Social Security Continuance Letter?

My wife and son receive SSD. They have been getting it for 20+ years. We sent in copies of the benefit letters we got from SS, but today the Home Retention called and asked for Continuance Letters to show that they would be receiving payments for the next 3 years. Of course today is the 1st of the month and the worst time to call SS. The recording of my local office says to call back on the 10th for faster service. I don't want to wait that long so I shall sit and wait on hold until they either answer or go home for the day!

Is there really anything such as a continuance letter or is the bank just blowing steam to delay things? They said that they could not continue to review me for mod until my file is "complete".

Thanks for bringing this info to light.

I receive SSD, too.

If they said this to me-- I would tell them this sounds like a type of discrimination.

And if they don't drop that issue, contact the Equal Opportunity Commission or other agency.

Just got off the phone with SS. They state that they do not issue such letters EVER. It is SS policy. I am getting a letter from my local office stating payments monthly amount for wife and son AND stating that SS NEVER issues such letters.

I can't give the bank what doesn't exist so I have to imagine that this will be the reasoning for not giving me a mod.

I didn't have to put this amount into gross income because wife and son are NOT on the note, but I did to prove that we COULD pay. Now I am sorry I did that.

Going to call my negotiator now and send emails to OOP.

Moe, any thoughts on this situation?

Spoke to negotiator and she asked me to call Home Retention back and talk to them about it. She told me that if they insist that I have to have this then she will go to upper management and talk to them about it and get this nonsense stopped because you can't give what doesn't exist.

So I called HR and was told just send in what you get from SS, but that did not answer my question. so I will be calling Jessica back later today and let her get this straightened out

Got letter from SSA today which stated benefits AND THE FACT IT IS THEIR POLICY TO NOT GUARANTEE MONTHLY PAYMENTS FOR CONTINUANCE. Faxed it in and hope they accept this fact. Otherwise they have EVERYTHING they requested and have acknowledged reciept and upload. Will check with them next week to make sure they have gotten these (my fax machine said they did)

This reminds me of when they asked me to prove I WAS NOT drawing un-employment. My hardship letter stated I had no income and we where getting by only on my wifes income, how do you prove your not drawing un-employment? Beats the heck out of me, I ended up writing and faxing a statement that I am not drawing or entitled to any un-employment. It was accepted.

Many people are on Disability Fixed Incomes, loans were even written and given to such borrowers, as their Disability Fixed Disability Income is & was used to qualify the borrower for the loan..

Simply showing that you have deposited Disabilty payments in your checking or savings accounts for the past 2 to 3 MONTHS, via bank statements, is all that is LEGALLY required to qualify for any loan modification !

This asking for proof of future Disability payments, for any length of time is a crime & should not be allowed to continue at Bank Of America.

Moe - Please run this by Dan Frahm as one of the major criminal loophole tactics being used at Bank of America

Attacking people who are on disability and using it against them is a Deplorable, Dispicable, DISCRIMINATORY and DEFRAUDING CRIME !

Let's just calm down until I find out if B of A accepts the letters faxed into them that I received from SS. My negotiator agrees that there is no way that I would get such a "Continuance Letter" and at that point she has promised to go to bat for me should they NOT accept what SS has written.

While I am NOT defending B of A by any means, I think that because they are hiring people who are not aware of the policies of Social Security there are unreasonable requests being made. I think that part of the problem is that my wife received SOCIAL SECURITY DISABILITY AND MY SON RECEIVES BOTH SSI AND SSD. You probably CAN get a continuance letter from SS IF you are on retirement benefits. The people working on my case may not realize that these are 2 different programs that are administered by SSA.

The people I have been working with have been most helpful especially my negotiator Jessica Gedang who has gone out of her way to get some issues regarding self employment paperwork resolved to my best interest.

Before you jump the gun, wait for me to update my post when I call later this week to see if these letters have been accepted.

I am perfectly calm Montana, but a little perturbed that you would actually tell me to calm down & not jump the gun... Which is NOT your place to do so and I am also doing niether act..

On this forum I am NOT defending any particular INDIVIDUAL at all, as in you.

Your circumstances are only a COMMON symptom of what is happening to MANY MANY other borrowers with Bank of America and or Fannie Mae, etc etc

We protect each other as a group here on Loansafe, not necessarily as individuals,although that is a part of it...

Remember, what is happening to you, is not just happening 1 or 2 people, it is happening to thousands...

What is happening to ONE OF US, is happening to ALL of us in a sense.

I am PROTECTING THOUSANDS of peoples rights to NOT be put through what you are going through, which is Discrimination and Fraud and BS loopholes.

Disability in any form and Protecting the legal rights of everyone through ADA / the Americans with Disabilites Act, is what I am doing here.

And tryying to close up another BS loophole at B of A and Fannie Mae, etc..

Saying Bank of America employees are unaware of COMMON SENSE things like this, is like saying B of A is hiring 3rd graders to perform Modifications, so be patient with their childish abuses...

The only way to STOP the Criminal behaviors of Bank of America is to make sure they know, that we know, and if they do not cease and desist, many Government agencies that support Americans with Disababilties Rights will soon know and bring justice upon their heads.

WE must not be afraid of B of A, to the point where we loose our God given right in America to have a backbone.

I had not seen anything prior to my thread where B of A was asking for the phantom "Continuance Letter". All I was saying to those who already had replied to my query was that I would wait to see if this was accepted BEFORE I made a complaint to anyone. Additionally, had you read my entire post you would have seen that I already talked to my negotiator regarding this and she told me that if they insisted on this letter she would take this to the appropriate party and get it resolved as she agreed that you cannot give a letter that no one will write for you.

I apologize to you if I have offended you in any way.

Just curious...did they request this type of letter when you got the original loan? My husband is on SSD and we just gave them the benefit letter you sent them. Also, if unemployment only has to continue for 9 months, why SSD for three? Sounds like they pulled this out of thin air, and they are discriminating against the handicapped.

No they did not because my wife is not on the mortgage. I included my wife and son's income to be sure I would meet the financial requirements. I am self employed and my income can vary from month to month, but my wife and son's income never change.

What they / she the NEGOTIATOR should have told you or anyone is this --

" I am so Sorry, we apologize and this issue will be taken care of TODAY, as within the next hour and your modification will be streamlined ASAP ! "

Not that "IF" the problem keeps on going on for you then she will address it at that point - WHY ? JUST MORE FRUSTRATION FOR YOU AND WASTED TIME OVERALL -

One phone call for just 60 seconds / 1 minute or less on your negotiators part and the problem should be over and done with for good - PERIOD .. And she would have prevented that punitive person from messing with other people and further stalling mods for no real reason

Hello, Yes this is Miss Smith - Negotiator for Montana Loan # 1234567

Bank of America is not allowed to ask for SS disability payment letters, it is an illegal request and besides, SS has no such letter - Only ask for the required past 2 months of Banking Deposit statements & Please advance Mr. Montana's Loan Mod into the next phase ASAP.

This is exactly what should be happening at Bank of America with any and all BS loopholes...

And we all need to let Bank of America know that we know, with proper and professional due diligence, instead of Bank of America's Criminal & Defrauding excuses and Nefarious Negligence, that our Loan mods NEED TO BE STREAMLINED & NOT CRIMINALLY SIDE-LINED and that we are sick and tired of their Premeditated Perpetrations
