Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Not sure of what I just received in the mail Just got a package (USPS) from Home Retention Team in Houston TX (BAC Home Loans Servicing LP) telling me that I MAY qualify for MHA. It instructs me to send in payments of $1624 on 10/1; 11/1; 12/1. And of course the hardship affidavit, tax report form for 2007 & 2008 etc. We had written to Barbara D and were assigned to negotiator Jessica. Jessica submitted to Fannie Mae and it is now in upper management for them to decide the right mod for us. When I spoke to her on 9/1 she had no further information and that I should call back on 9/10 and maybe they would have an answer for me. I have several questions regarding this package I got just now and keep in mind that it came through the Post Office and NOT FedEx: Does this offer have anything to do with what Jessica is working on?

It says "You may be eligible for a new affordable mortgage payment. Complete the enclosed documents by 10/1/09 to get started" It asks for documents that they already have. "Here's how the program works:

I thought the offers were sent via FedEx not post office. This was mailed the day that Jessica said they had no answer from upper management yet (9/2/09) |

There is nothing called Home Affordable trial |

These are the templates for servicers to use, but the servicer may use their own forms. What you are describing seems to be BofA's version of one of these templates. However, I do not see any of them mention sending in payment unless you are being offered the trial plan for HAMP. I don't see how they can request money from you when all this letter is saying is that you MAY be eligible, not that you ARE eligible. This has me scratching my head. I would call your negotiator and bring it up with her (even though she may not know what it is, at least she'll be aware of it). There are so many third parties working for BofA now, that it is not impossible for you to receive more than one HAMP offer. Do post what you find out. The whole thing is odd since I've never seen anyone receive anything from them through any delivery service other than FedEx. | |

My guess is that they want to commit me to 3 payments and then decide if I am eligible. Had they sent this to me when I first called in June and I was only 3 payments behind I would have jumped all over this as it would have been only $297 shy of being caught up. I might still be able to use this to my advantage if I have to. I can afford my mortgage, but for months of March & April we were not paid for $15,000 worth of trucking and our bookkeeper disappeared with $6300. I think that this is something they should have sent me long ago! |

If so, this is odd, because they are asking you to make 3 payments while evaluating your case, which is typical of a trial offer, also they are calling the program "HAMP"!! I find this very strange. In my previous post, I talked about 2 different letters, but both would mention that it is a trial, in fact the #2 letter would not even include payments, so it would not apply to you. I have a feeling that BOA is not following the guidelines and forms. May be they are combining both letters in one as a short cut, in other words, they will verify your income and have you make the trial payments simultaneously! Please let us know what your negotiator says. |

I do not think that this is what Jessica is working on. Jessica already has everything except the tax returns. I think this may be a case of one hand does not know what the other is doing (imagine that!) I will be checking with Jessica on this, but at least if nothing more, if I get nothing from her by the end of the 3rd week of Sept, I can still use this to buy more time for them to do something that makes sense. Actually, since they have determined that we can afford the mortgage (got behind due to reasons previously posted) it's not a bad deal for us. Will post results of conversation with negotiator on Tuesday! |

With those, they claimed in a cover letter that there was a condition of them verifying income. Only problems: 1) they did not tell you TRUTHFULLY what they were doing, 2) they never asked for any input if there was a problem 'verifying' your income 3) they never told any borrower that the contracts were all cancelled before even the FIRST payment 4) they reported the differences of the payments to the credit bureaus without your knowledge and 5) when the difference was more than $10K they would finally contact you by phone and tell you the contract was previously cancelled or various other excuses. There is a list of about 7 excuses people were told and most got told two or three of them. I'd be VERY wary of ANYTHING where BofA is SUPPOSEDLY continuing to verify income, especially on any program that is 'internal' to BofA. With the 'AG mods', no matter how many times you asked about the progress of the mod being incorporated into the note (since it was a FINAL contract), you were told not to worry, the contract was 'yours', your contract is mod'd, everything is ok, don't worry about not having our signed copy of the contract. With the 'AG mods', payments have gone on for as many as 7 months in some cases while the borrower kept requesting the CW signed copy of the mod contract. Now, certain of the CW employees refer to those mods as being "conditional" and have stated that practically all were canceled. I can see HOW they did it but it is ANYTHING but honest business practices. Given that the contract was offered and they made no effort to report any 'verification' problem to the borrowers within any reasonable time, nor even allowed any interaction when they finally did report the cancellation, the borrower never had a chance. Some of us never have been told of any reason, just that the contract was not implemented. Later comments were added that there was funding that did not get linked up. Sorry, where was THAT in the contract that I signed? That reason was NOT even in the cover letter. So, I REALLY believe you should be VERY careful of any 'FIRM' offer that allows them to be 'continuing' to verify income. It is could be just a ploy like the AG mod one. They got money while at the same time doing a 'setup' for making a demand for a sum of money you may not have and then pressing for foreclosure. That is the outcome of the 'AG mods' that they seem to intend. | |

I think that this stems from my initial call on 6/5. In aug I emailed OOP and things started moving then. I'm not even sure that I trust our negotiator, she seems to know nothing about our case, Will certainly keep you posted on this...hope it is not the "new" twist! |

I already have what I refer to as the 'Litton-twist' (strange that you picked on using the 'twist' term unless you read one of my posts elsewhere here that mentioned that. The 'plain-jane' case is with CW still owning the note, 'Litton-twist' they transfer the note instead of implementing the modification contract. (Maybe I also called it 'Litton-Lemon-Twist'.) I hope we do not have cause to dub this offer of yours the 'FIRM-twist'. | |

Hope its not deja vue! Wonder what would happen if we got hold of say 20/20 or one of the investigative TV shows??? Or use one of my favorites...Set up to have EVERYONE light up all lines on all numbers we have for B of A including OOP. My office uses this method when we haul freight for a shipper or broker who does not pay in a timely manner and Bookkeeping will not answer the phone or voice mails. It's a real attention grabber.....when you tie up their lines and overload the system it gets their ATTENTION! |

I will CC Jessica as well. It's up to them to decide what this means, what they are doing. Anyone want to put some $$$ up that I get two different answers? |

The type of mod contract I have, the AG mod, had worse chances of being implemented than winning the lottery, regardless of the number of the contracts they issued and had folks notarize and return. They should have to at least refund the money spent on the notary. They didn't make any attempt to honor them, it was a game of issue them so they meet the settlement requirement, then cancel them all, regardless of whether it was in any way a proper or fair business practice used to find a 'cause' to cancel. | |

It DOES include the 3 payment dates and the rest of the agreement but it is specifically entitled "Workout Plan". I am calling Jessica 1st think in the morning and will post again once someone can clarify for me what this is. I don't believe that this is what upper management" was working on for me. |
