Just submitted a mod application 2 days ago.<br />
<br />
Mortgage is $3450/mo w/PITI<br />
<br />
$416,000<br />
<br />
$90,000/yr income(wife)<br />
<br />
Late on payments but, current for now. Savings gone.<br />
<br />
I've read the horror stories here dealing with IMB/OWB.<br />
<br />
Thanks for any insight or suggestions</div>

			<content:encoded><![CDATA[<div>I've been in the process for almost 4 months...I've been dealing with one guy for the last month on my modification and he's been updating me.  I didn't hear from him for a week so I decided to email the head guys again and heard back that night, they contacted AJ (the guy I've been dealing with ) and he got back to them telling them that I qualify for the modification they are just waiting for it to get done and as soon as it is they'll send me the info.<br />
 <br />
What should I take this as meaning?  Does it mean I will definetly get a mod?  I know he told me they are looking for a 10% drop in income which we have.<br />
 <br />
What should I expect if I get papers?  Does everyone get a trial period? and if you get a trial period are you guaranteed the modification if you make all the payments on time?</div>

ASC a subsiderary of Wells Fargo is my mortgage co.  In September 09 I was late on my payment about a week after the grace period and assumed we may be late again the next month.  I thought calling right a way was the best thing to do.  <br />
 <br />
On the 28th I contacted them and asked if there was any way I could do a modification.  They sent a work out pkg I filled it all out with the supporting info., called them, they told me not to send it, just to qualify over the phone.  <br />
 <br />
I told them my story ....<br />
 <br />
3yrs ago when I refied cash out 30k, my car was stolen, my mother in another state asperated and I had to place her in a skilled nursing facility, a year later mycat of 18yrs died which was a huge vet bill and one week later ... I was told I had cancer.  The inscision herniated.  I had to quit my second job and through all that.  Here I am now trying to get by.<br />

The numbers ....<br />

I owed 70k refi cash out 30k = now owing 102k  <br />
Current value now  35k - 45k<br />
 <br />
My loan is NOT Freddy Mac or Fanny Mae which disqualifies me for the "Home Affordable Program" ASC sold my loan to private investors.<br />

I call with them on the line...thats about it.<br />
 <br />
ASC infomed us yesterday (November 18th) because I didnt fill out the paper work the closed my file!!!!!!  I NEVER GOT ANY PAPER WORK!!!!<br />
They dodge the mention of sending it certified or any tracable manor.  I offered to pay myself.<br />

I wasnt behind, now I am, will Christmas be outside this year?<br />

They were denied a request for a loan modification 5 times by Central Mortgage Company. 4 out of the 5 times, they denied them stating insufficient income. This most recent time, they actually told my parents that they now have TOO MUCH income. They started the foreclosure process, and a trustee sale is on 12/7.<br />
<br />
They are trying desperately to keep this home.<br />
<br />
Has anyone heard of Kardia Capital? They are trying to push back the sale date and are considering going into litigation, but who to trust? I'm not sure how my parents found this contact at Kardia Capital, but they are some sort of loan modification/debt specialist. I was wondering whether anyone has worked with them, and what their experience was.<br />
<br />
They reside in Northern California. Any suggestions on someone they could work with who is trustworthy, knows what they're doing, and able to help us push back the sale date?<br />
