In June 2012 I was laid off and we weren't able to make our payments I called B of A immediately and was told to send in docs to request a modification. I sent them the docs then I was told I need to be 90 days past due. Once I was 90 days past due I called and found out they change my case worker but I could never get ahold of the new case worker so I called the HOPE program they did something in the system and I was assigned another case worker but was told I won't qualify for a mod because the mortgage was my on debt (not true) once that was fixed they gave me a new case worker in September, I could never get a hold of that worker. In November they assigned a new case worker that seemed to know what he was doing, he requested that I send the mod docs again (which was the 3rd time) once he received them he called and said I need to be in the Unemployment Program for 5 months before I can apply for a HAMP (at this time I was already 6 months past due). I asked why I wasn't put I. This program back in June he said I had to be 90 days past due before I could be put in the program (that should've happened in August). This is where it gets strange and confusing.  In February 2013 I received Notice of Pre-foreclosure Options which was strange being that my unemployment program didn't expire until the end of April. I responded to the notice requesting a meet and confer which b of a received exactly 30 days later. In March I also received a new mod packet that needed to be filled out and returned which it was. In March I also received a notice of default (but was never contacted about the requested meet and confer) I sent a letter to Quality Loan Service demanding that they revoke the Notice of Default. At the end of March I called my customer relationship manager to make sure he received everything he needed or the underwriter, he said he did and if there is anything missing he will all me immediately. I called again in May to make sure my docs were sent to the underwriter and was told my customer relationship manager accidentally removed my account from the mod review process and now I have to wait to be assigned to a new account manager. Once assigned to a new account rep she said I had to send all new docs because she didn't show that i sent anything after October 2012. I was upset at that time and said I will be contacting my attorney, after I said that she was able to locate the docs that was sent to them in March. I posted my complaint on Consumer Affairs website and was called by a Social Media Manager from B of A stating he was there to help me get this resolved and that this new account rep can get things done faster than a regular account rep. He assigned me to a new account manager in the social media dept on May 20th, I got a call from that account rep the same day. He said once he receives all new docs he will have an answer from the underwriter in 3-5 days. They received my new docs on May 29th I received a letter from B of A on June 10th stating they received my docs on June 5th and I have been calling my social media account rep 4 times a day since June 11th and I haven't heard from him. On June 17th I received a letter stating they have transferred my loan to Northstar. I was also set to go to mediation by my housing counselor but it was revoke due to them not scheduling the meet and confer. Now I do t know what will happen. Will Northstar immediately foreclose or allow the meet and confer or give me a modification. I really want to save my home<!-- google_ad_section_end --></div>

My First was originally owed by H&amp;R Block and then by AHMSI/Homeward Residential and my Second was originally owned by Green Point Mortgage and then by GMAC and now both my 1st and 2nd are owned by Ocwen Loan Servicing.  On my 1st I owe $402,000 and on my 2nd I owe $166,000.  I am current on my 1st and have not made a payment on my 2nd for 2 years.  My property has gone up and is realistically worth at most $450-500K.  I have several questions:</font><br />
 <br />
 <font color="#333333">1) I would like to do a loan modification on my 1st and settle the second.  I have been told that even though Ocwen owns both loans, the 1st and the 2nd can not share information because neither loan originated with Ocwen.  I would like to know if this is accurate? </font><br />
 <br />
 <font color="#333333">2) My second concern is that if I turn paperwork in for a loan modification on my 1st will make it less likely that I will be able to settle the 2nd?</font><br />
 <br />
 <font color="#333333">3) Should I do nothing and keep current on my 1st and wait till they make an offer on the 2nd or see if they foreclose on the property and what do you think the likelihood of them foreclosing is?</font><br />
 <br />

Been hard year for us. Should I not make the 2 payments to BOA? Make on fist payment to EVERHOME on July 1st 2013?<br />
Does BOA care about late two payments? since, they are sold to EVERHOME? Please, can anyone give me, real honest info.<br />
We have Prayed Daily for financial help and blessing to get caught up. Don't know what to do? Should, I call Everhome before July? We appreciate anyone's help and advice.<!-- google_ad_section_end --></div>

We got NACA involved they postponed the sale date. it took a year to be offered a forbearance, NACA said this was the best they could do, our payment would stay the same as before. We signed and notarized the docs and sent 1 payment, The sale date was canceled and removed from recontrust. We did not make anymore payments after that and tried for a short sale, that took another year for them to approve and by then the offers went away. We were ready to give up, then I read on this website new programs for FHA loan  modifications. Our real estate agent said he would help us get a loan modification but that did not work out, he pretty much got us the same payment as before, we declined that loan mod, I emailed and called, the banks CEO asking why we do not qualify for any affordable programs, within 24 hours I got a call back. In a few weeks were placed on a trial payment starting March 2013, payments have gone from $2750.00 to $1380.34 is this possible?I have contacted the Pres. and CEO in the past never any help before, what is the difference now. We have made all the trial payments plus 1 more, but have not received any permanent docs, called my point of contact he said documents not generate yet he will call me back when he knows something he does not see any problems with our modification, just takes a while to process. Seems to good to be true, what are the chances of this really happening. trying to stay positive<!-- google_ad_section_end --></div>

2008 - Received a bad in-house mod thru Chase.  2010- Received Hamp mod. Loan balance 492,000...2% for 5, 3% for 1, 4% for 1, 5% for life of loan.  Payment reduced by $800 <acronym title="Page Ranking">pr</acronym> mo...resulting in balloon payment of over $280,000.  We were at least 5 months behind.  Servicer was Chase...not a quick or easy process.  By this time, we had went through all of our savings, borrowed from family til the well ran dry, sold belonging, etc.  Fell behind on the Hamp by 30 days w/in 1st year due to unexpected medical expenses, 60 days late each month since May of 2012.  Loan transferred to Ocwen in fall of 2012.  Applied for mod, asking for the SAM in Apr of this year.  Denied due to not being in default (90+ days). Had meeting w/ RM on May 1st and was basically told to miss another payment (in so many words).  Another RM meeting on May 31st...he didn't ask if I had payment this time (which I didn't anyway).  Asked to send in an Apr &amp; May bank statements and Profit &amp; Loss to-date (husband self-employed). Scheduled next meeting for 6/10. Told we were denied for Hamp Tier 2. Next RM scheduled for 6/25...told it would take 30 days to review for other mods. On 6/11 received foreclosure notice from a 3rd party. Called and moved RM  meeting up 6/15.... and much to my surprise we were informed that we were approved for SAM!!!  <br />
 <br />
Good news...reduction of principal balance of 157,000 over 3 years of timely payments, 2% for life of loan, no balloon payment, up to 25% of equity to Ocwen should we decide to sell in the future.  Term not extended, still at 23.5 years. Asked about extending term, but was told that would result in a large balloon pay't. Only 1 trial pay't of $1551 due July 1 and then mod takes effect Aug 1.<br />
 <br />
Bad news...more of a long-term fix as our monthly pay't increased by $70.00 per mo.  We definitely would have benefited by a lower pay't and may not be able to sustain this if we have any unexpected expenses (still no savings), but we're gonna give it our best shot!!  <br />

After 10 months of applying for a loan mod and servicers selling my loan requiring me to submit and resubmit applications and documents I have been denied for a hamp and in house mod. My loan is a Freddie mac and was denied for hamp because it is a rental property. I was denied for the standard mod because they couldn't get the post mod dti between 10&#37; and 55%. Now my only hope is a streamline mod. My understanding is that after July 1st servicers must offer streamline mods to all Freddie, Fannie loans that are more than 90 days late. When I was denied for the in house mod I asked my relationship manager at ocwen about the streamline mod and she did not know what I was talking about. I am worried that they are going to foreclose on my house without offering the streamline mod. Has any one had experience with the streamline mod at this point I have little faith that the servicers will do what they are suppose to.<!-- google_ad_section_end --></div>

After spending hours reviewing posts on these forums, in February 2012 I decided to do a strategic default and allow my condo to go into foreclosure as I was underwater at least $100,000.  The trustee's sale was done May 31, 2013 and I saw that the property was "reverted to lender."  I also just saw that a new deed was recorded June 10, 2013 with Bank of NY Mellon Trust Company listed as the holder.  I know in Washington state after the sale, the owner has 20 days to vacate the property.  However, I have not received any notices or knocks on my door, no mail, no phone calls.  In doing further research since the property was reverted to lender, does it mean I have longer before I need to vacate if I don't hear anything?  Do I have to receive a 3 day Notice to Quit before they can file an Unlawful Detainer and have the sheriff evict me?  I am prepared to move, but want to put if off until I absolutely have to and quite honestly, was hoping to receive a cash for keys offer.  I would move immediately if I received the 3 day notice.  I do not want an eviction on my record!  Am I automatically obligated to move by June 20th, can I wait for a 3 day notice, or am I going to suddenly get a court notice with 3 days to move from the Sheriff?  Just to be clear, I live in Washington state.  Thanks for any input anyone can provide!<!-- google_ad_section_end --></div>

I've been in my job for 20 yrs and I make decent money, however, due to divorce, daughter in college, and $2200/mo mortgage, bills started piling up.  To make a very long story short, after 7 years of using savings, dipping into my 401k, etc...I finally decided last year to file bankruptcy.  It was discharged in Jan 13.  I did not reaffirm my 1st (Nationstar) and 2nd (Citimortgage), and opted to continue paying on time.  Two months ago, I was told that my job will be relocated to Virginia early next year.  I love my job, and at my age, I made the decision to move.  The problem is, I can not sell my house, as I am at least $60k underwater + leak in the basement + badly needs updating.  I decided to just walk away.  My first missed payment was this past May.  So, here's my question....how long do I have before I need to move out (without getting evicted!).  <br />

In Maryland, because "default has occurred after all automatic stay has been lifted due to bankruptcy", MD Rule 14-206 gives the Lender the option to immediate Foreclosure.  <br />

 </span></font>Rule 14-206. PETITION FOR IMMEDIATE FORECLOSURE AGAINST<br />
RESIDENTIAL PROPERTY <br />
 (a) Right to File<br />
 A secured party may file a petition to be excused from the<br />

§7-105.1 (b) and (c) and Rule 14-205 (b) and for leave to file an<br />
action for immediate foreclosure of a lien against residential<br />

My home value is $183,000<br />

I have not paid my Green Tree 2nd since 2011.  The amount owed is $48,000<br />
 <br />
At this point a local law firm has begun attempts to collect the debt, and I assume at some point in time they will eventually sue me.<br />
 <br />
I've made 2 settlement offers thus far, one for 5&#37; and another for 10% both denied.  They came back and said that they will not go below 50%. At this point I'm holding off on making anymore settlement offers. I provided them with a debt validation letter, a recent CMA by a local Realtor. I also provided them with a copy of a faxed document form the original loan originator saying that I was denied the loan that is dated about 10 days after I signed the loan documents.<br />
 <br />
What do you think my next steps should be?  I'm fairly sure they will not move to foreclose, they said something about moving to obtain a partial judgement, which I assume will be suing me on the note.<br />

I would greatly appreciate any insight and advice.<br />

The second Lender was Marix, who has now gone out of business.  The home has been sold twice to different homeowners, once in 2009 the other in 2011.  The second Lender, Marix must have sold to Real Time Solutions after my husband had already left the property in February 2009.  He did not even know who they were and has never signed anything with them, he received forwarding mail to his apartment from previous address.  After he knew the home would be sold on the steps in March he moved out in February (prior to the sale) he was still paying Marix up until December 2008.  Real Time Solutions has been a ding on his credit since 2010 and we don't know how to get them off.  He has never had any dealings with them and never made any payments to them.  He did receive a letter from them but this was long after he had moved and the house was sold by 1st Lender.  RTS has reported him being late every single month for the $538.00 payment he use to pay Marix and the loan balance is showing the full $49,900 with a past due of $25,000 plus.  This is the only negative thing on his credit and its keeping him/us from getting another home because of the large balance.  Is there any way we can get them off since he never had any dealings with them and the house has been sold twice since he moved out of it?  Any suggestions would be appreciated.  We are trying to buy a home this year if we can get RTS off.  We have not heard a word since but it keeps showing on credit report.<!-- google_ad_section_end --></div>

I believed it is a Freddie Mac.  When we were 3 months late, we were served with Foreclosure Papers....and they did not produce the Note.  My husband is employed but we ran into a tough time and fell behind, things are better now.  We got an attorney to delay the foreclosure and we have been in limbo ever since.  We did the same as everyone else, phone calls to PNC, sending and resending docs, etc.  Finally today we get a FED EX from PNC offering a 3 month trial, which was 2200.00 a month.  Our original payment was 2400.00.  There were no details at all in the letter so my husband called the bank and left a message with the negotiator asking for more details.  Does this sound right?  I know it's been 5 years...but we have been trying to resolve this  pretty aggressively...and we want to keep our home.  We also had a HELOC with Chase and that was forgiven about 6 months ago, for about 48k.  Out of  the blue we received a fed ex telling us. I am in Nevada, and I refinanced my home in 2004 with E-Loan. E-Loan was listed as lender, MERS as beneficiary, Lender's First Choice as trustee. Essentially, unbeknownst to E-Loan and myself, the deed of trust had an incorrect parcel number and legal description (it had the legal and parcel # of my old house). They recorded the deed on the incorrect parcel (my previous home). Therefore, when I got an equity loan in 2005, there was no deed on the correct property according the recorder. I filed chapter 7 BK in 2007, but kept my home. <br />
  In 12/2008, got a pay cut, and attempted to get a loan mod... they filed a Notice of Default in3/2009 and the mod process took a year, but after paying 4 trail payment payments, they denied my mod, based on an incorrect income (I made 59k, but they said I made 75k). By that point, I was sick of the run-around, and left the home because they said I would have to re-apply for a mod if I wanted to fix the error. Because I have 3 kids and *they had filed the NoD*, I moved into a rental out of fear that we would be kicked out. I paid 1500/mo for the rental.<br />

The entire time I was in the rental, the house was still in foreclosure. I called the servicer, Aurora, multiple times to inquire I about why the house was not foreclosed on yet, and they never gave me any info.<br />
 <br />
So here's where it gets crazy... Two years after I moved out, I get served with a lawsuit. They are asking for reformation of the Deed of Trust, declarative relief, and/or a lien based on equitable subrogation. I was clueless as to what it meant, talked to a few attorneys, who told me it was no big deal, and further, it was between the banks (Aurora and the home equity bank). I had no money, because I was paying rent... and let it go.<br />

A year later, they hadn't moved on the case, and I was sick of this foreclosure hanging over my head, so I moved back into the house in order to hire an attorney to fight them. I am currently in default as far as the suit... but they have not moved for a default judgment. So, I filed a motion to set aside the default (pro se, because I still have no money- the house was in bad shape, so I had to fix it a bit to move in). I am scheduled to be hard on it in June.<br />

 <br />
  So…. Apparently in 2005, E-Loan (who had supposedly already sold the loan) “discovered” the error, and filed a partial reconveyance to release the improperly encumbered property. Apparently, they were trying to fix the error. They never told me about this. Their attempt to fix the error was completely ridiculous, because it did not reform the deed, it just released the improper property. All of the assignments of the deed have been on the wrong parcel, including after they filed the suit. They still do not have anything recorded on the proper parcel, except for one assignment and the NoD. <br />
  Essentially, there are multiple errors that have been made by them along the way, specifically their attempt to “fix” the mistake. The NoD they filed was obviously improper, along with many other things.<br />

  For instance, in the suit, they attach a “true and correct” copy of the note, which has absolutely no endorsements. The list goes on and on. I have more details, however there is no point in disclosing all of them…. Point is, they have screwed up royally, and I am wondering if any of you thick I might actually have a shot against them?<br />

P.S. – E-Loan, Lenders First Choice, and Aurora are all either out of business or do not work in the capacity to lend/service loans. The current plaintiff in the suit is a new servicer – Nationstar- I have NO CLUE as to who the lender is. The loan was definitely sold back in 2004, because E-Loan was only a warehouse credit line lender.<br />

My loan got transferred to Nationstar mtg in Oct. 2012, this was in the middle of a modification with BofA. I had to submit new paperwork to Nationstar and we eventually got approved for an in-house mod with Nationstar. We had 3 trail payments to make and the mod would become permanent. We sent in the first two payments on time, they were received and everything is going good. We received our final docs to sign on May 4th, the were due May 12, which was a Sunday, that doesn't make any sense, but I digress. We sent the paperwork back, notarized etc on the 8th. We just sent in our 3rd trail payment, should be there today... everything is going great. <br />

My HUD counselor emailed me today and told me that Nationstar never received our permanent doc paperwork. Well, I tracked it with the fed ex number and it was delivered on the 9th and signed by somebody at Nationstar. I sent the confirmation to my counselor and she forwarded it on to the bank and I'm waiting for a reply from them.<br />
 <br />
Meanwhile, I decided to check the public record since I haven't done that in a couple of months and lo and behold Nationstar has submitted an Appointment of Successor Trustee dated May 13th, the day after the final docs were due. I've already been down this path so I know this means that a trustee sale is right around the corner. <br />
 <br />
any suggestion would be great. If Nationstar continues with the foreclosure I will be getting an attorney.<!-- google_ad_section_end --></div>

Payments were interest only for first five years then jumped to principle and interest,needless to say I have rented rooms in order to maintain house payment which is $1758 not including taxes and homeowners insurance which total $200 a month. Here is their offer.........lower interest to 4.1% payment with taxes and insurance would be $1191 a month which would be amazing BUT would include a balloon payment at end of loan (21 years) of 148 thousand!!!!! Does this make any since? The breakdown was $956 principle,rest was taxes and insurance. I am 60 would it make more since to look into reverse mortgage maybe? Really want to leave my home to my kids.Just seems like a huge chunk of cash to pay in the end.She said this was through the making home affordable program with proof that my daughters contribute $1000 a month since I am on permanent disability. does this make sense? At this point I kind of don't trust chase.<!-- google_ad_section_end --></div>

I have been reading the posts on this site for a few weeks, and knew that I needed to join. I will appreciate any advice that I receive.  <br />
This very unusual problem began 11 years ago, in July of 2002. We refinanced our home with American Equity Mortgage to lower the interest rate from 7.87 to 5.875 percent. We didn't ask for any additional funds, we only wanted a lower interest rate. (During this refinance, we found out that our 14 year old daughter,had a brain tumor from the radiation received for the leukemia, and needed surgery). So when American Equity Mortgage, Inc. said they had an appraiser they would send, we thought that would be one less thing for us to schedule during a stressful time with our daughter. AEM arranged for a time we would be at home, the appraiser arrived, and began his assessment. He was here for about an hour, measuring, writing, etc. When he was completed with the appraisal I paid him the $375.00 owed for his work. I then asked him when I would receive my copy of the appraisal, he said before the closing. Two days later, AEM called and said that the appraisal came in a lot higher than they thought it would.(Was aiming for 170K, and it came in at 203,500.00)<br />
I asked if I could please have a copy mailed to med immediately, and they said, "We don't have all of the paper work yet, we will give it to you at closing." We should have demanded to see it before the closing, but we had too much on our minds with our daughter's upcoming surgery. <br />
Again we requested the appraisal at closing, and you guessed it, they still did not have it in their possession. We closed anyhow, and we were promised to have it mailed to us in a day or two. When it did not arrive after 2 weeks, I called AEM and asked where it was. I was told that the mortgage had already been sold to ABN-AMRO, and it was sent with the package. So then I call ABN-AMRO and stated what I needed that I didn't receive in the closing package, and that AEM said they had already sent it to ABN-AMRO. ABN-AMRO said they would look for the appraisal and send me a copy. After a few weeks go by I call ABN-AMRO again to ask if they located my appraisal, and they tell me that it wasn't included in the package from AEM. So I call AEM again, and tell them what ABN-AMRO told me, and AEM said that they sent it with the package, and that they have no further dealing with our mortgage, that we are to call ABN-AMRO for all future calls. It is now December 2002, and still no copy of the appraisal. I can't tell you how many times between 12/2002 and 2007 I called ABN-AMRO for this missing appraisal, every call ended with, "We don't have a copy of your appraisal, it was never given to us, you need to contact the loan originator to obtain your copy". <br />
In August of 2004, our daughter passed away from the complications form leukemia at the age of 17. The appraisal was the last thing on our minds. The next couple years were a difficult time for us, but we made it. Through all of this, the mortgage was only 30 days late 1 time. It is current now.<br />
In 2007, CitiMortgage acquired our loan from ABN-AMRO, and I am again requesting the appraisal, which of course is still missing. Citi now asks if we would like to lower our interest rate, and they send out their appraiser, and tell us that if the appraisal isn't high enough to refinance what we owe ($175,000.00) that we didn't have to pay for the appraisal. Well of course it wasn't going to be high enough, the housing industry was just starting their nose dive. The appraisal came in at $160,000.00, so the rate remained at 5.875 percent.<br />
Sherlock Holmes must have come back, because the missing appraisal finally surfaced after 11 years. Well we know now why it was kept from us, I think the only thing that was correct on this fraudulent appraisal was our names, address, and the parcel number.<br />
The obvious false things, (and there were many).<br />
 <br />
1.    Neighborhood<br />
-    Distance from XXXXXXXX(major city) is 35.47 miles, not 25(On report).<br />
-    Closest Shopping Center is 17 miles away (report stated we were very close to) , at least ½ hour drive, that isn’t convenient.<br />
-    Xxxxxx NEVER had Public Transportation(report said we did), you can ask for a taxi (XXXXXX Taxi Co) 9 miles away the day before for a $36.00 fare for 16-19 miles. That sounds affordable.<br />
2.    Site<br />
-    IT IS A CORNER LOT; appraisal says no.<br />
It is irregular shaped, a triangle; not Rectangular/Typical as report states.<br />
-    ACREAGE SQ. Footage is 25,319(Survey as per XXXXXXXXX County Tax Records); not 27,144<br />
-    There is a 25’x 25’ utility easement in the corner of the property, “Easements – Non Observed” We are on the corner, we have XXXXXXXXXPOWER, XXXXXXX GAS, XXXXXXXXXXXXWATER, XXXXXXXCABLE, all with easements on our property.<br />
-    SQ Footage on home is 1737, not 1809<br />
-    WE Have Public Sewage, not a septic system as stated on this report. <br />
 <br />
3.    Description of Improvements<br />
-    WE DO NOT HAVE A FOUNDATION; THIS HOUSE SITS ON CONCRETE PIERS. It has a crawl space with an attached garage. There is a brick façade that looks like a foundation, but it is not one, the report states a full foundation.<br />
-    IT IS A MANUFATURED HOUSE (Sxxxxxx – XXXXXXXXXXX 1047CT) SERIAL # XXXXXXXXXX. The appraisal states “MANUFATURED HOUSE - NO”<br />
-    We NEVER have had either WOOD doors &amp; trim, it is all paper over fiberboard.<br />
-    WE DO NOT have an ATTIC; listed as scuttle attic on the report.<br />
-    NO COPPER WATER LINES, ever, as report says we have.<br />
-    NO Jacuzzi and SKYLIGHTS in the MASTER BEDROOM, ever, report claims these are really nice features.<br />

There is a lot more, for a later post on this appraisal. The bottom line is, the supposed professional appraiser should know this, he looked at everything, and also took pictures. How can we receive a refinance at a low rate, (we have good credit) with this mess? It isn't worth half of what we owe, and it is a manufactured home, that a lot of banks won't touch. It is a Freddie Mac loan.<br />
So I contacted the PA State Attorney General today(<b>thank you Loan Safe for the information</b>), explained the mess, and was instructed to file a consumer complaint for withheld information causing a poor decision.<br />

Currently in foreclosure<br />

Chase has been trying to get me to short sell this investment property for the past year - now they are saying that there is a good chance they may be willing to waive the deficiency but of course say they need financials in order to do so.  So far I have not provided them but if they really are forgiving the debt (as they claim) I am considering it.<br />
<br />
I have no liquid assets (cash, stocks, bank accounts), my only assets are exempt in the state of Florida.  My peresonal residence is owned free and clear, worth approx 400k (is homesteaded meaning they cannot take it) and the remaining assets are in my retirement plan (exempt by federal law).  Income is 80k however may not be long term (changes are coming in my company next year).  So my thought is share the financial info with them, they will see I am "judgement proof" and perhaps they will be more inclined to waive the deficiency.  I will not short sell the house without the waiver in writing.<br />
