explains it so simply (and with plenty of humor, which I am quart low on these days) how this things works. It's important for us to understand who the true villains are so that we focus our energies on where our remedy truly lies.

I was at a foreclosure/modification meeting today with a major Phoenix law firm holding a discussion.

They said in order just to get to the discovery phase it would cost at least $15,000 in legal fees to bring an action. Could be far far more for fighting.

Unfortunately they say they have seem quite a few unjust foreclosure sales and would love to file actions, but the costs just make it impractical to do so vs low likely hood of recover and many years away. Civil suits typically take many years in the overburden courts today, unfortunately.

But would be great if someone would try it and report what they find out from other attorneys.

As a small business man I've been in the court houses before with my own lawsuits. I'm basically saying "do it yourself" if you have time (nothing against Moe and the call to arms here) all I'm saying is this.....simple Discovery is what your willing to "plow" through and find out the underlying facts on you own.

Unfortunately time at this stage is my currrent enemy.....15K for Discovery is the epitomomy of sudo tort reform. Not to mention Lawyers trying to stiff the public under the circumstance!

Again I want everyone to go to the recorders office and find their ASSIGNMENT OF TRUST it's very important.
