Hey!

Just got off the phone with Tarina Jones, customer service care department. She's taken over some of Ashley Stix's work load or so she said when I asked, I thought I was told I would be hearing from Ashley Stix?"

She is referring me to the workout department - duh - I've been working with them on my own since January 14th! And again, the question of income verification becomes an issue. I've repeatedly told them I have never had a steady income since I took ownership of the house. That I have up till now, been paying for the most part out of my savings. I told her that Sherry, the woman I initially spoke with in the workout department on January 14th told me to have my fiancee, who is willing to assist me in paying the mortgage until I am able to do so on my own again, to supply a letter of consideration

I understand they need to know that I will be able to pay the modified loan/s but as I've heard so many times lately. "They don't care who pays as long as they can payment." So, why then does it really matter now, who is paying the loan/s as long as they will be paid on time each and every month.
The biggest hurdle for me it appears is the fact that Countrywide refuses to acknowledge that I was put into these loans under false pretense. By that I mean, to make a statement that my fiancee's income doesn't count because he's not on the loan, but my brother who is on the loan/s is neither willing or able to pay anything towards either.

So, I suppose basically the reality is, if they will not accept my fiancee's letter of consideration as proof of income or whatever proof they are looking for to assure them that after modification/workout the loan/s will be paid as they had been until the middle of last month. That is when I realized that all I was doing by paying off those horrid loans was throwing my money into a pit without a bottom to it. Can anyone say, "The Money Pit," with Tom Hanks! Then, I don't have a leg to stand on and I will not get a loan mod/workout with Countrywide. What other conclusion is there for me??? Except, that I'm screwed...

No you are not, if the fiancee is living in the household they are accepting household income from the other parties legally living in the household....

Contact this person and see what arises with appropriate explanation, forget the issue of 2nd home versus, whatever presently your goal is modification and at this point that muddies the water and your need is predominately the modification. Let the attorney deal with the purpose of loan and occupancy issues, that is beyond the negotiators and the people who answer the phone. Oh, workout is modification, forbearance, whatever...just a lump name for the processes that are done in the work out of loans.

If this person can not assist you she will know who can....keep trying and understand at the work out level, the occupancy and purpose issues are moot, that is attorney level stuff that goes to negotiate the issues, and the folks at this level in Country Fried are just not up on how that impacts their position in the loan.

Hey Poppy!

Okay, as always appreciate the swift imput, however the problem is my fiancee is not living with me. We sort of take turns visiting each other for extended periods of time. So, what am I do except lie and tell Countrywide that he will be living with me? This is getting so complicated.

Also, why is it that the attorney's Gigi recommended on my other post where deleted before I had a chance to write their names down? Is it that you on the forum don't know enough about them? Is there a way I can get in touch with Gigi through the forum without us posting our personal emails, since I've noticed that is also a no, no... I realize Marshall comes highly recommended on the site and I respect that, but I'm wondering if a Florida attorney would be best for my personal situation.

Oh, and speaking of which, sorry if I broke the rules by requesting attorney recommendations. I wrote the post in one of my anxiety driven burst of energy last night.

We do not cross refer legal or for profit services in the forum, there are issues that cause us to one be at risk and two be in a position that will allow other parties to just descend upon us with this "stuff". All references to Web sites, Attorneys, Realtors, anything of that nature is deleted for the well being of the members and the stated terms of the site.

Never, ever fib....the fact that you have assistance in the household should be clearly and positively noted in your modification package with copies of the paychecks, W-2's and a very serious letter from the other party. However, since they are not residents of the household, there is that possibility that the income can or could be discounted. That is up to the underwriter at the other end of the equation. This is not complicated it is simple you need a modification and you need to get someone at CountryWide to act on your behalf, now and reconsider the issue with the proper and appropriate documentation. That is why I posted that person's number, they should be able to forward you onto the appropriate party or at least give you solid information regarding your case.

I will simply state the facts as I have been and hope for the best. That my fiancee has and is willing to continue to assist me until I know longer need it. Which is stated in the letter of consideration faxed on his behalf along with all other requested documents.

Sorry it is so difficult kiddo, this is an awful time for many, I wish that it were not, but here we are.

I do also wish that I had the ultimate solutions for everyone, however I can not do that. I do not run the joint (world of finance)...

I understand and appreciate all you and everyone associated with this site are doing for those of us in need. And now, I am off to email Marshall per his earlier request via my post. Afterwhich, I beleive I am going to take a break from all of this and enjoy my fiancee's company before I return home tomorrow.

Hello all,

Its been awhile since I've been able to post. I don't have daily, hourly access to the wonderful world of cyberspace when I'm home. Home - boy that sounds like a double edge sword.

Okay, so two weeks ago I was told by Tarina that she'd be calling me within 24 hours to give me the name of my negotiator. She did just that, but I wasn't available to take the call so she left a brief message. I returned her call the first chance I had and yes, got her voice mail. I have not heard from anyone from Countrywide for almost two weeks. I did finally receive the return receipt dated March 3rd indicating that the certified letter I sent to the Office of the President arrived and was accepted by someone. Couldn't quite make out the name but it didn't look like Adrienne Ely?

I have since spoken with numerous attorneys who's names I got off the NACA website. So far, one thinks he might be able to assist me but I don't feel very positive about any of this any longer. I've listed the house with a local real estate company who was willing to work with me regarding the commission. I don't know if they have the experience I need to achieve a short sale, if necessary. I am so tired of all of this! How does something so beautiful as buying a first home turn out so ugly??? Oh and my brother finally called me and at first he was extremely pissed off about the prospect of his credit being ruined by all of this. He verbally tells me he's with me in this fight but still expects me to do all the work including finding the right attorney. Doesn't want to talk to the mortgage broker who is located maybe five minutes from his house in Ormond on our behalf. Am I being selfish when I say, "is he kidding me!"

I'm sorry. Don't mean to bring anyone down but I'm afraid the reality is I'm going to lose the house. I just can't believe its coming to this. I feel completely paralized and numb. I just can't take it anymore. I have a home that each day is going down in value while my loans are going up. I've been living on my savings since I purchased. I've tried to be positive and have prayed for guidance and peace of mind to help me make the right decision.
I know, that some of my prayers have been answered because I found this website. Still, while I write this at the local library I fight back tears of anguish and want to crawl so far under a rock that I'm never found... I've always been a fighter and that's what my brother is counting on for both of us, but geez - a little help would be nice. Just a little!!!

Thanks everyone for your support.

I just received the doc's requested from Countrywide but only on the first loan?

Tarina sent a letter along with the doc's indicating that I have been denied because I admitted that I have no income. I went to see a local RE attorney who was so nice and generous with her time. She told me to speak with the attorney who's handling the lawsuit against the builder of the home for breach of warranty contract. She said since it appears I paid too much for the home and the home has obvious defects. His defense should be that I paid too much for a defected house. She said if only she was a litigated. She'd forced the builder to buy the house back. Plus, I just found out that all the room sizes including the two bedrooms upstairs which are four feet smaller than what the MLS and builder spec sheet indicated are wrong. If the room sizes are smaller than the square footage must be wrong. Wow!!!

Looking over the the loan doc copies from Countrywide my fiancee discovered that most doc's don't even show my name. So, on paper the home is my brother's second home even though I've paid for everything. Tell me this isn't enough so far to make a person want to check out. Good thing I'm not so inclined. It's not worth it!!! I am fighting for a home that was suppose to me mine but is in fact, my brother's second home. A home he wants nothing to do with. You tell me how crazy is this all? Oh, and on the adjustable rate note which is four pages. . . I've been told repeatedly the note is usually one page. The last page shows our signature but the other three pages are initials that don't match mine or my brothers. Interesting how I have no copies of this note and my brother told me yesterday morning he has three copies of a one page note with nothing on it. No initials or signatures. In fact, he has copies that I don't have but he told me there are no initials or signatures on any of his copies including three copies of the TIL. I haven't one copy of the TIL so my brother is mailing all his copies to me today. I want to compare what he has to what I have and what Countrywide sent.

Excuse me while I go scream!!!

Yes, both of us sign the note. However, my brother has repeatedly told me that neither of us signed the TIL copies that he has. He overnighted all loan doc's in his possession and I should get them by tomorrow at three. It will be real interesting to see what he has that I don't. It appears his copies are different then mine and neither one of us shares most of the doc's that Countrywide sent me. I have copies that Countrywide either doesn't have or didn't bother to send.

Okay, the countrywide package doesn't include TIL or RESPA copies. I received my brothers package today. He has one copy of TIL withhout any signatures along with the HUD settlement statement without signature which I don't remember seeing. He definitely has a lot of copies I don't have which do not match what Countrywide sent to me. Where do I get a complete package if not from Countrywide? Should I be making a visit to the title company where the closing took place? I have an attorney who is waiting for me to drop off copies of the doc's but now I'm not sure if I have everything. This whole transaction appears to be such a debauchery. I have never in my life experienced such incompetence. Starting with the real estate company representing the builder. The mortgage broker, title company and lastly, Countrywide. My brothers copies where in such disarray it took me over a half hour to place them all in proper order and I'm still missing pages. I know he received them in that mixed up order because what I have was also out of order. Oh, and my brother tried to pay a visit to the mortgage broker and it appears he's closed the Ormond Beach office. Hmm...I can't imagine why!

Question about the HELOC on the home which I was convinced into in order to not have to pay any PMI. How does TIL, RESPA or any other violations affect that loan. Countrywide is servicing both as October 2006.
