We have a primary with Bank of America with a balanceof 117,000 and a second with Bank of America for 44,000.  We have just made interest payments on the second.  Houses in our neighborhood areselling for about that - 160,000.  We are 2 months behind on both. Today we got a letter that our loan was sold to Seterus.  Itwas for the first - not the second.  We don&#8217;t particularly wantto stay in the house as our income is down substantially.  We talkedto B of A a couple of years ago and we did not qualify for modification becausewe refinanced after some date that mattered.  We have no money to fixup the house or to pay realtor fees.  </span></font><br />

With all of the you cant get a loan after bankruptcy and/or after foreclosure for 2-3 years confusion (one person says after bankruptcy another says after bank takes the house another says with a 15-20&amp;#37; down payment). I am in a wheelchair and this house is halfway accessible as I get older things are getting a little harder for me to do. Not to mention we just had twins 8 weeks ago... we are just running out of space. The house needs a roof, furnace, and if my health doesn't get any better a bathroom remodel. It doesn't make sense to stay if there is an option to leave. we are now thinking of dropping the house for something with a larger accessible floor plan and bathroom I can use properly<br />

Apartments that are accessible usually only has 1-2 rooms and are more expensive then what we are paying to &quot;rent from the bank&quot;. <br />

I purchased our house before we were married. The property only has my name on the deed and note. My wife's credit report shows no mortgage loan, the county auditors only shows my name on the look up. <br />

Could my wife get a new house loan after we rebuild her credit over the next couple years and save for a down payment  She has worked full time for the past 5 years in the same company around 34-35k a year. <br />

Also the lawyer said that we could stop paying the mortgage and save for the down payment also over the 6-12 months the bank takes to start the foreclosure process. <br />
 <br />
We live in Ohio<br />

We filed for Chapter 7 in Nov 2011 nad it was discharged in Jan 2012. We filed paperwork to have our debt reaffirmed with CHAse only to find out that it wasn't. I/We have paid on time for the expception on of when we asked for a 3 month exception. (Suffered significant losses from Sandy, needed mortgage money for heating system) We made our payments current within two months and got off their memoritorium (sp??). We were prior to Sandy and after the memoritorium. <br />
 <br />
What options do we have to refinance our home so that it can be reported to the credit bereau? Also, thinking about making it a rental property so I would have have this prior to moving out. Not planning on foreclosing on it, was never our intent. We had way too much credit card and I had lost my job. We couldn't keep up so we cut our losses. <br />
 <br />
We did buy a Van on a payment plan and obtained two credit cards to help improve our credit scores. I am employed as well now. Credits scores are starting in the 640's.<br />

What has popped in my head though is the agreement references the secured interest and value listed corresponds to the principle balance. Past due interest isn't noted. Should it be or is that part of the 1099? Basically wondering if there is exposure to come after accrued interest/fees after the fact. Lawyer obviously isn't in tomorrow to double check. Didn't know if this is standard language or if I need to hold off.  There is no promissory note involved.<!-- google_ad_section_end --></div>

I've sent my short sale request to Chase about 2 weeks ago and they have been good so far in responding to my request.  I have an appraiser set to be at our house in a few days.  Our house has been on the market for 9 months with no offers or many showings.  We bought our place in December of 2009 for 153k did a 100&#37; USDA loan(big mistake) we now owe 145k but the market has fell in our area.  Our agent has sent Chase 5 sold comps that have closed this year and 6 that are currently for sale, but he feels a fair market value for our house is around 130k.  Does anyone have experience with Chase's values and what the percentage they normally approve compared to the figure the appraiser says our home is worth?  I've read 85% but has anyone else seen them take a lower percentage?  We are current with our mortgage and have never been late, but I've made it very clear to them upfront that my savings will run out in September and we will not be able to make the October payment if we don't sell before then, I know there are those who say they won't help those current but I can remedy that pretty quick if necessary.  Anyone who can shed some light on my question would be so helpful.<!-- google_ad_section_end --></div>

<font color="#333333">Original Loan 80/20 interest only- $125,000 Countrywide (now Green Tree) / $30,000 HELOC countrywide (now SLS)</font><br />
<font color="#333333">We still owe almost every original dollar borrowed because of the interest only</font><br />
<font color="#333333">Fair Market Value – $120,000  If we're lucky<br />

<font color="#333333">I stopped paying as of April 1st.  Got a Notice of Default in the mail today.  It has language that states that if I do not cure the default in 30 days maturity will accelerate.   </font><br />

<font color="#333333">We fully intend to walk away but we're looking to prolong the FC as much as possible to collect the rent.  DH is active duty military, currently deployed.  Is there a way to use that to our advantage?  I should add my name is not on either loan or the deed.  </font><br />

<font color="#333333">We have little in the way of assets as our current home is also about $30,000 underwater and after that it's just debt, the car (has a loan) motorcycle (also has a loan)  and a few hundred dollars here and there for an old IRA and kids' college accounts.  Nothing to worry about them coming after, correct?  The rent being collected is being spent on necessities or pulled out via ATM and stuffed under the mattress so to speak.  </font><br />

<font color="#333333">Where do I go from here - whats' next best to stall.  I have a uniform borrower assistance form packet they sent me, but it requires ALL of my info and from what I understand I shouldn't be giving them any info.  I'm sure Green tree is pissed they are calling DH's phone and it's been shut off!  <br />

Will they even communicate with me?  I have a special power of Attorney specifically for this property, I just have to let them see it I suppose.  <br />

I was one of the ones that was foreclosed on while on Active Duty.  My check was for $125,000.  The problem is that the check was made out to myself and my ex wife.<br />
<br />
Here are the details:  In 2005 I bought a house with my now ex wife.  We were divorced in 2007.  Her attorney was a real "bully" during the divorce and threatened me with all kinds of stuff if I did not take the house in the divorce.  So I did and after the divorce I never saw her again.  In 2009 the house was foreclosed on because I just could not afford it on my single income.<br />
<br />
I never knew anything about this review that was going on.  I received the check in the mail this week and when I realized that she would have to sign it I made contact through a friend.  I told her that I had been in contact with an attorney and the money was mine.  However to make things go smooth I offered her $25,000 cash.  She was blown away and excited.  <br />
<br />
She asked how much the check was for and I told her, (she was going to see it anyways when she signed it).<br />
<br />
We agreed to meet and have the check deposited into separate accounts.  The next day she emailed me demanding 1/2 the money.  So I contacted an attorney and he sent her a letter stating that she better accept the 25k or we would go to court and she would get nothing.  <br />
<br />
She in turn got an attorney and demanded the entire 125k be given to her.<br />
<br />
I used my VA loan for this home and therefore lost 140k from my VA eligibility.  <br />
<br />

I have had no real luck finding a job paying what I was making previously ($60k).  I have been on a reduced payment with BofA that is about to end in June.  I am seriously considering not paying and seeing how long it takes them to foreclose.  I hear it takes a really long time here and maybe I can save some money since I have used up all of my savings since my unemployment ran out last June.  I have always paid everything on time and used to have great credit.  I have no credit card debt anymore, I negotiated with all of my credit card companies and they took less than what was owed.  I am 48 and single.  I am feeling very much alone in all of this.  The forum really helps though.  I had no idea how many people are out there going through the same thing.  <br />

I hate not paying but I really don't have a choice.  I just don't have the money.  I love my home but with the lower payment, the balance has been added to the mortgage and now I owe $169k on a condo with an original $153k mortgage that is now worth $130k.  <br />

I did not file bk on my company, Bad Luck LLC which owns investment property because there was no chance of getting a discharge.  There is a currently a 200k plus judgement against Bad Luck LLC and several other lawsuits pending.  <br />
<br />
There is a property owned by Bad Luck LLC that has a first mortgage and a Line of Credt (BLC) as a second with another bank.  The first is current and the BLC has been charged off at least 1 year or more ago.  I would like to retain this property if at all possible.  However, the judgement issue needs to be resolved.  Negotiating with the the creditors that are suing Bad Luck LLC is not an option at this point.<br />
<br />
<b>My Stategy</b> - I, via a newly formed company (New Start LLC) will purchase an assignment of the BLC because settling does no good because of the judgements and pending lawsuits.  New Start LLC will eventually foreclose on the first mortgage from the second position and take control of these properties.  I have contacted the second and the rep I spoke to was not sure if they could do assignments and recommended that I speak with their attorney.  I plan to have my attorney present the BLC attorney with an offer from New Start LLC to purchase the assignment at a significant discount of course.<br />
<br />
<b>My Questions </b>- <br />
Question 1 - How should my attorney present the offer to the BLC attorney?  Please see Question 3 for context<br />
<br />
Question 2 - If my attorney is asked by the BLC attorney about the nature of business for New Start LLC how should my attorney respond?  <br />
<br />
Question 3 - Should he say that New Start LLC is in the debt collection business not mentioning my name     OR      Should he say that New Start LLC is an entity that I have formed post BK and that I am trying to settle the LLC debt and the only way I will settle will be to purchase the assignment  OR Should he say something completely different?<br />

My husband has a second mortgage with CCO. We've tried a couple of years ago to get a modification but CCO would always delay and we would have to send in multiple documents every month. Our finances improved so we became current and was able to pay until about October of 2012. We have been struggling with paying them (we are current with our 1st mortgage) so we did not pay for April 2013. We turned in paperwork once again for a modification. I highly doubt we will be able to be modify as my husband, when work is good, (he's a mechanic on commission) he makes decent money. The last few months have been the worst we've ever seen. And he's been doing this for almost 30 years. <br />
<br />
We are prepared to just let the 2nd mortgage go and we are extremely upside down in our house, even if it was just the first mortgage. We owe around 68k on the first and 54k on the second. Our current tax assessment of our house dropped again this year to about 42k. From reading the posts here, I don't think CCO will want to foreclose on our home (even though every letter we get says they will). <br />
<br />
My question is this: We don't have the funds to even negotiate a settlement. If we did, we would pay our debt. What will happen if CCO doesn't modify our loan? I've read it will go to a collection agency (we're quite aware of them since we've dealt with them before). My fear is that the CA will try to garnish my husband's wages. We're a one income family and we would definitely lose our home if that happens. So what should we expect if CCO doesn't modify our loan? Thanks so much for the input. This site is a blessing!<br />

Here's the story.  I am looking to settle second mortgage (HELOC) and have read all kinds of advice on the loansafe forum, specifically from Tom Eason.  Great advice, and I'm taking my time with the steps.  We went through chapter 7 bankrup(Michigan), which was discharged back in November 2012.  No payments on second since late 2012.  First is current.<br />

I sent Chase a letter authorizing them to contact me about settling the second mortgage, and they sent me a couple letters about calling them.  I resisted, then relented.  I called them, and of course they wanted to take the call in a different direction.  I simply ignored everything they tried to do on the phone and stated that I sent a letter in about settling the second.  I was told that I had to send that letter via fax, to a specific number, with an offer... and that Chase looks to get "arounjd 40&#37;".  I faxed my offer (around 6%), and within two days, received the letter and form about the third party.  I don't even know what it means.<br />

 <b>I'm confident about the direction I'm headed, based on all of the great advice I've read on settling seconds.  I just need to know what this letter and form is abuot.  Is this something (the two page form) I should fill out and send in?  I can give more information to anyone that can help answer this for me, if more info is needed</b>.<br />

Because its not my primary residence its considered an investment property. Im told that most banks wont do anything on unoccupied co-ops because Freddie and Fannie won't buy them on the secondary market. I was informed that only portfolio banks will do it, so i searched out a couple, but it didn't work out. so i sought out a mortgage specialist. i was going to rent it out for ~2K (which is cool with the board) in order to pay back the loan but the mortgage specialist that i am dealing with said the banks DGAF. i will do anything to keep this property but I'm financial hell. would it be possible to get a personal loan with the property as collateral? I don't know what to do and the clock is ticking.<br />

They charge $2500 for "phase one" which is basically getting started. They charge another $1500 once the terms are finalized ("phase two").<br />
 <br />
The address they give is in Newport Beach, CA, but I cannot find any information on them on the web...good or bad. What I can find looks like they wrote it themselves.<br />

I was wondering if anyone has heard of these guys, and if their service is legit. They claim to be able to work on a modification much more aggressively than I can on my own because of all the lapses the mortgage companies had with paperwork, compliance, etc.<br />

They get the loan info and property info, look up the originating mortgage company, and then let you know if you are approved or not for their program.<br />
 <br />
In some ways, it seems very legit. In others, it is scary. I have not been able to find anything on them on the web.  To pay, they want you to ACH or deposit money into their bank account.<!-- google_ad_section_end --></div>

Now Chase has just sold my loan to Residential Credit Services.  They are harassing us with phone calls 5 times a day to get a payment.  The phone calls start on the 1st of the month when we are still in our grace period and continue until we pay.  They want a post dated check by phone or they will continue to harass.  I thought they weren't allowed to try to collect on discharged debt.  Any suggestions?<!-- google_ad_section_end --></div>

Here is my situation. I owned this house since 2004<br />
I am current on my first loan  never been late. I dont pay for 2nd .The thing is i dont live in my house right now. I got laid off and we had to move to a cheaper place . I am renting my house right now to section 8. We all know they dont pay a lot. <br />
What happens to my house?  Can chase go after my house and foreclose because i dont live in it or it doesnt matter<br />
I dont want to loose my house I want to settle with chase for a &#37; if I can.<br />
What is my options? Please help<br />

My husband lost his p/t job 3 years ago and ever since then its been a nightmare around here trying to pay bills.  So we filed chapter 7 bankruptcy which is now in the works and notified wells Fargo.  Our court date is in early June. I applied for a loan modification loan online and had my husband call there shortly after I submitted the form.  The person told my husband that we did qualify, we couldn't send in any pay stubs or tax returns because they are in the hands of our bankruptcy attorney so wells Fargo called there and got the info.  Now wells Fargo told us we needed to make 6 trial payments of a lesser amount than our house payment because with his job loss we just could not afford the house payment. We had to sign some agreement papers.  Now what I would like to know is what happens after the trial period is up?  Will they issue a a modification loan?  He was told that if we missed one of these trial payments the whole thing would be null and void and they would want the regular house payment.  Can someone explain this to me? They won't talk to me, since my husband was the one who made the itnial call, and I am very worried that we wont be able to afford propane this winter to heat our home.  Please reply with any info to help me out here, thank you so much.<br />

We have been trying to sell the place since 2006 and were approved for a short sale twice in the last 3 years. We brought a bona fide potential cash buyer to Chase &amp; the offer was for $200k. Chase has been either giving us the run around for 18 months now &amp; we were served a summons for nonpayment of mortgage. The building has been hit by two flood events in the past 2 years &amp; each time we poured every dime we had into trying to keep afloat.  All three of us have financial problems &amp; 4 hardship letters were sent to Chase. Each time there seemed to be administrative screw-ups at Chase &amp; trying to talk with a knowledgeable person proved impossible.  We also applied for a DIL twice over 18 months ago &amp; were told no.  We continued to try &amp; short sell, but Chase will not accept the offer on the table, saying that it is $100K too low!! We just received "Request for Judicial Intervention" paperwork yesterday, indicating that Chase is proceeding with foreclosure. Can we still do a DIL? If so, how can we get someone of authority to talk with us to try &amp; resolve this matter. I appreciate any help you can offer.<!-- google_ad_section_end --></div>
