Re: Failure is not an option for us....

And the fact is----BofA is under the gun to produce-----they are completely behind schedule. Perhaps this bodes well for everyone.

According to Sergio, my file is at 'the highest level' of management for mod consideration. Yes, it's the dreaded PNV test. I have renamed this the Probably Not Valid test, instead of Present Net Value. Perhaps they will notice the irony.

Two days ago, I also received a call from the Escalated Cases Unit of FreddieMac, and was advised by the nice man that my case had come to their attention and would be brought to resolution ASAP.

I hold out hope for us all----it would be nice to know that our home will not be sold three days after Christmas.

Re: Failure is not an option for us....

Hi Cassie
congrats! on your Mod. Is this finalized yet? Is your old loan a fix or Adjust? I like the way you play your games with the lender , I understand that your were current up until April and you pay 1/2 in June That is what I am thinking to do. I am current on my mortgage now but not for long. I put in mod. with WAMU?CHASE since July did not go nowhere, so I went to NACA event in LA convention submit application on 9/28 got denied twice from WAMU.1- None-owner occupied(They are lies We live here since 2005) Naca reply them back . 2- Denied hardship is not permanent nature. waitting for NACA to appeal. After reading your thread make me felt stronger to fight back with my bank, any suggestion what I should do next?
Thanks
Jill

Re: Failure is not an option for us....

Hi Everyone, I have been away for a bit..... a bit "LOST" I guess I could say....LOL.

Had a scare last night when advocacy left me a message to call back. But it was a false alarm. I have spent well over the last year working on the mod and finally got it. The first payment is due on Dec 1st. So I have been trying to relax for the last month or so and CHILL!!!! I actually started watching "Lost" the TV episodes (All 5 seasons!).... and litterally became LOST! It felt good to sit in front of the TV and litterally do nothing for weeks every evening....the house work showed, but oh well....it was caught up in one fell weekend swoop. Even cleaned out the garage! If something goes wrong after my first payment (crossing fingers and toes it won't!) I decided I am going to enjoy the holidays and not worry about it until January.

I am wishing the best for everyone still waiting.... Once you get your approval, do something for yourself, CHILL....It was long overdue for me but I feel much less stressed now.

I still come around and lurk....PDSFOLEY, I read that you got a mod! Yippee! I will have to find your thread later and do an official congrats! I have tried to stay away to de-stress myself (although I love this site!)

If I missed others....know I send a big congrats to you guys too....everyone hang in there!

Virtual Hugs!

~Cassie~

Re: Failure is not an option for us....

Cassie,

I was reading through your post and all I can say is WOW. I just found out today that BOA submitted a proposal to NACA for me. it is 2% fixed for the life of the loan. The Naca type. I started celebrating tonight thinking this is the end of the journey. But I guess it isn't at all. Looks like I still have a long way to go with getting the doc in the mail, sending it back to them and seeing the change on my online account. WOW. I have been doing this since July 2008 and I was denied several times. So I am gonna keep fighting until it actually happens.

Hi Cassie.......YES...sent papers back last Thur. 1st payment due Jan 1...I'm feeling sort of weird too (NOT UNgreatful) just sort of lost....wondering if its REALLY over or not....not sure how to explain it. I guess after spending 21 months on this fight was part of my daily life. I now have to figure out how NOT to think about it. Don't get me wrong...I'm THRILLED!!!!!!! I hope more people on here get success stories. I will have a new battle soon....working on the 2nd loan. but I'm gonna wait until after the new year to start on that. My best to you and everyone on here!!

Congrats PDSFOLEY!

The latest here is that the Breach of Contract (the modification contract) suit may get settled with a NEW modification contract. BofA and Litton attorneys are making the same comments about settling the case that way. I won't believe it until I see it now. And not until they offer me a contract WITH THEIR SIGNATURE.

BTW, I don't see their signature on the original note that was recorded. Does that mean that my loan is not a contract either, since THEY never signed the official copy (or any copy to my knowledge)?
