Hiya Daniel

How is life treating YOU? Another great bunch of students this time around? If you would be so kind when you have time to answer a couple questions. I am in need of further education for my dealings with First Franklin/Home Loan Services. First, I have certified mail at the post office awaiting pick up has of yesterday. I was going to do it today, but chickened out I called for any updates today. The loss mitigation department is once again pushing me to list my home for a short sale. Oh and telling me I can keep it out of foreclosure with one payment before Feb. 1st. I should start the whole loan mod all over again. Nooooooooooo, thank you. These guys have lied so many times I have no way of knowing the truth. The denied short refi offer in Nov. was for 50k more than it is worth today. If they didn't accept it then it doesn't make sense to me to go through all that for another denial. Am I missing something? Also I was told the only way they would accept a DIL is if after three months on the market with no offers. Is that true? I can't do a DIL unless I list my house? These guys are pro's for not keeping their stories straight. Thank you in advance for the great advice, Catherine

Hi Catherine I know this was intended for P. Shays, but just wanted to toss in something that I've noticed with our lender. Anything they've EVER sent us by certified mail, they've also sent multiple copies thru regular mail...It's reached the point where I don't even bother to go pick anything up from the actual post office anymore if I've just received a bazillion other copies in the mail of something....10 times out of 10, it's the same dang thing............

How are you these days? I see you all the time here doing what you do best Helping to explain this process and answer questions is so kind of you to take the time. If I may ask your opinion once again for a clear understanding of my NOD. I have come to the conclusion my lender or servicer has very dirty dealings with the motive being foreclosure with the tactics I keep reading about. I have also realized unless they are called on doing legal and illegal foreclosures nothing so far has changed their idea of business as usual way of dealing with it's customers. If you would be so kind on this one has always I appreciate your input. My NOD had a list of companies that make it all the more confusing. With the copy sent to me did not match the copy at the county that was filled. On my paperwork it listed a bank out of Germany the county has no record of. The part on my NOD about being contacted prior to the NOD per California Law did not have a name. Just a stamp. The county record showed who signed that. Here is the part I am confused. It says a man contacted me Jan. 12th. Daniel I swear I have NEVER heard this person's name in all my dealings. What does that say in my fight? Thank you and Happy Sunday, Catherine

Wow your fast, thank you. I wish I could scan and put my documents in an e-mail form to let you see them. One I have no way of doing that since my printer/scanner is broken plus I have no clue how. I recently went on a NACA webpage and found an Attorney that meets all my needs. At the moment the documents are with him while he is in the process of preforming a forensic audit. I have come to the conclusion my loan servicer has no intentions of working with any of us. They way they are treating the requests keep leading to foreclosure. That tells me after all my time and effort to save my home it was a waste of time trying on my own or any non profit agency for they get the same run around that ends with a denial. I has always appreciate your time Daniel. Wish I could have been able to show you my picture. Both NOD's say National City, First Franklin, Home Loan Services, MERS and now LoanStar has acting trustee to see the foreclosure completed. This German Bank is the only one mentioned on my paperwork. The person who claimed to have contacted me is listed by name at the county. If I get those back soon I will work out a way to get them to you. Happy Sunday, Catherine
