    NOD in WA??? question?

    We were sent a NOD certified mail, not posted on property, not sent regular mail. We are only in our second month of default, is this for real? Or are they trying to scare me into paying?

    ETA we are in Washington State. Our grace period for our second month was on the 16th of this month, they attempted to deliver this on Friday which was the 15th.

    ImaWAwalker - Hi there. I know its scary to get that certified mail. I got mine in 8/11, which was after I stopped paying as of 2/1/11 (6 mos), my actual NOD was posted on my house around 5/18/12. I also received several via regular mail in Aug 11. So, I think the early, mailed ones are for informational purposes (and/or scare tactics). They don't have to record the NOD in WA state (I learned that here on LS). I looked constantly online for the NOD. The NOS however does get recorded & is also supposed to get posted on the house.

    so they DON'T have to post the NOD on the house? How will I know if it's the real thing or not? I guess if I get a NOI or NOS....?

    They do have to post a NOD, but they don't record it in public records. They do both with a Notice of Sale.

    For clarification, I pulled out both my certified mail NOD from Aug 2011 and my actual NOD posted on the house.

    One of the differences is that the real NOD they post on the house actually refers to a Trustee Sale #. It is also signed by someone. It also refers to your name in terms of it being addressed to John Doe, a Single Man. The actual NOD posted on the house has a very detailed accounting of the past due and fees. The NOD via certified mail only had a total past due that was not detailed.

    I imagine that all the lenders vary in terms of their time frame for doing a FC, like others have mentioned Green Tree going faster & perhaps BOA going slower.

    I hope this helps some as I know it is nerve wracking not knowing what is going on.

    I suppose it doesn't really matter, I know I have until January bare minimum. I'm hoping that I will file for a meeting, that will at least buy me the 60 days. The date on the NOD is the 12th so I should probably put it in the mail by the 7th so I know it makes it there by the 12th and I'll be sure to send it certified signature required... Those little stink butts! I wish we had done this a long time ago... We would have been with bank of America and not Green Tree... =(

    IWAW, you probably remember this, but I have both BOA (1st) and GT (2nd). I received a certified mail NOD letter today from GT. I'm posting the info on my thread.
