I am new to loan safe forums and wanted to post my story.
My first is with Countrywide and my 2nd is with GMAC.
I had both my loans go thru a forensic loan audit with loan safe solutions and it came back with a bunch of violations. I am hoping that it will help me to have favorable results with them trying to modify my loan to a more affordable payment at least.
I had tried doing the modification on my own with no success. We are in forclosue and want to stay in our home.
I am wondering how many are trying the same process I am, hiring loan safe solutions to do a modification for them by using the violations found in the loan? Does it really help?
They have completed my file and I am awaiting to hear from them.
Also, once they find violations, does it help just for a modification, loan balance decrease, money back?
If the violations are severe enough, do they suggest a lawsuit? Do you have to pay up front?

Welcome to the forum and thank you for joining. Loansafe has many sucess stories, both posted here, and those that never post here.
Before and After posting here I got immediate help..in the form of suggestions, advice, knowledge etc...
Loansafe is also working on my case at this time. It is a long process but well worth it.
I am sure you will hear from others on this subject.

When youj say it is a long process, does that mean to do the loan modification
or if you file a lawsuit?

I currently am in the loan auditing process and am awaiting the final options I have. They have found violations and I am wondering how the violations will help me.
I am in forclosure and had already submitted my hardship letter and check stubs with no furthur response from Countrywide. They have not been helpful at all and I have gotten nowhere with trying to deal with them on my own. So, I figured that going thru the forensic loan audit would be in our best interest to keep our home.
I have been told that I will hear from Loan Safe this week to see what my options are.
Exactly how motivated is Countrywide to help people modify when there have been violations found? I think that the violations found illegal kickbacks and exsessive fees to the lender, a bunch of disclosures not given to us, the 3 day right to cancel blank without our signatures, to name a few. How many are actually trying to fight Countrywide with hiring loan safe solutions to do the loan audit process and modification, not tyring to do it on there own?
I was tryingt to find a thread for those of us who are not doing it on there own and paying for the process also the success those of you have had with going thru the loan audit process and how Countrywide was more helpful due to the violations?

I am going thru a real estate agent who partnered with loan safe, James Magnusen, so I have not been issued a password.
Where do I get the password to enter into the paid forum?

I recieved a call today from the lawer Gregory Paiva but I missed the call!!!!
I called back but was not able to get a response today.
I feel like I have been holding my breath for so long and I just want to breathe.
I can't wait to find out what the loan violations they found can help me save my home. I will post when I get my answers, hopfully tomorrow.
Is there a specific section where people who are paying for the loan audit to talk to each other. I notice a lot of the people here are doing there modifications with free help, but I paid for my loan to be audited. I just wondered what others have had in form of success and how it turned out for them, especially with Countrywide. Findings for my 1st with Countrywide
3 day right to cancel not properly executed TILA Finance Charge Test FAILED – Under disclosed by $509,894.00 TILA APR Test FAILED – Under disclosed by 3.241% Violation of RESPA, $8040.00 was paid to the broker Because the (YSP) was not disclosed properly, the back-end Broker commission may be considered
an illegal kickback and indicates possible fraud or “unjust enrichments” by the lender or broker. This
is a strong “cause of (legal) action” and can in and of itself, justify a Truth-in-lending Law Suit against the lender or broker.
Findings with 2nd GMAC
3 day right to cancel not properly executed
We did not receive good faith estimates
So, let's see how these violations can help us modify our loan.
I am very eager to see how the lawyers can help me in my situation.

I called yesterday and they said he wasn't in the office that day.
I called back today and they said he is there but not in his office.
I hate to bother him and am trying to be so patient to wait for the call, but my whole life and my kids are in limbo.
Will be be able to keep our home?
I feel like my whole life is on hold and I just want to breathe again.
I called Countrywide and asked about the loan mod I was trying to do myself
prior to having the loan audit done.
They said they never received any of my paperwork, check stubs,
hardship letter and I have not been assigned to a negotiator.
That was 2 months ago!!!!!!!
So, I guess it is worth using an attorney and waiting.
What I would have to pay them in good faith money will be
better spent paying an attorney to get better results.
I would love feedback from others who are in my situation.
Isn't there anyone out there that is going thru my same situation where
they paid for the loan audit and are going to use the lawyer instead of going
the free route?
Do you agree that I will get better results using a lawyer than if I was doing it myself, like better rates, lower payments, etc????

All I can say is this...I, unfortunately panicked/was strong armed into accepting something from my lender which I thought was the best I could get...even my original motrgage broker said shut up and take it.
After mulling it over and talking to some others, I contacted Moe, and Paiva law firm. I found I had been bamnboozled once again by the lender.
The waiting would occur with or without an attorney..in fact, I firmly believe it is "worth the wait".
I am no expert by any stretch of the imagination...I hold no sway or fear....a qualified attorney has both these assets.
I have already been screwed twice by those in the mortgage industry...maybe 3 times...
In my mind, if affordable, it is the right way to go to use a firm like Paiva and Griswold who deal with these matters day in and day out.

I have some friends who had Countrywide take their good faith payment of $10,000 and then turn around and take the property anyway.
I just have to sit tight and wait for the lawyer to call me.

I need to get the final payment amount and conditions from the person who is
helping me and then my file will be forwarded back to Mr. Paiva's office to
process the loan modification!!!!
He said that he had just done a loan mod for someone else that had Countrywide and they were able to lower their payments from $4000 to $2200!!!
I can't wait to see what they can do for me!
I am so glad that we found loan safe and are having a lawyer handle the modification. I was getting nowhere by myself. Countrywide was going to require as much out of me as possible as a 'good faith' payment, so my money is much better spent having a lawyer deal with them, not just to get the best rate and payment, but for peace of mind.
I am very happy with my results so far!

For reasons I am not sure about,my file was transferred from Mr. Paiva's office to
Mr. David Garza's office. I was not sure about how I felt about that at first, but Mr. David Garza responded the next day after getting my file and has called me several times to follow up with me.
I feel very confident about Mr. Garza doing my loan modification and he also has a business relationship
with Mr. Bruce D. Stuart who is a very good real estate lawyer.
I will let you know how this saga continues to go. I know that Countrywide has offered modifications, but I can only think that having a lawyer will only get me the best of results, right?
