The latter is the sensible option. Reading the article on the New Hamphsire couple I saw the B of A Countrywide advert for helping homeowners and wondered why they can't do what they say. Quote:

| Re: Countrywide modification papers signed but now I have terrible credit score, and unemployed Update: My primary residence mortgage and HOA just raised to 230.00 to cover projected escrow and county taxes.. now my primary that is now a rental at 1350.00 the mortgage costs 2406.85 and the HOA is 124.80 almost 2600 dollars andthe house is a hundred thousand underwater and the lots are full of tumble weeds.. Still unemployed until I receive my surgery sometime this week or next. I know that if I let my primary go I will never own another home. I can't even find work that will pay the wages I received in California in Arizona. Should move all this to the foreclosure and bankruptcy thread because I can't continue with this anymore. I needed the help before my surgery. I need the law to look into the realtor that conned me to buy these homes with her lender instead what I wanted with the incentive from the builder. PooF!! everything gone at 48. |

The VA hospital called and I am scheduled for surgery for the 27th. Next Tuesday at five thirty am. Or should I say 05:30 ? Unemployment agreed with my appeal that I had a valid reason for quitting my job and they have given me my unemployment benefits. I guess I have tens days until they send me a check for the last four months. I have been given a realtor through the attorney that is advertised here and they will do a short sale but I can still careless and from what I have been reading should just not even bother since I will have to file BK anyway. Onward and forward into the great landscape that is American Hypocracy. How about that John Thain and his toilet with legs? and the billion dollar bonus to his cronies after receiving our cash to buy out a bankrupt merril lynch? Anybody remember jimmy durante? Put that phrase he used to say in yur heads... ah cha cha cha? |

I can not believe that because I tried to save both homes from going into foreclosure that I am going to walk away from mine. |

I called today to get help on my primary and they say they are not giving mods that lower the interest rates. I told them you did give me one and that dissappeared in December on the second home and what happened to it? No answer. I told them they can have my primary also. I will not pretend any longer and will collect the rent for as long as I can. I just hope the BK law changes to let the judge re-evaluate the mortgage. |

They reduced my rate to 4.75 and extended the loan to a forty year instead of thirty.My new maturity date will be oct. 2048. Start first payment Oct. 1, 08 received foreclosure notice on 12/23/08 and noticed loan was no longer on the countrywide website. I was in contact with cw and no one knew anything and they just told me to pay starting oct. They were not sure what amount because it states in the paperwork that my payment could be 2414.65 a month but not sure. So I paid 2400 even for two months until receiving the foreclosure notice and that ended me ever sending any more money to them for this property. Good news is I'm starting to get work again. ![]() |

I have not paid for January and I had asked for a modification since the other house is in foreclosure. My renter stopped paying rent after they served the notice of foreclosure. They wanted to stay there for five years. Luckily the lease is up in April at the time of the auction. I drove out there to talk with them and explained the situation. I havebeen upfront since this whole mess started last July. I am trying, but it seems that CW doesn't know what it's doing. Anyway, for my primary they said they will look into a forebearence and I told themI don't want a forebearence. So as from my other updates the loan for the home in foreclosure was modified at 4.75% for 40 years and the first payments started Oct. 1,2008 an the home when into foreclosure Dec. 23, 2008 and the account dissappeared from my account page. Today, it's there showing the november payment and a deference of payment till May and the original loan amount ( not the modified with late added at the end) Click on the account link and it goes to my primary. So now my primary and my "investment" property are both on my account page but only detail information on my primary. I am done calling or taking calls from countrywide. All communication is through the mail. When i receive default notice on my primary I will respond with my written wish list. At this point I am just banking the rents. |

My BK attorney told me the only hope in saving my home in a BK is to break the lease and move back in before I file. I told the family today that they can live there for four months rent free to save enough to move by the end of July. They wanted a two year lease because this will be the third time they have had to move in less then five months because of the foreclosure situation in Arizona. The home before mine they lived in it only four months before they had to move. I feel bad but I want my home and I want it at today's value or I will live in it until they kick me out. The other renter stopped paying when the foreclosure notice went on the door. I gave her two months free till April when they have the auction. So the plan now is I am two months behind on my primary and will be six months behind when the family moves out and then a month or maybe wait until the auction date and file for BK and drag countrywide through the process. I don't get calls and I don't write. It also still shows that the other home was modified. |

This month I am three months behind on my primary which I should be moving back into in July. I will pay this month, and then skip two months. Haven't heard a word from anybody. |

Just received in the mail that if I had an agreement signed for modification to continue with said agreement. But the last time I called CW said it was going up for sale at auction on April 6th. That's the investment property. The renter stopped paying the rent on. I called CW since my accounts page is current and updated to show both properties and that I am in arrears and to call this number. I called the number and got a recording stating that they are going over their customers files to see who qualifies for the March 4th new round of prolonged help. Recording says they will mail to those that are qualified. Again, my only option is to file BK because of the length of time involved trying to solve a very simple problem in my case. forebearance for three to 6 months, a rate reduction, and prolonged mortgage years to 40 so that the rents would have covered the mortgage until I recovered from my surgeries. Then go into a fixed rate for the rest of the loan. It's been a year now. I have minimal work starting again. The UI benefits have finally been cleared up and I will receive 6 months back pay for disability and unemployment hopefully in ten days. Is anyone talking to people or are you getting recordings also? |

I am so glad that I have finally been able to clear up the medical situation and can now focus on work and figuring out how CW will rectify this situation. The renter wants to stay in the investment property but it's over two hundred thousand under water. There is no way I want it. My home I can live with. It's one hundred thousand under water but I plan on living there for ten years and there is alot of development planned as soon as the economy straightens out after a few years. Still I believe that I should have been told that TREND HOMES was filing for BK when I was looking at the place. I'll keep everyone updated. As soon as I get my benefit money I will go back to Arizona. I was thinking about joining the union with the money I receive but it maybe better to just hold onto it. The local 600 (IATSE camera union) might get me more work. have to talk to them to see what they can do for me in Arizona. If not it's three jobs. 1- whatever day job I can find which is most likely 10 to 13 an hour. 2- a part time night job deliverying pizza. 3- my freelance camera and handyman gigs.. nice!! I'll be close to my daughters but will only get to kiss them for a minute and wave good bye..as a shuffle tirely to my jobs. Always have a plan. |
