    Searching the internet for foreclosure prevention services and knowing what websites and companies to trust is like finding a needle in a hay stack. There are many good companies out there but there also scam artists/ sharks that just want to feed on people when they are vulnerable.

    So how does someone find legitimate organizations to help them? The best bet is to go with a non-profit HUD approved Housing Counseling Agency. There are also for profit organizations that are really good and have been successful in helping people deal with their mortgage companies and perform successful loan workouts and loan modifications.

    A good real estate and mortgage law attorney who you can also consult with to see if you have a predatory lending case.     Moe,

    `Many cases the home owners can defend themselves in the foreclosure. It is not the best solution but when funds are short it is better than just giving up. It has been my experience that many people just can not get the right person on the phone in any kind or reasonable time.
    I get calls from so many people who have fallen a few months behind and then the bank won’t accept anything less then full payment. It is ridiculous that those who want to make partial payments have virtually no avenue to catch up without spending countless hours on the phone working out a forbearance agreement or simple modification. They have tried and failed and now they have been served with a foreclosure complaint.

    If people would just reply to the foreclosure action they could then negotiate with the attorney for the bank. Most of what is needed to reply is easily found on the web, the rest is common sense and not being afraid of the process of litigation. As you pointed out in you prior post about TILA and Reg Z violations they likely have some major defenses. The attorney for the bank has access to people with real authority and can cut through much of the stuff that frustrates all of us.

    Thanks for your thoughts Brian.

    My experience is that these lenders attorneys make more money if a home goes into foreclosure, then opposed to working with the borrower. Are you suggesting that if these laws are broken, to just personally arbitrate with the lender for a loan mod based on these law violations?

    What is it you do for a living if you don't mind I ask Brian?

    Moe,

    I am a foreclosure defense lawyer in Florida. What I am saying is that once the foreclosure is filed against the home owner the game is not over by any means. That is the time to really fight. Anyone who has been through the court system knows that it takes a long time to get anything do if both sides really want to fight. If the bank can not get a quick foreclosure out of the home owner, then they are kind of stuck between a rock and a hard place.

    The fees that will be charged by the banks lawyer will be huge and will likely never be recovered. Moreover the bank still has not received any payments on this loan, taxes are not paid, homeowners dues (if any) are racking up and the insurance premiums charged for forced placed insurance is really expensive.

    A typical defended foreclosure will last between 10 and 24 months in most courts in Florida, not including time for bankruptcy, if a reasonable defense can be found (think TILA violations REG Z, MEARS, lost note, ect). It is during this period that true negotiations can be had with the lender. They really don’t want to pay there lawyers and the file is now on the desk of a real person for the bank who wants to close the file and get it off his desk. The investor has been notified of the defenses and the chances of having to pay the homeowner fees and damages for the violations and is really not happy and is probably threatening some action having to do with fraud against the original bank who sold the note to them.

    In short, the homeowner who can’t modify there mortgage through tradition means, and has had no luck with giving the property back through a dead in lieu should dig in there heals and fight in court. A few basic forms and a lot of time will slow the process down for some time; time for the homeowner to find a long term solution!

    Great Brian. Surely homeowners can't do it on their own. Just FYI, I have been working for law firms in the past and still do in regards to mortgage law and loan audits etc. So I am very familiar with these laws and defenses.


    Just FYI

    I do not allow for profit companies or lawyers to advertise their numbers or websites in their signatures or anywhere else on the site. I am trying to build a network of "quality" attorneys in each state to assist me on the Internet in helping people.

    But maybe we can work something out here. I have teamed up with Fransen & Molinaro who will cover the Inland Empire in So Cal and Also Timothy McFarland in OC.

    I have been dedicating my life to this for the past 6 months with virtually little pay if any at times and answering questions, emails and phone calls.

    My goal is for the work to pay off by getting quality "companies" to advertise on my website. It is getting a tremendous amount of traffic and so is my blog at www.loanworkout.org

    This is about helping these homeowners #1 and my goal is to only have "safe" foreclosure defense firms on this site and that is the reason I have held back so far.

    I would love to talk more with you about advertising on your site. I know how you feel about the very little money. It is the one aspect of what we do that is not so nice. I get calls from so many people and I know that they cant afford to pay, so I end up coaching them through the process for free. Not the best business model, but I can not stand the thought of the banks making even more money after the created this problem.

    I saw that ad, however I was under the impression persons were not allowed to advertise on the site. Didn't think I should contact him. Also sounds a bit expensive. Also was hoping for someone local to sit down with.

    Marshall is the preferred attorney on our forum and has Moe's permission to advertise, and since he is licensed in Florida he might just have offices in both states..........it doesn't hurt to call and check on it.....
    Also in comparison to other attorneys his flat fee schedule that is advertised is much less expensive than the retainer/hourly fee..
