When I made my first trial payment on November 1st, I was transferred from imminent default to loss mitigation. But loss mitigation says they can't send my docs until I am 31 days late which doesn't happen until after I make my second trial payment Dec 1st. Today I was transferred by loss mit to "The Way Forward" 877 550 5705. The woman there told me she could just give me info about my account. She said I would have docs by next week. How many times have I heard this? Meanwhile all I have to confirm I am on a trial mod is a voice over the phone. I don't trust anyone! Every time I call I get a different story. It is laughable! Anyone else out there in this boat? Making trial mod payments, but no docs?</div>

After 5 months I did get a job for less pay and Chase/WAMU's loss mitigation department worked with us on the trial modification which we paid religiously on time, even calling weekly to make sure that we were doing everything correctly.   Then in September I got a job paying even more than I was making when we first got the original mortgage plus my wife went back to work and we are now making more before we lost our jobs in January.   <br />
<br />
At that time I offered to make larger payments than the trial modification but was told no that it would make matters worse and that the trial modification would be made permanent if we just stayed the course and continued to make the trial modification payments (the original 3 plus 3 additional ones so far).   When I called to check on things today I was told that the modification was denied last week because our income is not high enough to meet the payments from the trial modification.   They also said that because the payments during the trial modification were less than our old payment that our loan is now 6 months past due and they will be adding in all of the late charges and sending us to foreclosure.  <br />
<br />
How can this be and can anyone suggest anything as we do not wish to lose our home.<br />

We bought this house to start a foster care for adults with developmental disabilities.  We researched Oregon before we came, and there was a great need for good foster providers.  But by the time we had sold our previous home, purchased this one, completed the licensing process and opened for business, so had several other homes in the area.  There were suddenly and for the first time in history more foster care beds than clients.  <br />
<br />
So, my husband got a job teaching Special Ed.  That used to be an in demand profession, but in the current economy that is one of the first things to be cut in the school system.  He lost his first position to a teacher longer in the district who had lost her own position.  He got another position, but then was hospitalized for some serious health issues that forced him to give up teaching.  We felt if we could reduce our monthly mortgage payment, we could still try foster care with fewer clients.  We did not want to take clients until we were sure we could stay in our home.<br />
<br />
When we started this process, we were on time and had excellent credit.  In order to keep that designation, we have drained our retirement savings. We have not officially received notice of denial, and in fact yesterday when I spoke with EMC (a division of Chase) they neglected to tell me there was a note on my file that the modification had been denied last Friday.  I found that out this morning from the woman in the delinquent dept (a completely unrelated dept in a separate state) calling me about my payment (or lack thereof).<br />
<br />
We feel we have been punished for good behavior:  paying on time even though we could not afford to and putting a large down on this home which makes it a lot more than the mortgage, an unusual circumstance in this economy.  Others we know have NOT paid, even though they could afford to, and their mortgage modification has been approved.  We HAVE paid even though we could not afford it and ours has been denied.<br />
<br />
Any suggestions for getting this denial overturned?  We do have unstable income at the moment, because the unemployment rate is just under 20% right now in our area, and we are both working off and on as we can.  If we can get the mortgage settled, we can do foster care, but not until then.  The company knows this.<br />

I was on the phone yesterday with a loss mitt rep and when I inquired about our loan she was going down what seemed to be a list or whatever notes were written about the account where I could hear what she was saying whether or not she wanted me to I don't know but she used the word perfected..does that mean verified or what in chase lingo anybody know? She was like reading outloud to herself I don't think it was intended for me to hear.</div>

It has been along process already being told once that we were denied.<br />
 <br />
The next payment is due December 1st which will be the 5th trial payment.<br />
I dont know if I should continue to make the payment or not send anything at all.<br />

What is my best course of action?<br />
