Seren: My suggestion is sell it back to them for $1, that way they can't come back to you and say they didn't buy it. You'll have a price on their at least. Joni

Hello Everyone,

The buyer who was supposed to buy my house can no longer afford to purchase. What my real estate agent told me late this afternoon was he lost his locked in rate; rates have gone up and he can no longer afford the house. To say I am upset is an understatement.
I have composed an email which I will send off to all the contacts Cat gave me for Countrywide on Monday after I get some feedback on it from you. Please feel free to add or subtract as you feel prudent. I need all the help I can get from Countrywide and I want to make this as clear to them as I can.
The only thing I worry about is with B of A taking over on July 1st, what happens to us who have mortgages with Countrywide? If I send this off and I get someone who can or will work with me, what happens if they are replaced on July 2nd?
I'm starting a nervous breakdown club............anyone care to join me?

I am writing to request a Deed-In-Lieu of Foreclosure from Countrywide Home Loans. Many circumstances have led to a dramatic change in my life and financial situation. I can no longer afford my home. I do not have the means to pay the July 2008 mortgage payment.
In September of 2005, my ex-husband left our marriage. Our divorce was finalized in October of 2006. On March 14, 2008, I lost my job which provided me the ability to pay the mortgage payments and other necessities.
With no income and no real prospect of obtaining a permanent position in My City, Washington, I am forced to examine my limited options. I have come to the conclusion I must surrender my home to Countrywide Home Loans and move back to Phoenix, AZ where most of my family resides.
I am quickly running out of unemployment checks and cannot make another house payment. I simply do not have the funds. The money I currently have available to me must be left in reserve for my moving expenses. I have sold most of what I own and am left with nothing of any real value to sell.
My home has been on the market for sale since March 11, 2008 with many showings, but no buyers. Funding is very difficult for buyers to obtain in the current market and in the small town where I live, there aren’t many buyers to begin with.
I would like to bypass the foreclosure process and I request a deed-in-lieu of foreclosure to make this as expeditious as possible for both of us. It is important to me that I salvage my credit rating so I can move forward with my life.
Please respond at your earliest convenience to advise me further on the process as I am unsure how to proceed. I am sure there is some sort of paperwork which must be completed, and I would like to have this wrapped up before my next house payment becomes delinquent. I look forward to hearing from you.

I will send it off late Sunday night so it will be one of the first things they see in their emails on Monday morning. No attachments.

Do we know yet how the Bank of America/Countrywide sale is going to affect those of us who are in the middle of negotiations with Countrywide as of July 1st?

My husband and I have made a decision to ask Countrywide for a deed-in-lieu of foreclosure also. I have done this in the past. We offered to sell it for $1. That was 25 years ago. By selling for $1 it did not show up on our credit report. I have a feeling working with Countrywide to get a response is going to be impossible. I think we should all write our Congressman about Countrywide's responses to their customers. I am. So far we have asked for a loan modification because our interest rate is almost 10%. But get no response, other than a letter that they are theatening foreclosure on us. That is it from them.

It looks like you and I are in the same boat. I just sent my email request off to them late last night/early this morning.
I am sincerely hoping they do not wait until July 16th when my house payment will be officially past due. If they will let me sell it to them for $1, a nickle or a penny, it would rescue me from a black cloud which I fear would follow me for many years into the future.
I wonder if our sending the same request several times a week would get anyone's attention. I would be willing to do that.
As for writing my congressman.............Joni, Girlfriend, I have no idea what I would say. How do you convey to someone the depths of despair I feel every minute of every day? And I live in Washington state where Countrywide can pursue me for a deficiency judgment. I feel my life as I once knew it is pretty much history.
I am no longer hopeful about the future. In fact, it scares me to bits. I see a future where my future wages will be garnished for decades to come and if I lose my credit rating, possible homelessness.
I most sincerely hope your situation works out well with Countrywide and you and your husband can go on with your lives, be happy and live well.

Countrywide Nightmare

I am currently meeting an Attorney (10:00 am this morning), 7/1/08. I live in K.C. They told us they heard there was a class action suit filed against Countrywide here in K.C. We are going to file an injunction to stop foreclosure proceedings. We have missed two months payment now.
Countrywide was supposed to pay our property taxes, but didn't. They have billed us for it and now have made our monthly payments go up to $1700 from $1300. We have tried to all Countrywide for the past 2 months, and no one will call us back. Imagine that. They just don't care. They said if we don't pay by July 2 the past 2 months, they are going to proceed with foreclosure. I will let everyone know if there is a class action suit.

Good Luck to you, Girlfriend! I hope things work out and you along with others in your state are able to reach some sort of resolution with Countrywide.
As for me, I still have not heard a peep from Countrywide since I emailed them my DIL request on Monday morning. I was hoping someone would have called or emailed at least to say it had been received. Guess not.
Wonder how things will change once the Bank of America/Countrywide deal concludes and our mortgages are held by Bank of America. Today is the day it was to be finalized, wasn't it?

You might try this # at Countrywide: 800-669-6607, You do have to enter your Loan # and very your Zip Code, but actually got a person right away. This is the Customer Service Dept, but it didn't take 30 minutes on hold.

Most Serene - I too am from "a little town in Washington State." I can commiserate - don't have much in the way of advice to offer though. We got approved for a loan mod that sounds terrific, but they forgot to include this little thing in the loan called "property taxes," so we are waiting for it to get management approval again. I wish you the best of luck.

Help Help...

I received a call from Nikki Worthington this morning. She has received my request for a deed-in-lieu and will assign a negotiator to me. She has asked me to fax information to her, but this fax number I have isn't working. She gave me 1-800-658-9364 and there is no answer. I do not have a number to call her back. Does anyone know if this is the correct number or have I written it down incorrectly? She said she was with the office of the president, if that helps.

We are talking to Kacie Miller in the office of the president, and we have the same fax number. We faxed our documents last week to this number and it worked. Maybe keep trying? I dont know if it may have changed with the merger with BOA? I'm sorry I can't be of more help! Good Luck!
