    Complied with DIL w/ BOA - once we complied, they foreclosed anyway

    My wife had a mortgage with Bank of America on a home in Georgia. She has been trying to get an offer to request a short sale, but no offers received. REDC finally offered a DIL, and my wife complied with the terms of the DIL. We spent a week getting the house emptied, moved in with her parents, and then cleaning the house and yard. Once we were out of the house, they secured it, and then BOA reps couldn't answer her questions.

    The house was sold later at foreclosure sale, even though the terms of the agreement were followed. BOA and REDC have been giving conflicting information saying that they would rescind the foreclosure, and process the DIL. Then BOA tells my wife that they can do whatever they want today.

    It seems like the DIL was only offered to get us to leave the house immediately and in good condition, negotiated a legal agreement in bad faith. Is there anyone to complain to in order to help elevate this issue, or should we just share our story with as many folks as possible so they aren't taken by the scam that was used against my wife to vacate her property? Not sure what to do from here...

    IF you had an agreement for a deed in lieu signed and executed by BofA, you should take it to a real estate foreclosure attorney in your state for review for illegal foreclosure.

    You should also file a complaint with the Georgia attorney generals office and the OCC which oversees BofA as well here;
