    QWR to send?

    hi, I post here alot so don't want to repeat too much. after the WF MBS hassle and all the misinformation and knowing that they want to foreclose and make more money again....is it of any help to send this QWR? I don't know if it will make them hurry up and file NOD, we have not paid since march 1. so april-present no payment. worked with OOP and no help. so symapthetic though! spoke with RE attorney who feels our only option is to file suit in court and hope it gets pushed forward past the Demure(sp?). this is so frustrating! I guess I am wondering if they get this QWR will they all of a sudden offer some ridiculous trial or something to delay getting all of that info together to respond to me? BTW, I refuse to do any sort of trial!

    Hi Soccermom,

    No I do not think sending them a QWR will encourage them to accelerate foreclosure proceedings. They must respond within 20 days and defend their position within 60. That 60 day mark is not a deadline for change but but simply a legal deadline for them to answer the allegations. This is a right under RESPA - Real Estate Settlement Practices Act - to gain information and to dispute false bills or charges.
