Can Countrywide refuse western union payments?

Can Countrywide refuse western union payments?

Here's the situation...
My partner lost her job back in September of 2007. She called CW the very next day and told them. They reassured us it was no problem, we will work it out. She kept continuous phone calls with them, updating them all the way until November when she got a new job. We asked what payment agreement we could work out. They said, "SOMEONE WILL GET BACK TO YOU".

No one did.

January of 2008, we started getting the foreclosure warning letters. We called and called, and kept having to leave messages. Febuary of 2008, we got so pissed off because we were ready to make payments, but they kept giving us the blowoff. They told us they could not take any payments from us, we were in the "workout dept" phase. Well, I called anyway and made a payment through their regular number. The guy seemed pissed but took the payment anyway. I think that is what saved us. Again they never called us. I did some research and called the HUD. Told them our situation and they said they would contact CW. AN HOUR LATER, we got a phone call from CW. They offered us a forebearance agreement, which we agreed upon.

NOW, we had to make three payments. May, June and July. We paid through western union and all three payments, we got a letter back from CW stating they received it. After the last payment, we were told we would have satisified the forebearance agreement, and would continue going on paying our regular payments.

CW called us once a month and asked us to fax them our recent paystubs and bank account info. All three times, we obliged, doing so the very next day.

We received a phone call from them AFTER THE THIRD PAYMENT WAS RECEIVED telling us that they cancelled our forebearance agreement and now we have to pay the back payments ($6,000). They said they did not receive our faxes. (liars) The lady who we were working with (Stephanie Kelly) no longer works for Countrywide and the new lady is too busy to return our calls.

We have no record of the faxes since it was faxed from our job. It did say, "Fax completed to Countrywide" so I know they did get it. I honestly think they are trying to pull a fast one on us.

We have to send them the money by Friday. I'm so pissed, I could scream.

Right now, I know we can't do much of anything. My partner is unemployed once again however, she is getting a loan approved this week to open up her own business. If CW wants proof of employment right now, we're screwed.
We *might* have the $6,000 by Thursday, but we are not sure.

I just dont know what to do.
Any help would greatly be appreciated!!

To sum this post up, we did a forebearance, paid all payments on time, everytime but they cancelled it because they said we did not fax the paperwork the last time. (we did)

Welcome to the forum and thank you for joining...........

You would need enough household income to show a surplus of $100-$250 at the end of the month after doing the income and expense sheet for a modification....................so you might have to wait on that............it is also determined by your interest rate.............
Will your partner have income again sometime soon?

Since you called HUD...........do you have a fixed rate FHA loan?
What is the rate?
Are you still behind on some payments?

She will *hopefully* be getting the approval for the loan for her business this week. If not, she will have a new job within two weeks.

Yes, we have a fixed FHA rate loan. I'm not sure what the rate is, I'll have to check on that.

Well, they said if we do the forebearance agreement, they will tack the payments we were behind on to the end of the loan. We paid all three payments on the forebearance agreement on time, everytime. I just dont understand how they could possibly cancel something that we did everything 100%.

My partner is going to call HUD today to give them a heads up but I was wondering what my other options are.

If you are still behind on payments or have a lump sum due.........have your partner ask HUD about doing a Partial Claim for that amount to get you caught up.............FHA does offer this to their customers...........

Alrighty, here's my update!

The basics is this: we agreed to a forebearance agreement with Countrywide. We signed the paperwork, faxed it over, sent in ALL the payments on time, everytime. One employee there, who we were working with, would call us once a month and request updated bank statements and paystubs. No problem. Sent them the very next day, everytime.

Well, we called after our last payment in the forebearance agreement was sent. They told us it was cancelled. They said they didnt receive all the paperwork. We asked to speak to the lady we talked to, she no longer works there...they also dont have any record of her calling us to request the bank statements/paystubs. As a matter of fact, the guy was sooooo rude, he even went as far as saying, "well, you wouldnt be in this situation now if you made your payments on time".
(Nice, huh?)

We filed a complaint with the Attorney General. He said he has heard our story MANY times before! Apparently, Countrywide will take all of your payments through a forebearance THEN cancel it, and request the past due balance in FULL or they will start the foreclosure procedure.

I'll keep you updated on what he says.

Just curious, has anyone paid through western union and had countrywide refuse the payment? If so, did you get your $ back?
