It is my personal belief tho I am not an attorney, I have been reading Constitutional law and how the law applies to the citizens. From my studies I believe that homeowners living in non-judicial states are being deprived. Let me give some examples.<br />

In a non judicial state a homeowner does not enjoy his/her right to due process.<br />
The trustee simply sells your home, you then get an eviction notice filed against you.<br />
The sheriffs come and throw you and your belongings on the street. Hence you lose your home.<br />
So your 4th amendment right of keeping and owning property was violated. Also your 14th Amendment right was clearly violated by not allowing you proper due process under the constitution. And last but not least. Your 7th Amendment right was violated. You were not given a chance at a jury trial, hence your 7A was violated.<br />

Now these Constitutional violations can only come from a goverment agency and or an agency acting under color of law. Let me give two examples. The State, The sheriff's department.<br />
Both the state and sheriffs department are the goverment and an agency of the goverment.<br />
Because of the fact that The State will not permit judicial foreclosures they are in essence depriving you of your 4A, 7A, and 14th A under the Constitution.<br />
The sheriff's department in attempting to evict you from your home acting under color of law, is in fact violating your rights to due process, innocent until proven guilty, and depriving you of your right to property. Clearly all the States actions and Sheriff Departments actions are a clear violation of your Constitutional Rights as noted above.<br />
All the non judicial states and the agency that helps carry out the unconstitutional foreclosure of your home are in violation of your Constitutional rights.<br />

Now what is your redress and how do protect yourself. Well the first defense is filing a lawsuit in federal court against your State and any state agency sheriffs department etc that played a part in the unconstitutional foreclosure action.<br />
 <br />
You will need to file a federal case under U.S.C.A. 42 section 1983 claiming depravation  of rights under color of law.<br />
 <br />
While this is a new strategy that I am proposing and may need further study to accomplish the ultimate goal of saving your home, via the cash you will receive from the lawsuit.<br />
 <br />
I suggest you read up on USCA 42 section 1983. This is the only redress you will have.<br />
The banks will get off and prevail because they have the state and the goverment agency's working in there corner and banks are not a Goverment entity therefore cannot be charged or sued for any constitutional rights violations.<br />
We need to take the fight against the state and state agency that is working to remove you from your home.<br />
 <br />
Remember your 4A,7A, and 14th A is being violated in Non Judicial States. All thoughts and suggestions would be most helpful.<br />
