Unhappy Here's my story with CW BOA HELP

Hello Everyone,

I am new to this forum so here goes my long story..
I have a 30 year fixed loan with CW always made my payments on time
I am self employed and when the economy fell so did all of my business.
I contacted CW Jan 2009 telling them of my situation fell behind on my payments feb. I spoke to CW everyday and In March I was sent from the hope team new modified payments I was so Happy and relieved... My 1st new payment was due on May 1st I sent back all documents the next day in March.
The hope team said that my past due payments would be put on the back of the loan. the interest was going to be reduced for the first 5 years then go back to original interest of 5.75percent. I called them weekly and would ask them if I was def accepted for the loan mod and was told yes that we would not have received the documents if we were not accepted into the program.
Please note that my mtg payments were 5,000 per month that include my taxes. New payments were 3286.00 so I continue to make the loan mod payments on time.. Waiting for the new mtg documents that we were suppose to get... They never came So July 3rd I got some early fireworks a letter from BOA saying that I owe them $22,000 I got so sick that I had a sever anxiety attack and went to hospital .... My husabnd called BOA and they said that program they had no clue about it and anyway the Making homes affordable plan would be better anyway. So later in the month we get another Fed Ex envelope and fill out all papers send in all documets the next day. sent all of our bank statements profit & loss and such the new payment is 3000 1st payment Aug 15th No Sept pymt Oct1st Nov1st
I just made my last payment. So I would call weekly different story every time u speak to someone So I email Barbra Doser and Get a call next day from Juanice Neal. She said she has no idea why my first loan mod was not honored ( me neither) Then calls me and leaves a message saying that they r going to honor our 1st loan mod this was end of Sept 2009. Next time I hear she tells me to speak to a David C he has been help full but he is not in underwriting?? and just tells me that his usual job is to put your past due payments on the back of you loan.. So kim Menser is the one who is in underwriting ?? anyone ever here of her there is no way to get in touch with her ever I tried email and such and when she does call she always needs papers that I have sent over and over again.... HELP in NJ

Welcome to the forum. So sorry for all the crap you are dealing with... there is no rhyme or reason to the hell that the banks are putting us all through. I have never heard of this Kim you mention. I wish I could give you some better insight as I know how frustrating this whole process is. I can only say that if it's in underwriting, that is a good thing and you are nearing the end. If documents are more than 90 days old, they will request updated info (even if it is the same thing you have sent already). Hang in there! This too shall pass!

I have sent them all updated documents up to august they wanted all of our business bank statements and profit and loss for the 1st 6 months of 2009.
Does anyone know about David Kovik what his job is exactly???
he is the one that I have been in touch with . All he can say is he is waiting on underwriting ?? what about my past due payments I have been making payments the MOD payments. But I am afraid if I get denied they will demand all of my past due money which is over $30,000 I am so scared I thought that I was getting the MOD back in March then July ??? Nov 1st is my last mod payment now what?? anyone going through the same thing HELP

I am assuming you mean David Kozik (800-405-0078, ext 3047)? That is the same negotiator I have been working with. He is a sr. collector (aka negotiator) with the Home Retention Division - VIP Office of the Chairman. To my understanding, underwriting is the final step in getting things wrapped up, and I am sure the underwriters are exceptionally busy. I know your fear and concerns after reading what has already happened to you and reading what others have gone through. I am just still waiting to start a trial (any trial will do!). This is such a stressful experience and a real test of one's strength and patience. Stay the course and pray for strength (and sanity!). I know it is difficult to do, I struggle with my own stress every day. Just know that you are not alone and it will be okay. If ever you need a shoulder to cry on, we have lots of them here. I am just wondering what happens after u make your 3rd trial payment??
they say they r still working on it.. I feel like I am at the end of my rope.
If u get denied MHA program then what happens?? anyone knows??

Here's how it is supposed to work...once you make 2 trial payments, they should draft up the paperwork for the permanent mod. If you get denied for MHA, they do have their own modification programs that they could try and get you into. There is also NACA and they have been able to help some people get mods even if the person has been denied numerous times trying to do it on their own. There are always options.

Well after my second payment they asked for a letter saying that we don't pay homeowner assoc fee's. David has been very nice and said that he will help me if the mha falls threw. I am just afraid can i believe what he is telling me? I hope so since he is in the chairman's office?? What do you think in your dealings with him??

I just want to stay in my home any way that I can do it. I have 3 daughters my oldest is 11 my youngest 3 I feel like I am so stressed with all of this that I forget how to be a Mom....

Personally, I think David is a great guy. He has always been very upfront and truthful with me and for that I am grateful. I have read some bad things said about other negotiators being rude, etc and he has never made me feel bad in any way. I've also seen him go to great lengths to try and try again to help people out in getting a mod. Of course, there are always the cases where the investor just won't do mods and his hands are tied then. I've haven't had too much trouble reaching him either. I normally send an email with a read receipt on so I know if he read it. Of course, he does take days off here and there but is normally good about putting an out of office auto reply on. I have also left voice mails if the email goes unanswered. The only times I haven't gotten a quick response is when he was out of the office or playing catch up the next day. I just talked to him the other day and he had been off the day prior. He said he had 65 new voice mails plus probably at least a hundred emails to catch up on.

As for the "I forgot how to be a Mom"...I know how you feel. I have a 2 year old and 4 year old and have let all this house stuff consume me and the stress and sleeplessness! It will be okay. Take some time to go do fun things with the kids and take delight in the little things they say and do. It will help de-stress you!

Welcome to the forum. you sure you didn't copy my story. These guys are suppose to be qualified bankers and accountants. NOT. how do they screw things up so bad?? Gotta be on purpose.

I can imagine how much you want to keep your place. Ya gotta remember to be a mom and a you Keep your faith in yourself. They can't take away who and what you are. If they can get you all stressed out you won't think straight. Then they win. Read and learn here and keep your wits about you. Its hard and it sucks but you can do it.
