I haven’t received the notice yet, just saw this on the county website. It was filed by MTC Financial in Calif. Also, they included my partner on the NOD, yet she is not on the loan, or the note and she filed a quit claim deed over 4 months ago. She should not be a party in this at all. Anyone have any ideas on how to proceed? Perhaps it is time to see a lawyer. |

When serving notices of default the banks go out of their way to notify all parties that may have an interest in the property (because as I understand it the law requires them to). Her being sent a copy of the NOD does not mean she's a "party" in the matter, just that she had a vested interest in the property at one point and needs to be notified of the default (in case she wants to cure it to secure her interests, for example). It should not have any negative impact on her so long as her name is not on the loan itself. | |
