Countrywide modification

my story is quite similar. the only horrible part is i am in ga. i have a foreclosure date which is sept 2nd 08 and i am now 5 months behind on my mtg.I fell behind in nov due to some car repair issues and job changes i called for help way before i was behind one payment and was given a ridiculous repayment plan that i could never pay . when i initially became behind i did not qualify for the fha partial claim.(not enough payments behind.) it wasnt until i called on june 25th,2 days past the day the letter of default was set to expire.i was then told i now qaulified for the partial claim and an told by an automated machine not to call until aug 14th....and that collection activities have been temporarily suspended. now isnt foreclosure collection activities?!!! well i was told by cw that they are aware of the situation and they are working on it and that the message did not say that. i then clocked over and let her (cw rep) hear the message and she then was speechless but stated that collection means phone calls and ect. well any way,what do i do? wait until aug 14th for the negotiater to call me or should i file ch13 and save my home instead of waiting for countrywide to drp the ball? i will have 6000 by the end of the month but i wont have the 8000 until sept 6 which is 4 days past the sell date. what should i do?

Contact FHA at the number listed on page two of the partial claim fact sheet linked here.................tell them that you don't have much time before foreclosure and that Countrywide is dragging their feet on your claim.........

i called fha today and they havent done anything with my file yet.the lady at fha was very surprised at how countrywide was dragging there feet. she sent a message for hud to contact them and said call by friday and i will have a update by then.

here i am with my update!!! well fha called countrywide....they called on friday and a workout negotiater was assigned on friday!!!! guess what she had just recieved my file that the customer had told me had been being worked on since july!!!!! anyway she stated she would be sending my docs out and if i didnt get them by weds i should call her!!!! i am keeping my fingers crossed... oh by the way all the paperwork i sent in the beginning has nothing to do with her... now i have to complete it all over again!!!! she stated we should be done by the end of the week... i will keep you updated...

Well I told you FHA can get on Countrywides butt.....aren't you glad you found us......

They do not like when a servicer is jacking around with a loan that they back..........

I hope you get some good news on the claim!!

ok , you guys i am stressing again. The lady called me who is working on my partial claim who says i should expect docs today... well i didnt get them. I called her and they said the lady who does them is out sick and she has 11 days to complete this task.... that would put me at the 23rd docs recieved by 24th and very close to my 9/2 sell date!!!!! omg!!! then she tells me that she is new and just started!!!!!! arggggg....... i am sick countrywide is going to screw me i can feel it!!!

Please don't stress.............you need to stay focused............with FHA involved, I am sure as the investor they will not let Countrywide sell your home while you are working on the partial claim........

how long do i wait? my sell date is sept 2nd and now i havent heard from my negotiator nor is she answering my calls to confirm receipt of my docs...

Did you get tracking info from FedEx and had it been received and signed for already at CW?

well here is the update. called and found out my negotiator's mother died so she is out. they recieved my docs they say on the 25th..my sale date is the 2nd. when i asked what were they doing she stated " well i cannot see them but we have the money. i then asked are they going to postpone the sale date she said she cannot give me a definitive answer wether they will postpone it or not. SHe stated she will call me today..I am so sick of this sh-- i swear when i get this worked out i will not ever be late again....!!!

Call FHA also again..............and tell them that you signed the docs and sent them back and CW refuses to tell you if your sale date is now cancelled and can they please help answer that question because the date is 5 days away........
They are your investor.........and I have said that they will not tolerate the treatment that you are getting from a servicer that they hired to service their loan................

I called fha and she gave me the number to the VP in loss mitigation her name is sheryl

called and left her a message. I also called the lady who is working on my documents who acts like she could really give a d---. she stated that her priority are the files she has today. as of today my files are still not scanned into the system. but it will be resolved today.

well i spoke to the supervisor who stated it takes some time to get the docs scanned and ga doesnt allow you to postpone a foreclosure. It has to be cancelled
so she said if paperwork isnt in then it will be cancelled and if it doesnt work will start all over again.
