| | | Sale Date on 5/22/08 - Help! I’m an idiot who just barely found this forum. My house is due to go to auction on next Thursday. I’ve been on the phone trying to reach my negotiator for months, and was always told to call back in a 10 days, a week, etc for weeks now. I was also misinformed that they would not foreclose on my house during this time, while they are getting the loan restructure ready. It wasn’t until they posted the trustee’s sale notice on my house that I found out that someone didn’t tell me everything. Now I find of course, that they only wait till your sale date and postpone two days before.
I have been trying to reach the negotiator, but only seem to get the work-out dept and they read me the notes. Yesterday, they told me a package was being sent and we would be able to utilize the Home Saver Advance Program from Fannie Mae. Then today, when I called, they show that the sale has been postponed. So, I’m asking how reliable is this information? I feel really stupid listening to a work-out person, when they don’t always know or care about you losing your house. How can I know the auction is stalled while I wait to get these programs working for me. They told me 3 times (different people) that while the file is in review, Countrywide will not foreclose. What are the chances they are telling me the truth, and that I can feel reassured that I won’t accidentally be foreclosed on?
I have six kids, one with diabetes and seizures. I’ve even tried to get the re-instatement amounts and addresses to send to just in case they somehow proceed with the sale (I will borrow from a relative if I have to). They say they have to reorder the amounts, and that’s 48 hours. How can I find out, and be ready to give them straight up cash at the last minute in case they are lying to me? Also, what about the reinstatement amount. I'm going to try and get that amount again today, but they kept passing me around yesterday. I will hammer them today on that. If I need to, I will have the funds Mon/Tues and just pay it up. Then I can sleep again, no mod, no sale! Would I still need an atty? (I'm going to do some serious begging over the weekend, but I just filed 07 taxes and the kids help me have the funds to totally catch this up!
I wanted to hang onto the cash to help us make future payments, but I feel very uneasy at this point risking losing the house because I was led to believe that Countrywide actually stalled the process, and then didn't. And if I wait till Tuesday and verify that the trustee has also stopped the sale, then can I rest assured? And if I do that, I only have one day left to stop the sale if they haven't followed-through on the postponement!
And the hardship letter - I know I read somewhere about it - I already sent them this info months ago. Should I send another?

Email that hardship letter to all the emails provided. You will get a response. 1 person got a response the same day as well as a mod offer that same day. Please go to the Success Section of the forum and read read read. But email first  ! I know its stressful, I have been there.. Just follow what Cat says and you to will save your home

I did receive an email from my negotiator, first contact ever thanks to the email addresses provided here. He says the sale IS postponed! So it is not just a rep from work-out dept, now the negotiator says no sale. I will move on to verify with trustee next week. I will stand ready with cash to solve even at the last minute (Tues/Wed). I know I don't need an atty for this, but would it be advisable if the trustee doesn't show the postponement by some stroke of bad luck? I have also rec'd the application for the Homesaver's Advance now too!

My sale date was 5/13 and on the day before the sale my negotiator decided to call out sick, could not get anyone one the phone. This is when I decided to contact thoose emails. I had three people call me with in four hours and two people email me. I know how you feel the sleep sucks but it will be over soon and you will rest easy. Just make sure you have the money ready when you get the letter. Also if you want to check out what I went through it is under "Partial Claim".

I'm in the clear till I decide to take advantage of this Home Saver Advance Program, or try and make up the back payments. Today after mailing out to all the people on the list, I got two emails quickly (within 20 min) and this afternoon, got a phone call from Liz Moyer. She's asking the financial routine again, and wants me to fax current W2s. So it's redundant to do at this stage, but I was just happy they followed-up regardless.
I will go read your partial claim Dmooresville, but what letter are you referencing in your post that I need money ready to act with? I'm sorry, I just woke up, I've taken 3 naps today. I'm feeling much better and can finally sleep!

I believe they are referring to the Good faith money aka down payment aka contribution. Usually when a mod is approved there are monies involved that need to be back to the lender within 7-10 days with teh signed/notarized docs they send you. In my case it equated to slightly more than 1 months payment. But I did not have countrywide. | | | Trust the Trustee Sale is Postponed? I've checked with the Trustee Sale hotline, and they say that my sale date has been postponed to June 20. It also says they don't guarantee the info. Should I check further to verify with an actual person on the phone, or should this sale hotline update be sufficient? Countrywide negotiator has already confirmed this postponement as well as other work-out dept personnel.

As much as I try and relax, I still am feeling like someone is trying to take my house and everything I own. This has really done a number on me! I keep thinking I'm gonna wake up and realize that the postponement was wishful thinking, a dream, and I still have to face the nightmare. In reality, it's been postponed and I can focus on solutions from here. I'm waiting for Thursday to come and pass (I hope to make it to the sale and see who was gonna try and steal my house!). Then I will rest! I've been unable to sit and make calls cuz my son has been experiencing life-threatening low blood sugars (diabetes) and I'm trying to get him in to see the doctor (no insurance), and I'm running other kids to several schools in different directions, so I can't even call and verify. Although I believe from all sources I've contacted that this IS postponed, I get this knucklehead at the door tonight, ruining my American Idol hour, telling me that my house IS still slated for the auction block Thur 9am. I'm mad, shaken again, and start thinking somehow they have crossed the wires. Is there anyone else out there I should or could contact at this late date? I'm also understanding that the Trustee is who I need to contact to arrange for re-instatement - does anyone know if that is true? I've half-ready to run and try and cure this tomorrow, just so there are no surprises.

I wouldn't worry too much about the idiot at your door.........he is probably an investor who is signed up to get auction lists from the Trustee's office which come out a couple of months before the auctions...........so yours would still be on their list........
Yes you would have to call the Trustee to get cure figures for reinstatement..........but also call CW's legal dept. again tomorrow..........

Even the Recontrust has told me to go to their website 'Recontrustco.com', input the TS NO., and it pulls up my home as being for auction at a new date of '6/20/08'. That should be pretty good verification.
