NOT Vacated but Saxon Changed Locks, Things Stolen

I have a thread around here somewhere abt Saxon Mortgage. They purchased our loan a mo. after we bought our home. They'd tack on fees, change way they'd accept our pymts, etc...ended up trying to foreclose after they'd built up a large sum of $ that we were not going to pay. We filed Bk 13 which kept the monkeys off our backs. While our atty was trying to negotiate w/ Saxon to fix their accounting method w/ us & to get them back on track w/ us they put their foreclosure mill atty onto us. The paperwork w/ ridiculous loan workout is outrageous...after a few more mo. of neither of us agreeing to one another's demands we told our atty to tell Saxon to take the blasted house & shove it up their rear-ends. We then filed Bk 7 knowing that was our only way away from them at the end. Our atty told us stay in the house til it's foreclosed & we get eviction notice, etc....keep paying insurance and so on and that we're still liable for taxes & such. Well I found a place to move w/ a fenced in backyard that we'd planned to do at our house. The backyard is awesome here....layers of yard divided by stone walls, pond, arbor, etc... NO it's not ours but...it'll have to do. Hard to make the decision to give up my home. DESPISE the thought of renting...but then if the furnace goes or the roof blows off it's no longer MY problem, that's the ONLY thing that gets me thru this. So I took this new place & due to me working overtime all the time my husband & son moved ryder load after load here. I still have as much stuff in my house as I have here. I've vacated NOTHING. It's more than obvious that i'm still in my home. Between Dec. 17-20 I noticed my lawn mower on carport was stolen. Today, Dec. 27 I go to move yet more. There were orange stickers on each door that say 'winterized.' I go to get inside & notice my locks were changed. We have received NO letter, no eviction, NO notice of sale, NOTHING from ANYONE!!! Yet my atty told me stay there? Good thing I didnt...i'd come home from work & wouldnt be able to get in. I almost bust down every daggone door today but remembered a way to get inside. Moved 3 more loads. BUT also realized they've also removed & stolen my propane tank from my grill. My father passed away 3 yrs ago yesterday & I had his 2 xmas presents still wrapped in a closet from that year. I'd just seen them last saturday....still wrapped. NOT now...someone ripped the hell out of the box & wrapping paper to get inside...guess didnt like the gift so they didnt take it. How dare they. That was the last straw. They've been thru EVERY nook & cranny in the house digging for anything of value. I dont know if my husband got all of my jewelry (some passed down from family)....now that I've thought abt it there's one large jewelry box that I can't think of where the hell it is. I remember seeing it in the room my home office was in at my house.
What do i do abt all of this? Yes, theres a # on the winterizing sticker which I have the sticker from the front door. I've sent my atty an email in case he reads it this weekend. But I'm NOT calling this place until I get in there & finish getting my things...i dont want to let them know i've been in & have them pull a truck up to steal whatever else they want while I turn my back. I dont know what to do. There was no eviction, no nothing, not even a notice of auction. The house still looks lived in. I'm at a loss. To me it is burglary for taking my things. Losing my home is bad enough but who in the hell has the right to steal your things while you're moving? I'm in a horrible panic. I'm getting some candles together to go back over there tonite since i have alot of boxes & totes near the front door. This is insane. I'm just looking forward to reporting all my things stolen. I want this **** in jail. Not to mention I send folks to jail for a living anyways so this will not look well for the person considering I have such high regard & respect in the courtroom. I want this person to serve every day up to the year allowed (but then again....it's now grand larceny w/ the other items & not just the mower at misdemeanor larceny.) But to open a gift that I cant part w/ that was for my father that I never got to give him? Unacceptable. Any advice from anyone?

Wow, that is scary. It could have been a burgular or an inside job, but either way I would do the police report immediately as well.

I thank both of you so much for your reply. I'd planned to file a report but once I give pd the info w/ the co. name that 'winterized' I dont want them contacting that place until I'm able to get everything of mine out of the house. I've got most everything upstairs that I want boxed up that I didnt get out today but plan to tackle the basement starting early in the morning. I'm to the point now that I'm just getting out what I want most. Then I'll file that report for burglary, vandalism, etc...

I'm sure this had something to do w/ Saxon Mortgage. As far as them having someone do driveby's doesnt surprise me...they've tacked probably a dozen or more of those fees onto my loan. Most of those are probably bogus but what gets me w/ all of this is the house still looks lived in & that was a main concern of mine to begin with so that noone thought the house was empty or close to it b/c I didnt want it vandalized. The new doorknobs have 'Protect A Lock' on them. Like that would stop me from getting into MY house to get MY property. Luckily I knew a way in the house w/out having to bust the blasted doors down which I'd have done anyways. It's been a very messy 2 yrs w/ Saxon but this is the last straw. I do plan to file criminal charges & someone will end up in jail over this. I was hoping the mower would end up at a pawn shop b/c one must show ID to pawn anything & all the pawn tickets are sent to the police depts to be entered into their system. My husband was already on the phone calling the # of the 'Danger, property has been winterized' sticker that I took off the front door....I told him hang up, give them no clue I'd been there. Everyone just beware of 'First American Field Services'....it was either someone from that co. (yeah i have the rep #) or the locksmith (he'd lose his certification with Dept. of Justice). All hell will break loose once I get the rest of my most important things out of the house tomorrow. I have no problem pressing criminal charges against anyone b/c I do it everyday w/ my job. Chase thieves all day...was I busy doing that or in court while someone is stealing my stuff from home. Amazing. Thank you both again so much. Any other advice other than getting w/ my atty?

Hi puter99. Man that is just a kick in the gut when you are down. I'm sorry for your loss. There was a news story here in Arizona a while back. A man was going around to foreclosed homes, looking for items and then posting them on craigslist. I can't remember the details but I think he'd break in, then meet the buyers at the home, act like he was the owner, and sell the item. I think he was selling the appliances.
