| Do NOT give up people! I know it is hard, and stressful. I have been lurking here and gaining awesome information. I have also put it to good use. Per NACA's advice I have emailed and faxed everyones phone numbers that I can get my hands on, from Obama to Senators, to Freddie Mac, to the Attorney General in my state, and even the Govenor. I am finally getting someone to sit up and take notice and offer timely help. Never give up! |

| Re: Do NOT give up people! I wanted to add that NACA is only as strong as us who are willing to support and back them. If we are not willing to contact people (namely Senators) and barrage them with requests for help they might not realize how much the people in their district want them to support this legislation. Also making your investor more aware of the games Countrywide is playing helps put pressure on Countrywide! |

| Re: Do NOT give up people! Thanks so much for those links!!! I have just spent the last hour emailing any and everyone in maryland, and even the Obama office. I will send one once a week and hope we will be heard, or at least untill someone contacts me and tells me to stop LOL |

| Re: Do NOT give up people! Thank to you so much for the links. I have already emailed my congresswoman but have gotten no response. Can anybody give a "laymen's explanation" of a Notice of Intent to Accelerate? I recieved one by certified mail when I reach 60 days past due. CW has told me that I don't qualify for modification. No explanation. I'm hoping Wednesday will bring good news. I just discovered this web site today and am comforted to know that there are so many others in my situation. Hopefully, united, we can affect change!! |

| Re: Do NOT give up people! Carol: You must look to your state's law to determine whether the lender acceleration clause is effective. Here in California for example it is not. That is because the State has limited a lender's ability to accelerate the note in this fashion, instead providing a time period up to 5 business days before the date of the foreclosure sale where a borrower can cure the default by bringing the loan current by paying all delinquent payments, taxes, and foreclosure costs. | For what it is worth... Just wanted to add this tidbit for what it is worth... I started to become alarmed that my modification had not been updated on the online information at CW's site. (However maybe I am just panicking but it has only been 2 weeks since I mailed it.) So I took the modification to a lawyer to ask if the offer was legally enforceable and he told me, what *** has pretty much said about that is why CW does not sign it before they mail it to you etc. So I called CW and demanded they send me the confirmation and update the site and customer service said I should not expect any information for at least 30 days. Of course I did not accept that and called the office of the president who told me that no one actually signs that document and that they do not mail you a signed copy of it afterward. I do not know if that is true or not but if it is true that would seem to mean a lot about their intent and whether it is enforceable or not. Seems like standard procedure to me. I have not spoken with the attorney yet about what I found out. Does anyone else know if they actually do sign it and mail you a copy? |

I will have to do some research about CW from others that have received mods.................but I do know, from personal experience, that Chase does sign and notorize their modification documents where indicated on the signature page of the modification and they do send you back the signed copies...........within 30-45 days of the account updating.

We received our loan modification on Feb. 9 sent it back on Feb. 12, we finally saw some changes to our account on Feb. 24 but there were still fee's that still need to be updated by the time it was fully updated and we no longer received that message online stating our account need special attention was on March 6. It does take time because it goes through different stages of updating. This is our second modification withing 4 months and so long as you notarized it correctly and returned it before the due date then you should be ok. We never received a signature from cw on our modification we just have our copy. Check the transaction history that's where we first saw the changes. |
