| Countrywide Rips off Elderly Glad to read your blog. My father applied for a loan modification on My father submitted a request for a loan modification via phone on the afternoon of After the death of my mother we found that she had refinanced the loan on their home. They have lived in since the 1960’s. She refinanced with Countrywide Loans over the phone in February of 2006. She was 80 years old at the time and not in the best of health. If any of the family had seen this loan we would have put a stop to it. But she kept it from us because she knew she had made a big mistake and carried this burden with her to her grave. In reviewing the loan papers the family was appalled at the conditions of the loan. First of all her intention was to apply for a reverse mortgage. Countrywide said they didn’t qualify. They ended up giving them a Non Conf Arm Libor 7/1 with an interest rate of 6.3. Payments are $2077.07 interest only. This is more than 50% of their income. The $2501.55 P&I option is completely out of the question based on income. As I understand legitimate loans have a 28% ratio to income. Who ever approved this loan did not even bother to take down the income information, or did they take into consideration my parents were on a fixed income. Where did they think the money is going to come from once the payments jump to $2938.51? Countrywide Home Loans had the house appraised at $642,000 by an appraiser from your approved list (Landsafe). In going back over 10 years their home has never been worth more than $580,000. In fact, when this loan was originated by Countrywide, in February 2006 the value of the home was approximately $540.000 NOT $642.00. Due to the drop in real estate prices its value is now at approximately $408.00 with prices expected to drop 21% in the next year. There is a prepayment penalty which even if my father (who has great credit) wanted to refinance, it would cost him even more to pay off this loan. He has paid over $70,000 in interest plus close to $10,000 in closing costs, not a cent coming off of the principle. My Father is 86 years old a retired veteran of WW11. He has lived his life with up most decorum and has never even received a parking ticket. He has worked all his life to have a decent retirement. At this point in his life I feel he should be able to live out his life (which his family has a history of longevity) without having to deal with the “disgusting” conditions of this loan. I am asking on behalf of my father that this loan be modified; it is causing him extreme hardship both emotional and financial. I think that in reviewing the loan you will find that it was not above board and given to them by an unethical loan person who decided an elderly couple would be a good target to make a great commission. | Re: Countrywide Rips off Elderly Readyforbattle, Glad you found the forum and posted. I am sorry your father is going through this, and he's lucky to have you help him out. I'm sure there are alot of elderly folks who got ripped, and are now getting ripped again by the "loan mod scams and vultures" Sending the hardship letter is a good first step to getting the process started...be prepared to send alot of other paperwork when things crank up. The letter sounds good, I would send it certified mail so you have receipt of them getting it. Hang in there and good luck! | Re: Countrywide Rips off Elderly Thanks for the advice. I faxed it to the office of the President with no response. I will send it again certified.....and contact NACA. Yes, he has been getting a lot of solicitations. At first they look like they are from Countrywide but on closer inspection you can see they were obtained from public records.......in little tiny print at the bottom of the letter. |

| Re: Countrywide Rips off Elderly Thank you so much for the support.....I have been watching this blog for awhile. I feel for all that are stuggling. The one good thing is that the American people are really pulling together and are showing that we are fed up with the greed, in all areas. I have been thinking of posting this situation everywhere I can. The Local media is a great idea. The blatancy of this loan infuriates me. Since we found the loan papers after my mother passed on I've often wondered if the stress of this added to her passing. She would be fine in the hospital...when she came she would get sick all over again and back to the hospital. This went on for over a year. Your doing great work here!!! |

| Re: Countrywide Rips off Elderly My dad's loan was sold to the Bank of NY....Countrywide told me they weren't doing anything with these loans. My father is not late on his mortgage (this is the only home he has and no other mortgages) and he has perfect credit. This is such a mess. We have contacted a bankruptcy atty and it looks like he is going through with the bankruptcy to survive at this time. I hate to see him have to do it at this point in his life.....Will this hurt modification efforts we are trying for? I was told that he could buy a new home two years after bankruptcy does this apply to modification also? |

| Re: Countrywide Rips off Elderly Thanks, I went to their website and will be contacting them. I also talked to my father's atty today...he wants to hold off filing bankruptcy at the moment. He said he wants to hear Obama's talk next Wed, to see what is going to be going on with the bankruptcy judges including modifications. |

| Re: Countrywide Rips off Elderly I have sent out letters to everyone I can think of regarding my fathers situation. My councilmans office sent me back a note stating that he too thought this was elder abuse and referred me to the local DA who handles elder abuse. Within four hours of sending my email ...late at night I got a response from the DA stating that he understood my outrage, although he couldn't promise anything he was going to talk to the DA in the Real Estate Fraud Dept and go from there. So my advise....is send send send to anyone you can think of especially if you feel your loan was fraudulent. Countrywide should not be allowed to get away with the harm they have done! |

| Has anyone checked their prepayment penalty? On top of all the other problems with my fathers home loan. I found a prepayment penalty: If within the first SIXTY months after the execution of this Note, I make prepayment(s) in full by way of refinance, or the total of which exceeds 20% of the original Principal amount of this Note, I agree to pay a Prepayment Penalty in an amount equal to the payment of 6 months advance 12 month period immediately preceding the date of the prepayment exceeds 20% of the original Principal amount of this Note. Interest will be calculated using the rate in effect at the time of prepayment. Does anyone know if five years legal in California? Is this usual? Thanks for any input |
