I live in Georgia and my home was in the Short Sale program for 8 months. I had many offers on my home, but all fell through. My Short Sale program ended on 8/1/11 and I requested to be considered for Deed in Lieu of forclosure in August. I sent Bank of America all the necessary paperwork and was told to wait. I started calling BoFA again in late Sept to get a status update and was told that my home was still listed as being in Short Sale. I explained that it was not, my realtor sent all the necessary paperwork and they promised me they would correct it and move my file forward. I call every week, and I am told the same thing...."your file shows that your home is still in Short Sale". I have spoken with Supervisors, and my "Specialist" (who no longer returns my phone calls or emails) and still the same response--my file is sitting on someone's desk.
It is now January and my request was made for Deed in Lieu in August. I was told that banks had 90 days to complete the process, but BoFA has not even acknowledged my request. I send updated finanacial paperwork each month like they ask. My home has been vacant now for 16 months and my homeowner's insurance has been cancelled. I am thinking about writing my Congressman as this seems to be fraud in that BoFA is purposefully stalling on letting people apply for the Deed in Lieu program (I mean I can't imagine that all these employees at BoFA are that incompetent!). I would appreciate any advice!!
