Can someone please answer this ?

So, my house has a padlock on the front door. Is this prop still considered mine, or is it the prop of the bank? The house will be set up for auction late April, so I don't understand why they did the walkthrough and secured it already. What's your take on this?

Thanks in advance for your response.

I can't remember leaving...when did you you stop making payments? No NOD in AZ, right? I can't answer your question but now you are making me scared!

Re: Can someone please answer this ?

In California if the property is vacant the bank of the loan has been securing the property. (even if they have not taken back the house yet thru foreclosure) You might check your loan doc's to see if this provision is in there.

Is there a sticker on one of the windows or on the door stating a preservation company? If so you can call them to get access.

I really don't want to go back, I just want this to end and I feel it's closer now. There's nothing I want back from the house anymore...not even dust bunnies

I stopped paying September.

LeavingAZ, did they give you warning? Did you turn in your keys to them? Did they know it was vacant before they locked it up?

When a home is "abandoned" and a lender takes reasonable steps to assure that is the case, they can take reasonable safeguards to insure that their collateral is protected. I'm sure that's the case here.

And they do send people out to check. It's all part of a well oiled machine to process these foreclosures. I've had two people physically come to my house. If they find it vacant, they secure it up. I'm still in mine, so all they did was tape up a notice, which I quickly tore down.

Yep, I sent the keys even though my neighbor said this man used another device to open the door. I left my house fast and didn't ride out the process...which I should have to save more $.

Is this property still considered mine?
