Unpaid Taxes go with House upon Foreclosure?

I live in AZ. I will be walking away from my house and will not be paying my property taxes. Will this cause problems for me in the future (i.e. wage garnishment, etc) or do the unpaid taxes go with the property not the person? I am aware that upon foreclosure that the County will get paid first, then the 1st position loan and then the 2nd and then any other lien on the property. Just wanted to make sure. Also if anybody can point me to a website illustrating this that would be great!!!! Thanks!

When we stop paying our mortgage this month and subsequently stop paying all together .....will WF make a payment next quarter for our taxes ? They are currently escrowing. But since we will be behind by about 3 months at that point will they even bother ?

Thank you. By the way, this is a fabulous website. I think I would have probably had a serious nervous breakdown if I didn't have this website to read. It's slightly comforting knowing you are not the only one that is going threw this. It somehow makes me feel like less of a failure.

We are walking away from a property in AZ starting 11/1. A few weeks ago, I met with an AZ real estate attorney. That was one of the questions I asked him, since one of the properties does not have an impound account and the payment is due soon. He told me not to pay it. He says he has never heard of any problems agianst the property owner as a result of this. Once the house goes to trustee sale, the lien goes with it.

**No, Yomann, I have not asked WF directly. I'm trying to avoid speaking to them at all. They've just started calling today and I have not picked up the phone. 2 calls so far. We'll see how many more times they call. UGH !

Get ready to be bombarded, especially if you are not picking up the phone. DH has a personal loan through them and we got behind on that while trying to keep up with mortgage payments. We're now six months behind on the mortgage and caught up with everything else. Best decision we've made for a long time...but I digress...sorry. When we were about 10 days late they started calling a two or three times a day, and it escalated from there. After about a month it was every hour for about seven or eight hours (until they actually spoke to him). On the other hand, the toddlers thoroughly enjoyed talking on the real phone. Good luck hon!

What did your husband say to them ? I'm not sure if it's better to ignore all the calls or to just speak to them. I did speak to them last month when we were late and I fibbed and told them that we were planning on becoming current this month. Which we are not. I just don't want them to know that we are not planning on paying and that we are trying to ride this out as long as we can. Is it really best to speak to them ? If so, then what's the best thing to say ?

I have been told if you want to try to stay longer, keep answering and give them reasons why they should give you more time. If you ignore them, they have no reason to delay things. I plan on answering the calls just so they dont bother me at work, etc. I am just going to tell them I am doing my best with the pay cuts we have taken, and that is it!

DH just told them that we were trying to keep up with a mortgage and we could get them a payment on such and such a date, which we usually did at that point. It doesn't really matter though. They enter whatever you tell them into the system and the autodialer just keeps calling daily. We usually did not get any more calls that day, and if we did it was one or two instead of seven.

If one of you is not working, then I'd tell them that you are looking for a job, or another job if you are already working, and that you just need a little more time to get something lined up so you can catch up. Maybe even put in a few apps somewhere to make the case. Usually a prospective employer will run a credit check of some kind and that should show up somewhere where they might be able to see it.

If our mod through NACA is denied, we fully intend on dragging this out as long as we can, too. We felt a little guilty at first....until I started doing a little digging and found how people like us are getting screwed six ways from Sunday. If your investor refuses to work with you, then my opinion is to make it as expensive as possible for them....then maybe they will be willing to work with someone else later on down the line. Good luck and keep us posted!

I agree. We, too, felt guilty. But I certainly don't feel that way now. Our investor wouldn't help us because we were current on our loan. Oh, yeah ? I guess we'll show them. Now we're not current. What's their excuse for not helping now ? A*sses !
