Mine came certified mail and had the heading 'Notice of Default'. I confirmed this on my local county recorder site which had it publicly available.

Fortunately, It's the same day we move into our rental, so the timing couldn't be better. I plan on having most of my stuff out by the sale date, and to negotiate a cash for keys afterwards.

Unfortunately, it is far from over. In fact, the hard part is about to begin...

I have a recourse second with some real ball busters (BofA), so now the fun begins on negotiating with them on a settlement and trying to prevent a lawsuit and wage garnishment. Then comes dealing with taxes next year on the 'forgiven' debt. Although I should qualify for insolvency, I have not heard from one person who actually claimed insolvency, so I'm not getting a warm fuzzy about that either. I'll keep posting updates though, every little bit of information helps others.

Something that I would also like to remind people of is to make sure you are not baning with the same institution who holds your mortgage. I had my loan with TB&W and now it has been taken over by B of A. Now I need to find another bank. I'm thinking I'll go with a CU. I need to do something quick.

Ok update nothing yet still no NOD and last payment was made 7/2008. I have bank enough money to comfortably move and to deal with most other things by not paying mortgage and stayin gthe house for 14 months now at 2900 a month.

I am now hoping they will do this soon so i can move on but it has been nice getting my savings back

I initiated by downloading off of Chase the "official" HAMP program application and faxing in. A supervisor (who was part of in-house mod offer) got kind of snippy with me and said I didnt qualify and I argued I had read the guidelines and knew I did. The conversation didnt end well but low and behold A few weeks later, I was offered the HAMP program. I dont know for sure what pushed their button. I had several pressure points I put on at the time. 1. Had on-going OCC complaint (2) Had a lawyer send their lawyer a letter (3) Requested a mini-audit (QWR) of the account from the Trustee handling the sale.

It may depend on what state you are in but if you get served Notice of Sale, their is a clause that states you can question the amount they say is owed. Mine said I had 30 days to object to the amount. I objected and wanted a full accounting. This all happened within days of the trustee receiving the request.

The only thing that has any bearing on an interest-only loan is that HAMP does not allow for interest-only loan to be modified to interest-only again. It has to be converted to principal & interest loan. I wonder if the rep who gave you the wrong info had it mixed up how it applies?

Looks like we're in the same boat and heading towards the same direction. My situation: CA HomeAuctioned - Cont'd To Pay HELOC??

Will try to negotiate with BofA (b4 charged-off-how long after no payment??), but don't think they'll agree to one.... And if we were to file BK13, we might loose too much, but we might not have a choice.

So, looks like we'll be facing state tax on forgiven debt? And not, Federal since home was owner occupied. To my understanding the amount of forgiven debt is the amount will be taxed.

Thanks for sharing you story. Guess we'll muddled through this mess "together".

My hunch is they file a NOD much quicker on a house where there may be equity and move much slower on a homeowner who is severly upside down. Just an observation.

Anyone here from Washington State?? I got my NOD dated September 16th from IndyMac / now Onewest bank . Missed payment in August and September so yes got this when We were technically 46 days late.( WOW they must really want my house!) They want lots of $$$ by Oct 17th which we don't have so how much time do we have left before a sale date? We are most likely going to file chapter 13 in the next two weeks but are still wondering about this.

You should have a good year in your house is you go through forbearance and then loan mod programs...I called Chase for help in Nov 2008 (year ago) and I am just now going through loan mod process. I stopped paying my regular payments in January, started paying forbearance payments in April and just paid the 6th one on the first of the month. Now I am starting process for HAMP mod and doing 4 trial payments for that before it goes through. If you just don't pay anything at all I don't know how long it will take. My Aunt and Uncle filed bankruptsy and got to stay in their house almost a year doing that.

We are still trying for a loan mod program, been trying since March! Got denied once and now they are looking at our paperwork again. I did ask about other programs but the rep said we were not far enough behind for their other programs HA HA HA! Just wondering what will happen if I don't give them any $ this month??? I would totally pay them if they just would give me a better payment. That is why I was wondering how much time do I have to wait out for a mod approval or to file Bankruptcy. ( IndyMac / Onewest has never offered forbearance yet)

Wow! In reading all this I am shocked at how long some of you have been able to stay with out making any payments. My goal is to keep my house but I need a modification in order to do that and they have stalling since April. At this point I have just gone 60 days past due and am considering letting it go 90 or 120 to see if I can get them to move! Its almost like they keep stalling because I somehow manage to come up with the payment every month but it finally got to the point where I could no longer rob peter (the utilities!) to pay paul (the mortgage!)
I have been scared to play chicken with them. U.S. Bank tends to be rather tough to deal with... I may have no choice at this point.

Does anybody have any experience with the Mediatior process? In Ohio you have the right before auction to have a mediation to try to come to a modification.
