    I wanted to let everyone know that I am going to work hand and hand with non-profit orginizations to help people for free and that this section will have more and more threads and posts about the FREE services that are out there for people that are trying to avoid foreclosure.

    Moe, I am very close to getting a great loan modification but the only way I can afford the new payment is if I file for bankruptcy against our credit cards. Problem now is I gave all the money I had saved to attorney Griswold (not much help there, not once have spoken to him since I started with them in October 2008) and now I need a bankruptcy attorney to help me. Do you have any suggestions? Thank you in advance.

    Where can we find the best way to write a loan modification proposal letter to GMAC? They are our Primary and we are about to go down hard! Thanks Toby

    Moe,
    I joined the forum lately, I had my sale date on Jan/11/10 9:00AM. that about 2 days from now.
    I contacted wells fargo and all paperwork submited on jan/5/10, case assigned to negotiator, request was put in to postpone sale date, but response for last few days.
    I went through exec office number [thanks loansafe.org] i'm worried now, i called both WF and Samuel White atorneys office - both said they cannot guarantee the sale date postponed
    pls. help

    HELP!!!!!!!!!!!!!!!!!!!!!!!!!!Was submitted 8/5 (after months to get the file prepared etc,8 months behind,2 previous chase modifications over past 3 years on my own,FHA backed loan not sure who investor is but I think its Chase) got a proposal from NACA in December after I sent them via NACA a hardship letter stating why this hardship was different from two previous ones in 2007/2008 that they modified my loan for. The difference was this was a permanent reduction in income not temporary and they offered a lower rate, putting the back payments into my loan etc and a payment I could live with. Kept emailing NACA I hadnt received documents etc and chase as well and tonight after 2 months I pull up my NACA file and it shows the proposal again with notes from Chase to NACA in the "Narrative" that they declined my file that after they reviewed my file internally they found investor guidelines stated could only modify my loan 3 times in 3 years so I have to wait till October to get the modification after they proposed terms !!!!!!!!!!!!! I thought I was fine and now I'm in hell again! F***k investor guidelines plus I've never seen or heard of this . Why would they ask for a letter explaining why my current hardship is different from the previous 2 if they couldnt offer it in the first place! I emailed Kevin Winn,Tonya my negotator and others and am hoping they can work this out! Any ideas or suggestions please let me know.

    Hi Moe,

    My home was scheduled for NOTS on Friday Feb. 25th. My lender (CitiMortgage) finally gave us a loan modification. We sent back the paperwork with a cashiers check to bring our account current. I am showing on CitiMortgages website that my account is current and the loan has been reinstated. Should I still be concerned that Citi could auction off my home? Everytime I call, the customer service rep I speak to says the request was sent to the lawyer and they are still waiting. I would just like some peace of mind. I have heard stories from other people who thought they were in a loan modification and then their house was sold out from underneath them. I look forward to getting information you can help me with. Thank You

    Kim,

    Did you try contacting someone at the attorney's office they are using/used directly? Several times when I had an auction and it was stopped I found someone (in most cases on the attorneys office website) that I could email and they would confirm or deny that the auction was cancelled or not. In fact the attorneys office would typically forward my emails to get confirmation that it should be cancelled if for some reason the left hand didnt talk to the right hand. Get ahold of someone there by phone and/or email ,they can tell you if it was stopped or not. Dont rely on the bank ,they have too much going on. Plus most states (not all) usually have to advertise the home for a certain number of times in a certain local publication,I've even contacted them to verify the ad was cancelled or at least checked the source to see if was listed that week. Hope that helps.

    Just call the TRUSTEE direct first thing in the morning, sounds like your good to go i hope you are saying you did a cashiers check for the modifed payment not all the past due :-/ i really hope that is what you mean a RE CURE is horrible it keeps the banks dragging their feet even longer in hope that folks re cure. Just call trustee they will show sale is stopped, if not call your servicer they are intstructed by your servicer which would be a quick call from your servicer to the trustee.

    Hi Moe!

    I am in need of advice. I just got off the phone with my lender's modification person who informed me that my application for modification had been denied because according to FHA guidelines you cannot receive assistance for three years after having assistance another time. We filed and were approved for a partial claim in early 2010, making us ineligible for assistance until 2013...



    No legal paperwork has been filed as far as foreclosure is concerned yet (which gives me a little time) but I need to see if you have any suggestions...I have thought about filing for bankruptcy protection, but would only like to use this as a last resort.


    Would/can I be considered for a forebearance eventhough I am currently behind and been denied? The negotiator stated that the bank would not have any other options for me...


    Please help! Thanks in advance for your time.
