    Delinquent Condo Association Fees - Possible Settlement

    Anyone had any luck negotiating a settlement on Condo fees, PUD fees, &/or Sewer/Water fees?

    I successfully completed a Wells Fargo HAMP 1st mortgage loan modification approximately 1 year ago & and my CITI HELOC was extinguished approximately 6 months ago. I had a bankruptcy in 10' & I feel like I almost have all of my debt situations handled except that I am way behind on my Condo Association fees, Sewer/Water Utility company bill, & Planned Unit Development Fee.

    Sewer Fees

    I owe 2011 & 2012 actual dues of $700
    + almost $800 in attorney fees (for collection, I suppose)
    + ~ $200 in interest & late charges
    They attached a lien to my condo for most of the ~$1700 that they say I owe.

    Condo Fee
    I owe ~ $2400 Total
    I had thought I was only behind 1 or 2 payments but apparently they have been applying my payments to interest and attorney fees. Can they do that instead of applying the payments I make to dues first?

    PUD Fee
    I owe <$200 in actual assessments
    + Collection fees ~ $350 (says postage, copies, title & service costs, etc)
    + Attorney Fees ~ $500
    + late fees, interest ~ $50
    Grand Total ~ $1100

    These attorney fees seem exorbitant to me & attorney fees + collection fees seems excessive to me. On the PUD fee $900 in additional fees seems to be way too high on top of actual assessments of ~$200.

    Are these types of fees normal for delinquency turned over to an attorney? The additional fees are more than the original assessments. Anyone had luck settling for less than the full amount?

    Those fees are inline with charges that happen when the HOA and other assessments go to collections and attorneys, the HOA can also move to foreclose. I have not seen any members post that they have settled these types of accounts, I have only seen one member that was able to work out a payment plan for the HOA lien.
