How my husband and I found out our stupid loan?

My husband and I wanted to get the interest only (until now, we realized there are so many fancy loans out there) because we want to refi and pull out some equity to pay our debts and keep some extras for emergency (not for this kind of emergency). We told him we want the interest only where it's fixed. He started to talk about this loan that has a low interest and etc. When we were ready to sign, I thought we were going to sign the papers at the office. My husband and I kept calling him to inform when the papers are completed, he needs to notify us so we can take a day off at work.

He called my husband on Wed. or Thurs of Oct. 25 or 26, 2006; the LO said he can come and have us sign the paper work at home for our convenient. My husband didn't come home until Sat. morning (He's a truck driver). That Saturday, coming from my Sat. work, my husband said the LO is coming over to have us sign our papers. When he came over, I asked him was is okay for him to sign. He said as long his boss knows he is being faithful.

When we signed the papers, he told us to backdate to Friday which is October 27, 2006. We asked him why? He told us because the papers he ordered have a cost and he doesn't want any extra charges. (We didn't know it was okay) so we signed it. That's how stupid we are. He explained how cheap our interest rate is, which at that time it was 3.75% or around there. He told us that the deferment will add to our next year interest and by the 3rd year we need to refinance immediately because it's going to be expensive. He did show us the form where the numbers change but he never told us it is going to defer to our principal. He told us that there would be a prepay penalty if we sell or refi soon. We asked how much the penalty, he said it's about $4000-to 6,000.

My husband and I thought we had a cheap payment until one day I told my husband let ask his niece and her husband if they want to take over our house, the mortgage and just change the title/or name.Due to the fact we want to relocate and the couples are trying to start a family. When we shared to them, they think it was awkward. We told them to ask the LO who sold us this loan. When my husband's niece asked the LO, the LO didn't disclose much until they both talked to CW in a three way call. One or two days later, my husband's niece called him and asked him is our loan is those type of loan like the other people she heard about. My husband said he didn't think so because the extra interest will add to next year interest and at the 3rd year we will be done paying and need to refi soon.

I told my husband to called the LO asap. My husband asked the LO is it true that my niece said it is going to add to our principal? He said it's true. I told my husband no wonder when we paid the bill I saw the numbers change but didn't understand what it was. I read the asterisk but still didn't understand. My husband called CW, they said the 3.75 only last for a month and now it's jumping up to (can't remember the %).

Make the story short. I was crying like someone had just passed away because that was my only prized possession. Dumb LO maxed us up like a credit card. I was so mad I started to send messages to all of these fraud website, plus President Bush, my gov. in MN, to the FBI and etc. Later on I complain to CW fraud dept. They said this is not a fraud because we agreed and signed the papers but some how this

Also, would you please resend a package of my husband and our signature
loans plus your package from "The preliminary Truth in Lending Disclosure
as well as all required up-front disclosures like the Good Faith Estimate,
PayOption ARM Consumer Disclosure Handbook, and Consumer Handbook on
Adjustable Rate Mortgages, to name a few, were all mailed to your property
address on September 26, 2006 by Countrywide. The included Amortization
Schedule shows the payments increasing year over year and also the balance
increasing as well," stated by you..

The challenge that I see here is that it's your word against his. Unless
you have something in writing stating what you have said and proving
otherwise than what I have communicated to you, there isn't much I am able
to do.

I asked Ms.Hxxx to verify where and when the signing took place and she
stated that on her calendar it has your appointment for 3:30pm on October
27, 2006, and that if the closing took place off-site there would have been
a charge on the HUD for a certified witness closer, which there was not.

Again, it's your word against the closing agent/notary's word. Ms. Hxxx
notarized your documents in addition to conducting the closing.

I do not doubt the sincerity of what you're stating but without substantial
proof this becomes a verbal dispute between you and your broker.

If there were discrepancies in the documents or an error on Countrywide's
part for closing the wrong loan, then I would be able to offer some
assistance but at this time your broker is the appropriate person to
address your concerns.

Until know I'm still battling with them. My husband and I are still paying the high mortgage interest to keep the house alive. We are still holding the because we have another investment prop. and if we abandon our single family home, I don't WANT THEM TO TAKE MY OTHER INVESTMENT HOME. My husband and I work so hard and that's what we only have for our future money and retirement.

Why do other people want to spend my money? I have done crying for a year now and every time I talk about those two retard companies it makes me so mad. I look forward to get my money from them. Can't wait to haunt them. If it fail, then they can have my home because I got my $$$$ from this house.

Thank GOD we were thinking about relocating and my husband's niece and her husband is in our picture.

I told my husband if that time we didn't know. Stupid people like us thought we had a good deal. So we stopped paying the cheap interest on April 2007.

Kay, you need to understand that they violated Federal Law by doing this. You now have a strong DEFENSE to fight back against Countrywide.

The law is called the Truth in Lending Act and it gives you what is called a "3 day right to rescission". Meaning once you sign the loan documents, you have 3 days to decide if you want the loan and 3 days to legally cancel the loan.

If this loan officer had you back date the loan papers, then this caused your 3 day right to cancel to be void, because you didn't legally have 3 days to cancel.

We can now make Countrywide take that loan and shove it up Mozilo's you know what. How does that sound?
