The count of cases I know of that are preparing or filing suits is at least 12-14. These are all specifically 'CW AG Mod' cases, regardless of the state where the case is located. The principle stinking strategy of never signing the modification contract is now spreading to a number of other lenders. The strategy of not signing the modification contract AND transfer of the note during the time frame when the modification contract is SUPPOSEDLY being implemented in the underlying note ALSO is spreading to a number of other lenders. |

He was very pleasant but rushed. Not quite the same as talking to David, but I don't think anyone could out do him! Anyway, he saw that the acceptance from NACA had not been noted and he would escalate the proposal and have the docs sent out. (I have heard that before-more than once!) He said I should receive them in 5-7 business days. He said the first payment is still set up to be Nov 1st..... Just proves that the Negotiator was not truthful when she said she was sending the docs out and going into the NACA database to confirm the response almost 2 weeks ago... I hope I get them soon. 5-7 business days will be between 15th-19th. Then we have to review, call NACA with any questions, get notarized and send back to BofA. THEN.... Make sure BofA acknowledges receipt of docs and gets them processed and their system updated to reflect the correct payments on our account. Funny, I was never a patient person...and I have been quite impatient throughout this roller coaster ride...but I am finding the little things don't bug me as much as they used to, and......... I am growing patient... Cassie |

But it says if I don't get docs by 12/08/2009 and my first payment is 11/01/2009. I am still gonna call in the first payment regardless! (Crossing Fingers and Toes!!)

Wanted to know who has had any experience with Bank United in Florida? The FDIC took them over and I had to complain to FDIC to get a response about what happened to my loan modification but the bank made sure they continued with the foreclosure process. |

A bit of a change though.... It says first pament is 12/01/2009 instead of 11/01/2009 that I was told verbally over the phone. Also, since it is now Dec instead of Nov, the new monthly payment amount went from $2562.00 to $2581.51 But it is 2% for the remaining term!!! PITI!! WHOOO HOOOOO! So I just received the docs last night and it says I have to have them mailed no later than 10/18/2009 <----- A Sunday!! There was a cover letter on the front that noted there was upfront funds needed by certified check or money order. But when reviewing the docs, they applied the $1800.00 partial payment I made last June to the past due escrow and a charge for the BPO. So it ends up to be balance due $0.00.... Whew! Good Luck everyone! I will keep you posted and let you know when the website gets updated with the new terms. this has been one heck of a ride!! Hang on!!! ~Cassie~ |

I can't say anyone is as good as David and he was not as friendly (or maybe I should says as personable) as David, but he told me exactly what was going on with my mod and said the paperwork would be sent, AND IT WAS!!! I am going at lunch with my hubby to get the docs notarized.... Can anyone tell me what the below means exactly??? This offer is contingent on the following: * A lender's title insurance policy or endorsement, which insures the Modified Mortgage as a valid lien in accordance with our requirements. If you have any other encumbrances on the property, then you may be required to obtain agreements by which other secured creditor's subordinate their interest to the Modified Mortgage. Is this something they already have? It is listed under "What You Should Do". It also requests updated financials..(no brainer). It also says.... This offer is contingent upon BAC Home Loans Servicing, LP receiving relief from the Automatic Stay for any bankruptcy in which the property referred to in the Loan Modification Agreement is included at the time of the Modification. But we aren't in a BK or planning to BK.... what does that mean??? Incase there is a BK pending?? Any data would be appreciated!! ~Cassie~ |
