Legal definition of "owner occupied"?? - Loan Modification Forum

I am not on the note. My father is. My father no longer lives here.

I DO pay the mortgage, I am on the Deed since day #1, and I get the homestead exemption.

CW/BOA says my home if not "owner occupied".

Well, the insurance (homeowners) and the property appraiser says this is owner occupied,,,,,,,,,,,,,, but now the bank is telling me different.

Any advice?

As far as the bank is concerned, owner occupied means that the person on the note lives in the property.
