(I am in California) Been working on a modification since about the same time. Got a few 'denials' and had a FC date in Dec. Had that postponed as they finally got the correct info they needed (after re-sending a few times). Modification has been in their offices for over 2 months, they still tell me to 'call back in a week or two'. I dont trust them. In the mean time I sent them a QWR in November which they confirmed reciept of in December. 60 business days has passed and I have NOT heard anything! I dont have the $ for an attorney but want to work something out with the lender. Since they havent responded to the QWR, would filing a lawsuit against them be a good idea or just remind them about the QWR? Not responding to me is a violation and I believe they are violating some CA law that they have to compare the loss of a FC to a Modification. Hands down a Modification is in their best interest as well. Balance is around $600k (including all the crap fees and interest), value is probably $400-450k. File lawsuit? File an injunction? Squat? |
