Nothing has happened since the last post - and I'm pretty sure it was Wells who initiated the foreclosure, at least according to the attorney. That's an interesting question, but at this point for me it doesn't really matter.

My god, Cleach!!! What a horrible mess you're finding yourself in. Seriously, I'm not at all surprised by WF's moronic actions in your case because that seems to be SO typical of them. A few months ago it was reported on the Consumer Warning Network that they had sued themselves (yes, SUED THEMSELVES!) in a Florida foreclosure case.

All I can say is that they're probably staffed by high school and college dropouts! I'm having to deal with WF (I call them Wells Fraudgo) myself even though they're not the lender or servicer; Option One/AHMSI is and WF is the trustee.

If MERS is involved in your situation, you might have a real fighting chance against them.. the Kansas Supreme Court just issued a landmark ruling in Landmark National Bank vs. Kesler in which they ruled that MERS had no right to foreclose -- which could be used as a precedent in other states. Good luck fighting back!!!

At least Cleach wasn't that upset that house was sold it was more the almost comical situation where WF didn't even know and wanted him to pay.

I was more concerned about the gal we haven't heard from since her home was sold when servicer had her on mods and wasn't suppose to but did. She was desperate to save and that is the huge issue that is why we need some new foreclosure moratorium to give time to work out the mess with servicers.

She even had attorney who last post that I saw was trying to see what could be done. Is she still here and reading this by chance. We are interested in an update.

A bank suing itself is just as stupid as the banks creating 80/20 loans (of which I took advantage of). If you can't put down the 20%, you have to pay PMI which will serve as the bank's safety net if the borrower defaults. So, instead of retaining that safety net, let's give the borrower two loans, one for 80% and they can borrow the 20% from us and avoid having to pay PMI. What a brilliant idea! Too big to fail? How about too dumb to stay in business?! I hope cleach does sue them! Can you sue on grounds of utter stupidity?! Should be an open and shut case then!
