    Quick Question RE: CC Debt, Bank garnishment, and Credit Unions

    Hi all,

    Can a Collection Agency garnish a credit union checking account? Wasn't sure if that works the same way as a bank? Credit unions seem to be "kinder" to their customers.

    Also, I have a tax lien that the IRS is not currently collecting on because of my financial situation. Will the creditors(or a judge, if it comes to that) see that lien and not bother to go to court? In other words would they know they would have to "get in line" and see it as a waste of time?

    Yikes, I think I am getting down to the wire as I am 6 months behind. Getting nervous!!

    No one can garnish without a judgment.

    Collection agencies often are less likely to file lawsuits than if retained by the original creditor after charge off. But CA's can also sue but easier to defend (they have to prove they own it by documentation the sale is a additional step vs proving the original debt).

    The IRS issue is probably not a major factor or they may not even check for it.

    If you lose the suit and the creditor gets a judgment it makes no difference if you have an account with a bank or credit union. Both have to hold funds when get a garnishment order from the Court.
