Re: Failure is not an option for us....

Hmmmm coincidence??????? I call BofA to verify if the HUD-1 has the title insurance needed. I get put on hold and then he comes back and says' yes. Print it off from the website and send it in with your docs. I go to Countrywide/BofA on-line and now I cannot access my on-line account!!! I was just on it 20 minutes ago!!! I should have printed off the Hud-1 then just in case! I almost wouldn't be surprised if they just blocked my account with the phone call! AARRGGHHH!!

Anyone else able to log on????

Re: Failure is not an option for us....

cassie,i dont think you have to update financials again because you are already approved. i also received my docs i signed and notorized them last week and my first payment is also dec1.i think you have to update finacials if you self employed at least that what it should say on the doc that they gave you. i was questionable at first but it is a offical loan modification agreement that we received so they have to keep there word on it. only question that im concerned about is if they are gonna send a statement or coupon for dec1 payment or do we just mail it by itself.congrats to you and your family.

A bit of a change though....

It says first pament is 12/01/2009 instead of 11/01/2009 that I was told verbally over the phone.

Also, since it is now Dec instead of Nov, the new monthly payment amount went from $2562.00 to $2581.51

But it is 2% for the remaining term!!! PITI!! WHOOO HOOOOO!

So I just received the docs last night and it says I have to have them mailed no later than 10/18/2009 <----- A Sunday!! So I will actually be mailing them tomorrow or by Thursday at the latest!!! Just have to include copies of the last months paystubs for hubby and me and get the docs notarized.

There was a cover letter on the front that noted there was upfront funds needed by certified check or money order. But when reviewing the docs, they applied the $1800.00 partial payment I made last June to the past due escrow and a charge for the BPO. So it ends up to be balance due $0.00.... Whew!

Good Luck everyone! I will keep you posted and let you know when the website gets updated with the new terms. this has been one heck of a ride!!

Hang on!!!

~Cassie~

That is great! I am new here and your story makes me hopeful! Can you tell me how long it took, what was the process and who David is (or his replacement?). I have heard i should contact Barbara at the OOP. Is this an in house mod or HAMP? Any other pointers?

There is a significantly-sized group of CW mod contract holders who WISH your statement was TRUE. The group of us are slowly making our way into courts across the country, presenting the contracts we were offered and complied with but were NEVER implemented by CW/BofA. CW/BofA reneged without notice or attempt to claim any defect in a timely manner.

You MUST verify that your loan payments show the mortgage balance DECREASING.

Also, get a copy of your modification contract that shows their signature, not just yours. That has been their claim to renege on the AG mods after taking MONTHS of the payments.

Sorry to tell you but you have to still watch out with these sneaky deceitful lenders.

Ok, mod papers are notarized... (hope the notary did it right!)

Now still waiting to log onto the CW/BofA site to get the copy of our Hud-1. If I had it now, I could already be at the FedEx office sending the papers back to them!

Well, that just figures doesn't it! They must have known you were trying to get that... "quick, Cassie needs this document, let's take the server down and mess with her just a little bit longer"! Maybe they are making some radical new change to help people...ha ha!

Now no need to go paranoid on us! I'm figuring people already think of my warnings in that light. Sad to say, the tactic of not signing the mod contract is spreading among the servicers and lenders per the Fransen & Molinaro firm.

Re: Failure is not an option for us....

I kinda remember that every month around this time the site would have ISSUES! I think it is the amount of people logging on to schedule their mortgage payments....

It is still unavailable. I was on it earlier and should have went with my initial gut instinct and printed the darn thing off. I have a copy of it at home. That just means I don't send the docs until tomorrow. I really wanted them to get out the door today though..... Show them I mean business!!

I am going at lunch with my hubby to get the docs notarized....

Can anyone tell me what the below means exactly???

This offer is contingent on the following:

* A lender's title insurance policy or endorsement, which insures the Modified Mortgage as a valid lien in accordance with our requirements. If you have any other encumbrances on the property, then you may be required to obtain agreements by which other secured creditor's subordinate their interest to the Modified Mortgage.

Is this something they already have? It is listed under "What You Should Do". It also requests updated financials..(no brainer).

It also says....

This offer is contingent upon BAC Home Loans Servicing, LP receiving relief from the Automatic Stay for any bankruptcy in which the property referred to in the Loan Modification Agreement is included at the time of the Modification.

But we aren't in a BK or planning to BK.... what does that mean??? Incase there is a BK pending??

Any data would be appreciated!!

~Cassie~
Hey Cassie
Congrats!
Do not worry about those two paragraphs. I called David L about them and if you are not in BK don't worry. The other paragraph about the title policy, David's comment was to ignore it and he wished they would stop putting that in as it just confuses people!

FYI When I made my first new payment is I think when the website updated. Possible some when I sent the docs back. Also, you can make your first and second payments on the phone with advocacy because you will not have coupons. I now receive coupons with corrected statements and all. Yahoo!

Re: Failure is not an option for us....

Sorry Cassie, I had to step out for a few. I got it off the Countrywide website after I logged in on the front page. Still couldn't access my loan info on the Countrywide sight, haven't tried the BOA site yet.

so-cal-gal,hows your case with your attorney involving your AG mod problem?
i swear if they do the same to me there gonna have a hell of a mess to fix in this place.
Two things here:
1) Cassie, regarding the payment: If you make a payment on December 1, that pays the interest that accrued for the month of November. So technically, when your payment coupon or the document says your first payment is due on December 1 but there is language that the new contract period starts in November, the statements are both correct. November is NOT added to the principal balance.

2) My case: Suit filed. Judge looked a bit shocked. Of course, most people ARE when they hear this tale. It is almost like the situation has the other type of 'tail' involved, like the devil himself.

They did not implement the mod but transferred some PARTIAL interest in the note. With the RESPA request for them to honor the contract since a transfer is not to affect the mortgage instrument, how would they even claim the investor did not know of the agreement that exists to modify that mortgage, since one of the investors, the one who was also the servicer, STILL is an investor? And there is serious doubt that they can claim the new SERVICER did not know either.

Re: Failure is not an option for us....

I got home last night and received a good laugh from BofA....

So I got my mod docs for the 2% for the life of the loan PITI with first new payment starting Dec 1st, 2009 in the amount of $2581.00.... We received the docs Monday and I sent them FedEx yesterday back to BofA. (24 hour turn around)

Then I get home and have another FedEx from BofA. It is an offer for the HAMP mod with trial payments of $1871.00.... it is almost as is they are thinking the person is gonna sit on the mod offer a couple of days, so let's send her a teaser and see if she bites! Of course the HAMP is not anywhere near as good as the 2% for life so I am gonna ignore it of course. But...I am now part of their statistic and report card.... I am now being counted as a Trial Mod Offer to Obama when they never seriously offered it and I was already in another approved mod!

What a joke!!! Seems like another way to not really help people but show the government..."Look!, see how many people we tried to help that didn't take the help!" Pathetic!!!

Good Luck everyone!
