I kept getting phone calls from BOA because I was past due, it got to the point where I decided to ignore their phone calls. One day I answered and I told the lady that there is no use of calling me everyday because the result will be the same, read my lips"I don't have the money to make a payment". Then she asked me if I applied for loan modification, I informed her that I had talked to several people and I was told that I do not qualify. She asked me about my income and expenses. Then she said "I don't understand why you were told that you do not qualify?!! She asked me to fax to the HOPE dept. a hardship letter and proof of income documents. Weeks later, I received a call from the HOPE dept. to verify that all the info I sent was still current, then he told me that they will offer me a Loan Modification trial that will start in August. Few days later I received the Fed Ex package with the trial starting in September.

Hopefully I will get some sort of new. Do you remember when you submitted the form 4506-T......did you sign it? I thought I saw on the forum that you must sign it or it will hold everything up. But, the form itself says caution do not sign this if lines 6 and 9 are blank ????

My package came from Home Retention - Texas. I contacted OOP and from there worked with a Sr. Negotiator. This took from 7/23 to 9/10 to get package.
I was paying 2544.22 for PITI, and escrow shortag efees, on trial with HAMP for 4 more months new payment is 1870.84 PITI and escrow shortage fees.
Basicly I was paying 1936.73 Prin. & Interst. before taxes and fees so now my PI before taxes is 1227.91. I have made my first payment to BAC HOME LOAN SERVICEING LP. I found out from calling 18006696707 that THE HOPE TEAM was the approved lender and that they recived my FE- EX package.
FINNALY after 12 months, results. Was only denied twice.
History: I Requested help in January 2009 and recieved a reply in April. Denied for no hardship at this time and because I was current on my payments.
In July I Got a second call from my Mortage Servicer at that time BANK OF AMERICA and was denied from Home Retention Dept. for the reason that I didnt have a curtailment in income that was enough to substanciate assitance. But he said he would send my request and hardship letter,docs. etc. to the Investor.
I did what most people do I gave up on the idea that there was any help for me, even though I met all the and every single one requirement of the requirments for Help for homeowners found on the fannie mae website.
In August I got a call to my suprise from the home retention dept that if I was still inerested in help, so over the phone I gave them my income and guestamated my debts, and said I have to use my saveings in keeping upand I cant save a dime., and that I meet all the requirements.
He enters it on the compuuter and BANG the guy was jubilant and totally suprised that his compuuter came back with "I am approved" and to start my trail period with the new payment of 1870.00. But when I asked him if the new payment included my taxes and insurence HE SAID IT DID NOT AND THAT WOULD BE ADDED ON TOP OF THE 1870.00.
Hm I thought going from 1936.00 to 1870.00 PI, is no bargain and represnts only a 66. dollar savings plus my payment would be higher than my current PITI adding the escrow shortage fee of 137.. Of course I said no.
Moveing forward, Im at home on the putter In Sept. and by chance I find this website LOANSAFE.ORG, and read somewhere a link to a Barberra Dosier, an executive way up the food chain and I guessed. I e-mail her a complaint that I meet all the requirements for hamp so whats the holdup?. I than get a call from the OOP in october about my request being escalated, My loan is now with BAC servicing Lp, new loan # and that I would be contacted by a negotiator and recive an Mediator.
In December 28th. I hear a knock on the door to find a FED EX package and the new payment of 1870.00 for the trail and this includes the Insuerance, taxes and Escrow shortage fees.
In January I get a call from the Mediator from Home retention dept.and she say it looks good. I tellher Im on HAMP TRAIL. She has no knowledege of it. She ask me if as a favor I could send her copies of those documents for her records. I get a call latter from her one week latter that she is returning my phone call that I had a question and how could she help? She says I know you have a hamp trial and she has not recived those fe ex copies. I ask her what is her function and porpous as a Mediator and she tells me "TO see that it gets impemented".
Two or three days past and I find online at BAC that my work out information shows all copie or the fed ex docs I faxed to her showing under the work out link, all the new trail payments showing under the transaction link.
Thats it! I am waiting to make my second trial payment in February.
Persitance pays off. The knowledge base from this website pays off.
E-mailing (3) times to different BAC personel pays off.
I'll belive it when I get my final modification agreement that makes it PERMANENT. Sometime after my final 4th. payment. I HOPE I HOPE I HOPE.

We started asking for a loan mod. on November 2008 and they denied us bucause we were still making payments, of curse, we exhausted ALL of savings trying to make payments on time after my hubby's bussines went dead, but in feb- 09 a customer representative told us that: since we were not behind we don't qualify, we give up and stop making payments ( we can't affort! I am the onlyone working and paying for everything) On June-09 they sent a Trial Period pk and we send it back and start making payments, very affordable, but after 5 payments and no answer from BofA, we stop payments and went to hire a lawyer ( we check credentials), now 2 months later BofA is calling us and telling us to get rid of the lawyer, keep making payments and they will work out something, I just sent proof of my really slooow hubby's bussines and my income, should I keep the lawyer informed of what is happening or just deal with BofA and hope for a good resolution? The lawyer mention that she may get rid of our 25K second mortgage. Suggestions?
I have the same long run around nightmare as the rest of you with BOA. My trial began in June and I met all requirements in the 3 months period. I choose not to pay them after that. I agreed to risk 3 months payments to this crap shoot- nothing more. The documents they sent me told me I'd have a decision at the end of that 3 months. I never signed or was notified of an extension and have been fighting with them since. I fulfilled my end of the TPP. Today I get a fedex giving me 30 days to pay 8200+ before they grant me a decision. I say, give me the decision and the final payment amount and then I'll happily hand over that $$$. I'm done being nice with them and I've begun researching legal remedies to deal with their blatant disregard for the MHA servicing quality guidelines.
After spending 7 hours reading as much as I can get my hands on at the MHA website regarding Servicer Guidelines, supplemental directives etc. I found THIS document I pasted in below!!!! Which I think is extremely important for anyone with an aging MHA trial mod plan which has not been finalized.
I'm done with cowering in fear with BOA. I fulfilled my part of this obligation. They have failed to service my mod according to their servicer agreement. I am notifying them of their violation and I am reporting them to Fannie Mae compliance immediately. I'm really exhausted from all of this, but I'm strongly considering compiling a thorough "package" documenting my plight, including point by point examples citing their lack of servicing quality, using quotes from the MHA service directives documents that dictate service guidelines. I plan on sending this package and copies of documents to support my accusations to everyone I can think of from media outlets, SIGTARP complaint hotline, members of the banking committee, ACORN, Fannie, Freddie MHA Compliance oversight, HUD, Attorney General, White House etc etc etc.
They have caused me tremendous financial, physical and psychological suffering with their gross inadequacies. I have pages and pages of proof to substantiate my claim against them and if I can find a way, I am going to sue them for damages. If they could pay their TARP money back early so they could give their bonuses out, they could afford to hire more people and live up to their end of the bargain with us, the US taxpayers who bailed them out. This is total BS! I know they will probably squash me like a bug as I will likely have to defend myself in court but if I can become a huge thorn in their side, I will gladly waste my time trying to sue them without a lawyer.

Under the Section titled DECEMBER 22, 2009 it says:
"December 22, 2009
Q1222-01 How should servicers handle situations where an eligible borrower successfully completed the HAMP trial period but has not been converted by the servicer to a permanent modification in a timely fashion?
In situations where an eligible borrower successfully completed the trial period (including providing the required documentation and making the required payments) and should have been converted to a permanent modification, but for reasons beyond their control were not timely evaluated for a permanent modification, the servicer must promptly make a determination as to whether the borrower is eligible for a permanent HAMP modification. If the borrower is eligible, then the servicer must offer the borrower a permanent HAMP modification as soon as possible, but in no event later than sixty days after discovering the error, including, but not limited to, discovery through notification from MHA Compliance, the servicer’s own procedures, or notice provided by the borrower. In addition, servicers must make permanent HAMP modification offers to eligible borrowers that are identified as currently being in this situation by February 28, 2010. The permanent HAMP modification offered must put the borrower in the same position as he or she would have been had the servicer converted the borrower to a permanent modification in accordance with the program requirements. A borrower in this situation remains eligible for a permanent HAMP modification regardless of whether the borrower failed to make trial period payments following the successful completion of the trial period.
In order to achieve this result, the servicer should take the following steps:
• the modification should be made effective as of the date the modification would have become effective if the servicer had converted the borrower in a timely fashion (the “Modification Effective Date”);
• the initial unpaid principal balance of the modification should be the unpaid principal balance of the loan as of the Modification Effective Date, plus all accrued but unpaid amounts allowed to be capitalized under HAMP as of the Modification Effective Date;
• any payments made by the borrower after the Modification Effective Date until the time of conversion should be applied retroactively in accordance with the modified terms; however, any shortfalls between the actual payments made by the borrower after the Modification Effective Date (including any missed payments) and payments that are due under the modified terms until the time of conversion must be advanced by the servicer, capitalized and deferred as a non-interest bearing amount that is due and payable by the borrower at the time of payoff, maturity or transfer. The servicer may collect this amount subject to such restrictions as theinvestor may establish including, but not limited to, restrictions on collecting this amount in the event of a short payoff or other disposition of the loan;
• if, due to a shortfall in payments, amounts are deferred, the servicer must amend the Home Affordable Modification Agreement in accordance with the Document Summary for the modification agreement; and
• the servicer must take the necessary steps to correct any credit reporting for the borrower since the Modification Effective Date.
As part of its regular compliance activities, MHA Compliance will test for compliance with this guidance. In addition, MHA Compliance has been conducting, and intends to continue to conduct, focused file reviews on populations of aged trial modifications.
Servicers should note that this guidance does not apply to situations where a borrower has been granted a Trial Period Extension under HAMP Waiver #20090803 because the borrower made all required trial period payments during the original trial period but did not submit all necessary documentation. In that situation, the borrower must make an additional trial period payment for each extension month by the end of the Trial Period Extension to receive a permanent HAMP modification.
I am at wits end!
Tria payment made for 3 months! (December, January, February, ). Called bank today o check status of loan mod. Workout loan has been closed! Ask the BAC rep..WHY? he sayss I don't why, do you want to reapply? Why would I have to re-apply. Why was it denied. I refused to let him off the phone without an answer. He breaks down and say's.. I know it's really confusing! He admits that he's confused, each loan shows different things..for workouts Becuase I show it's in the workout department, but when I put you on hold and checked with my supervisor he says it's closed. I ask him to transfer me to the workout department and he says "they don't have phones! WTF..no phones.. come on, what is really going on! It is an aweful game they are playing with consumers. Here's someone who wants to pay, who wants to keep their home..and all they can say is, mail us the 8600.00 dollars and we will consider! While 4496 dollars is sitting in a partial payment accounting... so they can make the loan appear to be later than what it really is! Is there a class acition suit...? Where can I sign up?
My aunt recently agreed to HAMP with BOA investor Freddie Mac. We attended the NACA workshop in West Palm Friday wherin they told her he first needed to complete the terms for the agreement before she could do a workout through NACA. This came from Freddie Mac Rep at 5 pm....Yeterday she ws served with paperwork advising they would be auctioning the home....She is only 5 months behind. Help Help Help
