Got our NOD at about the 1 year mark, and now finally seeing the Notice of Trustee Sale on the King Country records search website.  The date on the record shows 5/15, and I have access to the actual notice in a PDF.  I've only given it a cursory look so far, but it says something about it being the final step before forclosure, you have 20 days to pursue mediation blah blah.<br />
 <br />
I've been following the doctrine of 'no contact' during the entire walk so far, I haven't contacted GMAC (my servicer) once.  Last time I checked the condo (about 2-3 weeks ago maybe) we were still able to get in, and no notices left or anything, nothing about C4K.  We do still have a few remaining things just so we wouldn't have the locks changed on us, but nothing we actually care about losing if it comes to that.  I will check the condo again tonight to see if the locks are changed/any C4K, but my main question is- is there anything else I need to do at this point?  Can I just stop paying HOA dues and forget all about this place, or is there some other step needed to confirm the sale went through before I can safely stop paying dues?  <br />

Should I have expected to see any C4K stuff /before/ the NOTS, or does that typically come after?  Looks like we might finally be at the finish line, but just want to make sure we don't leave any loose ends.<!-- google_ad_section_end --></div>

Hoping we can get some advice on the foreclosure process. The house is in Arizona. The first full payment missed was March, 2013 (partial payment made in Feb, 2013). Primary lender is Green Tree, second with Wellsfargo.<br />
<br />
 Two weeks ago I sent a letter to the lender (by fax and mail) letting them know the house was vacant and requested pre-approval for a short sale or deed in lieu of foreclosure. We drove by the house this week and they have changed the locks/put a lock box on the front door, locked/blocked the back slider and there is a flyer (from the mortgage service) in the upstairs front bedroom window. <br />
<br />
What I find odd is they have not communicated any of this to us. The only communication was have had with the bank is the letters that I sent them two weeks ago. I have not talked to them on the phone, although they have been calling and leaving generic voicemails. We have received from them (via mail) bills, collection letters from attorneys and help packets. <br />
<br />
I would think they must notify us if they are taking possession of the house? I am also curious how they got around our alarm service (I need to call them). What notices are they required to give us in order for them to change the locks? Does this mean they are going the foreclosure route? Thoughts?<!-- google_ad_section_end --></div>

Making great money during the 'boom' decided to build dream house in 2001. Fast forward to 2007..bottom fell out and we lost 70&#37; of income. Struggled to make house payments for next 4 years. 1st Mort loan mod was a joke. 2nd was better. Started to fall behind, finally stopped paying 2011. During the last 4 years, house has been listed with 4 reductions, 4 years and 3 lookers.. No offers! Received NOD from Nationstar (2nd mort) 2012, received NOD from HFC two months ago.<br />
Called both banks, asked what we could do.. Reply "HUD, HAMP, etc... But I doubt you qualify". Called back told them we have it listed for sale again. Reply " let us know when u get an offer or want to SS"  we live in a rural area, no one wants to live this far away from the city so here we are stuck. We are discouraged, tired, worried and just dismayed our life has come to this at our age (50's). Used all our savings to pay bills both business and personal. BK is not an option as I have already done Chp7 and hubby can't due to back taxes owed. My question "should we just walk away or stay until they foreclose?" Help please, at my wits end and I don't have much wit left! Thank you for any info.<br />

At that time, the prior owners disguised a leaky basement by finishing the basement completely with drywall/flooring/etc.  Ever since we bought the house, the basement has leaked every spring as the water table has risen around the foundation.  This has ruined countless possessions, in addition to the shoddy finishing job that they gave the basement.  Fast forward to now, and there is black mold in the basement.  We can afford to keep on making our mortgage payment, but we do not have nearly enough money to tear out the moldy finishing and prevent future leaks ($15000-$20000+).  On top of that, we are very underwater in our mortgage.  We owe $120000 and the house in its current state would be lucky to sell for $60000 in our neighborhood.  We fear for our health and can no longer support this sinking ship of a house.<br />
<br />
So, we have talked with two lawyers who have advised us that it is possible to walk away.  Even though Michigan is a recourse state, they have told us that they have not seen a single bank go after a deficiency.  After hearing it twice, I am more comfortable with my decision to walk away.  Obviously, I know that my credit is going to take a huge hit.  I made last month's payment, but I may miss my June payment, depending on how things go.  <br />
<br />
I want to make sure that things go as smoothly as possible, so I have one immediate question for the forum:  My wife and I have about $8k in CC debt.  We both have excellent credit right now and have not missed any other payments.  Since our credit is going to be trashed by this process, would it be advisable for us to transfer the CC debt into a fixed rate personal loan prior to missing our first mortgage payment?  We don't want the interest rates on our CCs driven up by the foreclosure.  Can banks increase the interest rate on a personal loan after it has been issued, like they can on CCs?<br />

So although I got a HAMP a couple years ago I found myself unable to stay afloat in NM with my house payments.. I decided to let my house foreclosure.  My last payment was in June 2012- Complaint filed in August 2012 and around Jan I have been working with Fannie Mae for short sale or deed in lieu options. After four months of sending nonstop paperwork I got about 4 letters saying I wasn't eligible to lower my payment due to having the lowest interest amount, I wasn't even wanting to refinance. I have pretty much given up on Citi they keep assigning me new people and Fannie Mae said I wasn't eligible for alternatives as I make too much money ( which isn't true but oh well ) <br />
<br />
I checked the court system and say that Judgement/Default was awarded by the judge on 4/23/13. So strange as I haven't heard anything about a court hearing or anything but since I didn't answer the initial complaint that is all it takes. <br />
<br />
I know next it will go to auction after 4 weeks of listing in a publication but what timeframe do I have at this point? I have been reading lots of threads in which after the house sells in auction the bank usually gives you a good amount of time to move out but reading up online on various sites it says they can give as little as 3 days.  I would like to stay in my house till September as I am trying to find a job in Seattle, and home for my horses.. Just so overwhelming but I knew it would be.  I know I could file a motion to put it off longer, as I don't know why I wasn't approved for at least a deed in lieu.. I know there is the Hope Line also that might be able to intervene- <br />

Anyone have any suggestions about my situation? Its so hard at this point, I know I have at least two months has it hasn't been listed in my local paper but after the sale can it be that fast or do most lenders work with the occupants?<br />

Chapter 7 discharged in 09, did not reaffirm mortgage.<br />
Multiple HAMP/mod attempts, what a waste of time.<br />
Countrywide/BOA/Nationstar servicing.<br />
Tried to sell, had a buyer whose financing fell through because of an unexpectedly low appraisal.<br />

They sent me to work with Bayview to get a modification, for which I was approved. I had my trial period of three on time payments, which I paid through Western Union. In April I tried to figure out how to continue paying my mortgage now that the trial period was over and I found out that my home was still in foreclosure and was referred to Cenlar's local lawyers. After lots of paperwork and run around they are saying that they never received my January 1 payment. I have the Western Union receipt. I explained this, they still say they never got it. So I called WU and was given a sequence number which says they picked it up. They still want proof, so I requested the proof from WU and was told it will be here in 7-10 business days. In the meantime the lawyer informed me it's too late anyway, my house foreclosed on the 17th. Monday I recieved an eviction notice. I have an open review with Freddie Mac. I am waiting for WU's proof of payment. I don't understand how you make your payments and they sell your house anyway. Is there any hope here? Or do I just give up? Any one have any hope?<!-- google_ad_section_end --></div>

So I've been in the process of a walk, and I have a question.<br />

Since February, my wife has been keeping the mortgage money we've saved in her bank account. At some point, I may want to try and file for Ch13, but I don't know if I'll qualify (we have a lot of debt, but we both have good jobs).<br />
<br />
I'm a teacher, and a lawyer advised me to wait before filing for BK since my summer wages are so low, and they go based on 6 months of wages.  By the end of summer, we'll have saved quite a bit.  So here's the question: is it fraudelent or illegal to give that money to someone to hang on to, so as not to count it as an asset when I try to file BK?<br />

I figure if it is, I can use the money to pay down debt before filing, although that would obviously be wasteful since BK would eliminate so much of that debt.   <br />

Here's my story. My wife purchased a small home in Florida a few years before we started dating.  I had to move, blah blah blah, we tried to get a short sale with Wells Fargo, that went terribly, blah blah.<br />

Fast forward to now.  <br />

They've offered us a deed in lieu.  On the deed in lieu, it does not mention them coming after us for money, but it does say I have to sign the deed in lieu with my wife, and an additional witness and a notary.  I'm hereafter referred to as a borrower/grantor even though my name is no where near the paperwork for the house.<br />

My question is if, and how, this will affect me personally.<br />

The 2nd continued to send me mortgage bills, so I told them that the loan was purchase money and since the loan was for property in CA that it was non-recourse. I then received a letter from the 2nd that stated the following:<br />

"Our records confirm that the account is in charge off status and liquidation of the remaining balance has been initiated. This means that collection activity has effectively been ceased for this account"<br />
<br />
I did a search and couldn't find anything similar, so my question is what does that statement mean? "Liquidation of the remaining balance" seems to be a rather opaque phrase so I'm wondering if anyone else has come across this issue. Thanks in advance.<!-- google_ad_section_end --></div>
