Help getting the run around with countrywide

Where do I begin?

I had fallen behind on my mortgage due to a lack of work availability. I called my lender September 25, 2008 and asked what we could do. I was told they had plenty of programs for loan modifications. I gave the representative Fred all of my information and was told that within 7-10 business days I would have the package to sign and send back to Countrywide. While awaiting my package I received certified and regular mail that my home was to be sold at Auction November 4th. I of course called Countrywide asking who was the law firm Adorno & Yoss and why were they speaking of selling my home at auction if I had provided them with all the documentation tax returns, bank statements pay stubs etc. was told by Tia on October 13th that my documents were received and approved they were just a bit back logged with printing the documents not to worry my home would not be sold to continue to call 877-643-2788 and get a status on my package from the Heart/Hope team. I called 10/15 spoke to Nichole, 10/16 spoke to Tiana and was told they had no information they had to await a download from Countrywide to create my package and they had not received it. I continued to call countrywide and the Heart/Hope team daily no one could provide any information as to when my package was coming. I sent Countrywide $4,000 attempting to bring my arrears closer to current, the funds were returned because they were not certified funds. I continued to call to no avail. I asked for a statement of the total amount owed, was told they could not provide that information over the phone, they could request it and mail it to me. I had to continue to call to have that information provided. The letter indicated I owed almost $10,000 to Countrywide for past payments, but owed Adorno & Yoss over $10,000 in legal fees. I thought that was an inflated amount to owe a law firm. I called countrywide and stated I have given you $4,000 of the 10,000 I owe you I can get you another $4,000 to bring my balance to $2,000 owed. I was told that I could call the law firm and see if they’d be willing to negotiate their fee.

I was annoyed and stressed I found information regarding a company to help stop foreclosure called a company that was listed with the Better business bureau. I spoke to a gentleman named who agreed that I was receiving the run around from Countrywide who stated he was sure his company could help me. He asked me to print out his online form that would grant him permission to speak with countrywide on my behalf. His loan mitigation department would call countrywide to see if I was eligible for a loan modification and get back to me. The next day I received a call from Jay stating he had great news I was eligible for a loan modification. I found that very funny because I had already allegedly been approved for a loan modification with countrywide. I began to get suspicious when he then told me that he needed me to fill out an application and send him $2300 via money gram. He allegedly had my package all put together with my hardship letter etc. and was supposed to email it to me, but I never got it. I called him and asked where the package was he said he was unable to provide me with the package until he received the $2300 his mitigation department could not begin the modification without the completed application and the modification package could not be sent to me. I refused to send the money to him. I asked why would a homeowner blindly give him $2300 one month’s mortgage payment without even seeing what was in his modification package. He agreed and sent me a packet of nothing, a hardship letter that was readily available on the Internet and a bunch of documents that would allow his company to basically make any all decisions for me. I did not respond, he became enraged and continued to harass me and send me nasty emails, which I have saved and will attach to this letter.

I immediately contacted countrywide who indicated they did not have a relationship with the company and that no one from there had called on my behalf to do anything. I faxed countrywide a letter removing the companies rights to ask any questions or act on my behalf, that was 10/20. I continued to speak to varying representatives regarding the sale date of my home and assured that my home would not be sold at the auction November 4th. I spoke with Leslie in the foreclosure department on October 28th she was very helpful, she pushed back my foreclosure date. She saw the amount I was behind and said that I could send countrywide $6,000 certified funds. Leslie stated she would resubmit my forms for the modification, they had been having computer problems and maybe my forms were just stuck. I asked if I could send $5,000 certified and send the additional $1,000 when I received the package? Leslie agreed that the total of $6,000 had to be received. I sent a certified check to Countrywide for $5,000 on the 29th. November 4th came and passed my home was not sold at the auction. My loan was back in active status I felt relieved, I was told by Leslie 7-10 business days and my package would be there. I let the 10 days pass and called countrywide and was told that they received my $5,000, but they could not accept it because my home was in foreclosure and that Leslie had misspoken. I have to wait for a package before I could send in certified funds, oh and by the way my home was scheduled to be sold at auction again January 6th. To date I have received no package from countrywide they have the certified funds sitting in an account but have not credited my account for the funds and continue to show that my loan is 6 months behind on my credit report. I have over $250,000 of equity in my home, purchased for $470,000 June of 2007 with $250,000 down. They are attempting to sell my 7-bedroom home on seven acres for $230,000. I am still waiting on my package from countrywide and I continue to call daily. Countrywide’s conduct is despicable and a violation of your parent company Bank of America’s code of Ethics of “doing the right thing.”

To ask a homeowner already in distress to pay absorbent fees to a corrupt law firm to save your home is immoral and Adorno & Yoss and Countrywide should be ashamed.

I am still seeking help in saving my home; any assistance would be greatly appreciated. I have provided documentation showing my salary & have moved my parents in with me to provide an additional 2400 a month of income. I am having a difficult time figuring what takes from September to December to review. I have received no documentation from countrywide indicating my loan is under review or anything. Every customer service representative provides differing information but I’m told to be patient a package will be sent shortly & not to make any payments because my home is in foreclosure. I have been seeking assistance since September to no avail.

Welcome to the forum. Many of us here have experienced similar circumstances. We can empathise with your frustration. Especially when you hire someone to help and they turn out to be just another scam.

Thanks Dan! Don't know if this is good news or not but I have sent letters of complaint to all of my state senators, congressman & every oversight comitee I can think of, when I called the 800-669-6650. I was directed to the office of the president, which is currently closed.

My negotiator Coleman is too busy, he indicated to me that he has not even looked at my information since our conversation December 2nd. He could not even provide me with a date that he'd have time to look at my file. Is there a way to request another negotiator. Any advice is greatly appreciated

call the main number and speak to whomever answers the phone and ask for an update.............if they try to put you back to Coleman.........tell them you want to speak to a supervisor and explain what has been happening.

I spoke with with the supervisor and the new scheme is that since the second sale date on my home is not until February they have plenty of time. It seems to me that they are waiting until the last minute to modify to create more fees. If my file has been complete and in countrywide's hand since October it is adventageous for them to continue to delay until my sale date because I will have no option but to sign the modification no matter what. My file has been referred, referred, referred and referred again. They have the audacity to tell me that they have people who've been waiting for 9 months who they havent completed the modification process as if that makes me feel better. It makes them look horrible. What happens if they deny my request for a modification? Are there any other alternatives? Dont feel comfortable waiting for them to wait until february tell me I dont qualify and now have to move my family with no option. I understand y people walk away from there home

My negotiator is now talking about a broker coming past the home to determine the value. Is this normal for a modification or are they trying to refinance my home?

I had Litton and yes they did come buy and in my case they actually came in, it was all good and they were very professional. I was very skeptical as well. I am sure it will be fine.
