Hi everyone! Here is my story and I am hoping someone can help. I call Countrywide everyday and I always talk to someone different and I am telling you all the left hand doesn't know what the right one is doing. Here are some of the problems I have been facing with the loan modification program. In my excitement I mailed back the last 2 pages but not the cover page of my loan mod agreement. Within that week I received a call from them telling me what I had done. In the course of the ensuing conversation it was determined and agreed upon that I send the missing page..no problem. Well, I did but to the wrong address. My girlfriend went online and got a bunch of CW contact info and I started making calls. I eventually talked to Elizabeth Lopez a customer care specialist. After explaining what happened she took my number and said she'd call me back ASAP. Within half an hour she did and she told me she went to the other CW bldg next door, found the cover page and it had been mailed off to the correct address. A week or two later I was told I was approved and to start sending my payments. As i said before I call everyday...well...during one of these calls I was told they were going to have to reorder the documents and then I would have to notarize, sign and send back just as before and to make sure I send them all together and to the right address in order for them to have the proper paperwork and not to worry I was in the program and to send the payments. Starting in September I began mailing the agreed upon payment amount and currently I have sent two of these payment(mailed Sept.23 and Oct.23) only to find out on 11-10-08 that the second one was being returned to me and no one seems to know why. I then requested to have my loan negotiator call me but they said they do not know who it is or that they couldn't give me a name. I was also told for the fourth time they were going to send me another set of loan documents to resend. I was told the first guy back in September never ordered them at all and I have been told another two times that they would be reordered on October 17 and October 30 and I should receive them within 10 days to no avail. At the outset I was assured that the foreclosure process and any penalties would be stopped as I had been approved for a modification, however, I also found that to be untrue on 11-10-08. Yesterday, 11-15-08, the second payment arrived back to me in my mailbox. The reason they stated was that it did not reflect the full amount due yet it states nowhere on this paper what this amount is. It seems as if they are trying to make it sound like I am just not paying my mortgage, almost, as if they're trying to make like the payment had nothing to do with a loan modification agreement. They seem to also be trying when I call to push me to the December 1st program instead. I am now wondering where the first payment was applied since they are not accepting the second payment, should I still send the 3rd payment and am I really in foreclosure now. This is killing me as I have a 3 year old daughter who grew up in this house and tells everyone about HER house all the time and also an 8 and a half month old daughter and with winter approaching would really like to keep them from ending up ********. Again any help would be great. Thanx.

Hello Shane and welcome to Loan Safe!

Lets see what we can do to guide you in the right direction and give you some hope here. I know its very tough when dealing with Countrywide and their negligence in many situations. This almost certainly is the result of ALL their emloyees being over loaded and inundated with struggling borrowers.

You are caught in the bottle neck and it just takes a lot, I mean A LOT of work to get through that bottle neck and when I say work, it means calls, emails, faxes, letters etc until you get the help you need and deserve.

What I suggest is you consider writing a Qualified Written Request (QWR) and send it either certified mail or Fed ex and also email it and fax it to CW. A QWR's purpose is for mortgage servicing issues and complaints.

I would highly sugest you read the Countrwyide Attorney General Settlemnet here if you fall in one of the 11 states that were covered.

The news just gets worse...found out at work last night that anytime from now to a year from now the plant will be shutting down. QWR is written. I'll keep you posted.

Shane, at least they gave you a warning. Make sure you research other areas you may want to move to and work in as a back up plan. Back up plans give you hope in your mind because they provide you with an understanding that no matter what happens, you will make it.

Thanx for the words of encouragement. It's nice to know there's still people out there who care about other people, who want to help and are trying to make a difference. An In-N-Out burger would really lift my spirits right about now. I might just relocate back to SoCal. Got a lot of family out there...and friends. So anyhow...I called the HEART team today and asked about my mod papers again and they said I would have to contact the Workout Dept at CW. So I did...and...they said the original papers are expired so there would be no point in sending them out again. So my question is...Why promise to send them on 5 different occasions if it wouldn't have mattered anyway? Then, Johnny started asking me all the same questions as before to start the loan mod process all over again. He said he'll call me back tomorrow to go over my numbers again. So now I wonder where did the 1st check from the original mod go...my bank shows it was cashed. What was it used for or applied to? I have asked and no one has an answer. Do I send the third payment in from the "alleged" 1st mod? Or try the whole thing over again like Johnny said? I almost think they are trying to push me off to the Dec.1 program.

By 2pm today I got tired of waiting for Johnny to call me back so I called CW myself. I talked to Elaina and she said I have to start the process all over again from scratch and that I also no longer qualify/it's no longer available to me to have the 10yr. extension on my 30yr loan making it a 40yr loan. How can I be sure it will workout the second time around when it blew up in my face this first time? So here I am with the penalties and fees still accumulating daily and now wondering...Should I just file bankruptcy??? Yesterday I had a man come by to see if I still lived here for the 3rd time. At this point I'm afraid that if I don't file bankruptcy I will lose my house...a sale date will be set...foreclosure will be imminent...What should I do now? Any advice would be appreciated...Thanx!!!

You had been thinking that they might be waiting for the Dec. 1st program............were you able to call that number and ask if you do qualify for it?

Today I called about starting the loan mod process over again. I gave the guy my numbers and first he said I was over, then he said I was under and finally the guy eventually said you've already talked to 2 other people and I need to just stop trying for a mod and then he eventually hung up on me. I called back and Roxanne(who was very nice) said I didn't qualify for any of their programs...NOW WHAT??? I have less income now than I did when I tried the first time...so how did I qualify before but not now??? I called my bankruptcy attorney and am waiting for a call back to see what he thinks. What do I do??? I almost feel like they were leading me on for the last 3 months!!! HELP!!!

Can i have my fiancee call on my behalf or do I have to do it? I think it would be better at this point if I let her handle it. I was on the brink of snapping on the phone earlier today and she is much less tempermental and more levelheaded than I am at this point.

If she is on the loan, she can speak on your behalf. But if not, you can give permission in writing or verbally on the phone to them. Like I mentioned last week, I feel a QWR is in order and you should send it via fed ex to the office of the president.

I did not realize it was what it was until today...but I know now...CW did file an action to foreclose against me...on August 20th...as I was starting the first attempt at the loan mod process with them!!! However based on what I read today on the above mentioned website(see below)...I think CW is in for it because they did neither!!!

13. Failure to comply with FHA pre-foreclosure requirements.

FHA requires every lender to mail a booklet called “How to Avoid Foreclosure” and set up a face-to-face meeting with the borrower before foreclosing (in most cases). If the lender does not take these steps, then it cannot foreclose.

Still doing the QWR and requesting all paperwork that has my signature, all mortgage paperwork and etc.

So sorry you're going through this. I think it really is a matter of luck and getting the right counselor to help you. Like Moe said, they are so overwhelmed nobody know what the heck is going on. After reading your last post, if I were you I'd hire a real estate attorney to find out what you should do next. Maybe bankruptcy, maybe you can fight CW back since they screwed up so many times. I think without a lawyer it will be hard to straighten things out in time. Best of luck to you, I know how frustrating it is.

Make sure you clearly state a time line of events with your QWR and any supporting records on the FHA violations. That may help you somewhat
