Can I file my income tax without 1099C

***, Moe and Professor Shays,
I have not received the 1099C for the forgiven debts due to Short Sale from CW. I tried to call the 866 and 800 number but to no avail. Can I file my income tax without 1099C from CW? Do I get it from the investor or CW?

Thanks.

Re: Can I file my income tax without 1099C

Hello this is from CW Negotiator.

I asked him about the 1099C and he emailed me saying:

[B]The investor Fannie Mae or the mortgage company would send you the 1099. It may be that they are not sending you one if you have not received it by now.

I also got information from someone saying that it's a Short Sale and the balance is forgiven so the mortgage company will not send me a 1099C. Do you know if this is true? Can I file my income tax without 1099C.

Any info is greatly appreciated!!!

Re: Can I file my income tax without 1099C

Did you put in a change of address so your form would get to you? If you are supposed to get one and you don't, and you do your taxes, the IRS will eventually find you and adjust your tax return. It is up to us personally to make sure we have it, and the IRS says it is up to us to contact the lender to get the form.

I'm not sure about short sales and circumstances when you wouldn't receive a 1099. But like I said, if you are supposed to report it and you don't, they IRS will catch you eventually. Check out the IRS site. There may be some guidance there.
