Citi denied HAMP after trial payment period due to 31% rule. Now behind on 1st mortgage because of the trial payments I made for 4 months.<br />
 <br />
Tried for traditional mod on 1st &amp; 2nd: Denied because "insufficient income to maintain monthly expenses." And they cannot help on the 2nd because it is current. Citi suggested credit consolidation help, if successful there then maybe they can do something for me. (?)<br />
 <br />
Paycut is killing me. No more savings, no nothing. I am thinking about stopping payment of my 2nd. If they try to foreclose on me because of that I could probably get a hardship withdrawal from my 401k to settle the second. Please advise.</div>

			<content:encoded><![CDATA[<div>Started the process of modification of my sister's loan in May, she is a new young widow, got her placed in the trial in July, verbally Aug, sept, oct, but when paperwork came it was Sept thru November.  Paid all trial payments by phone, called twice a week since July 1,  They received package back on July 28 with all documents as I have the tracking information.  They clamed initially that it was not in the system, but after checking they said they had everything.  On October 22, was told we were in the cue to be assigned to an iunderwriter, that it was great nothing new was needed.  Online still shows the last update at july 2,<br />
Yesterday, she received another hamp app[lication and request for all the information that was intially sent, called loss mit, they assured me to ignore the request that they had everything,  The letter said to call another number so  I did, and discovered MOS,  Yesterday, they said her account was being handled by Citi and sent me back to loss mitigation who again assured me that all was well, just wait, Well, I called  back MOS this morning and was told that they no longer had the orignal modification because it was cancelled October 18 because they had no paperwork, MOS verified they did have the 76 pages in both systems, and did not know why they cancelled the trial period, and that CIti requested MOS to continue to work on the file, they would be calling in a few days to tell us what else is needed, This is after at least 50 calls asking if their was anything else needed,  I dont beleive anything I am being told, nothing has panned out, but I dont blame the employees, they have been very nice, but I do think they take the easy way out.  What needs to be done now, Just wait on the call or be proactive and if proactive, what is suggested.</div>

In addition to the above, please forward any and all disclosures, rate sheets etc. associated with the above transaction. <font color="red">did not recieve this</font>  Please note that all copies need to be clear and legible and all documents should be copied in their entirety.<font color="red">did not recieve this</font><br />
In closing, We/I understand that under Section 6 of RESPA you are required to acknowledge our/my request within 20 business days and try to resolve any issues within 60 business days.<br />
