Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Filed chap 7 and mod ended I filed chapt 7 with a court date of 3/10/09 and my mod ended the last week in Feb. My negotiator indicated that they would reevaluate my financials, but since I filed, they will not talk with me without my attorneys consent. Is that normal? Additionally, i am not clear on what I should pay this month. Should I go back to my original payments or reapply for another mod to have them lower my interest rate..what to do? All feedback is appreciated. |

Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Re: Filed chap 7 and mod ended Generally when you file it prevents any creditor from collecting a debt, settling a debt, or modifying a debt. when you filed, your attorney should have asked you if you wanted to reaffirm that debt, which means you want to keep the house and loan and you sign a reaffirmation agreement. At that time your attorney can actually work with the lender to change the terms if the creditor is willing. Keep paying if you want to keep the property. Please Please consult your attorney to see what he/she can do for you. |

I did sign a reaffirm paper indicting that i want to keep the house. I contacted my attorney this evening because I have not been responsible for any payments for the last 3 months as that was part of my mod to defer my payments until march. Well now, I am trying to determine what I should be paying and can not get a definate answer. I lowered my insurance payments and my taxes changed. My mod docs did not indicate a an amount to pay after the mod finished because they wanted to review my financial situation. |

So it sounds like they gave you a 3 month forbearance until they work out an offer for a mod. So you might want to keep paying your original amount until you get it modified. The reaffirmation agreement should have contained payment and interest rate info. |
