Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | As of yesterday, I have fallen flat yet again in my quest to find a capable attorney to represent me against Wells Fraudgo who "gets it" that these subprime mortgages are a massive criminal enterprise engineered by the banks and Wall Street. My foreclosure trial is scheduled for November 23rd, and I'm feeling the walls close in on me :-( I am SO fed up with the legal system and am going to stage a one-person protest at the county courthouse with a sign that says: "Please tell me WHY I should have faith in the legal system when you lawyers refuse to help the litttle people on Main Street fight back against Wall Street? All you care about is the ALMIGHTY dollar -- not JUSTICE!" I'm thinking about doing this early next week, depending on the weather, and sending an advance email to all the local TV networks. Anybody thinking of doing the same? Maybe we all should pick a day to protest in front of our county courthouses to bring attention to the problem. Whaddya think, people? Want to do it? By the way, when I do it, I'm going to wear my "Fighting Homeowner of America" T-shirt Your thoughts on this idea, please! Sally |

We have been organizing and fighting in other threads that you should join in on. Also, I have been trying to unite everyone under some type of homeowner party. FYI, I am in Kansas, just a stone's throw from Kansas City, Missouri. It looks like this Wednesday might be the best day to stage my protest as the forecast that day calls for sunny skies, no rain.... Moe, I get what you're saying, but what about my getting a lawyer to take my case in the meantime?? I don't have anyone in the legal profession advocating for me :-( and I'm feeling desperate with the time growing so short, which is why I feel the need to stand in front of the county courthouse and stage a protest. If I could get the lawyer who represented Boyd Kesler in Landmark National Bank v. Kesler in which the Kansas Supreme Court ruled that MERS had no legal right to foreclose, that would be awesome, but I don't know who that attorney is, or where to find him, etc., etc. Any ideas?? Sally, I just don't know lawyers who will help for free or are in positions to give away free legal hours. They too are suffering and the ones that are good are just too busy. It would take a slam dunk case and money to get the hired. This world has turned into one that operates not just by sun and water, but money. Money is like food and water. These lawyers go to school for 8 years, have loans to pay, insurance, mortgages and MANY are also facing hard times because no one has money to pay them. It is a vicious circle. The only way is on your own or keep looking.

Moe, That is probably very true in a lot of cases, but what real recourse do we all have if we can't get lawyers to take our cases or the banks to modify our loans? I love this idea of yours to file a class action suit, and I'm 100% in favor of it. Will this class action suit serve to stop any and all pending foreclosures cold in their tracks? I just am so scared about what's going to happen come November 23rd (foreclosure trial scheduled). I am doing a LOT of praying and such..... I'm only 3 hours away from you, but on Wednesdays, I work both jobs. One is 8-5, then the other is 6-9. Doesn't leave much time for the courthouse steps. I'm not complaining, however, at least I have a job. If I have a little bit of notice, I can take time off. |

Per the law if you want to file a Qui Tam as a class action, you have to have legal representation and the lawyer is getting cold feet. As in your case, I too have the same issues in finding lawyers. A Quit Tam is: In common law, a writ of qui tam is a writ whereby a private individual who assists a prosecution can receive all or part of any penalty imposed. Its name is an abbreviation of the Latin phrase qui tam pro domino rege quam pro se ipso in hac parte sequitur, meaning "[he] who sues in this matter for the king as [well as] for himself." The writ fell into disuse in England and Wales following the Common Informers Act 1951 but, as of 2008[update], remains current in the United States under the False Claims Act, 31 U.S.C. § 3729 et seq., which allows for a private individual, or "whistleblower", with knowledge of past or present fraud committed against the U.S. federal government to bring suit on its behalf. This provision allows a private person, known as a “relator”, to bring a lawsuit on behalf of the United States, where the private person has information that the named defendant has knowingly submitted or caused the submission of false or fraudulent claims to the United States. The relator need not have been personally harmed by the defendant’s conduct. The information must not be public knowledge

Sally, How about a (well executed) YouTube rant re no legal representation for homeowners, like the Debtor Revolt lady? If it goes viral, you'll have reached a much wider audience. What I liked about her video was she was calm, intelligent, and factual while laying out her anger toward the injustice committed by cc co.'s on hard working, responsible, citizens. I would avoid a rant at the legal profession for not stepping up (yet) to help homeowners. I would focus on selling your case to the right audience, and less on the rage at the legal system. Please don't take that point wrong. I'm on your side | |

That is a good idea, but the problem is, I don't have a camcorder Like Moe has said, there are a lot of lawyers out there who just aren't worth the piece of paper their degrees are printed on ....and I'm in a much more precarious position than most people due to the fact that I'm profoundly deaf and have been since birth, so going at it alone, as Moe suggested, is just literally begging for the wolves to eat me alive -- and they will! I desperately need a lawyer to advocate for me for that reason, someone who knows how to fight the good fight and send the wolves running for the hills.
