NACA disappeared on me!!

I've been working with NACA since May and at first everything seemed to be going forward on my loan mod. They were able to postpone my foreclosure sale date twice. But all of that has changed since mid-July.

BOA asked NACA to update my file, which they didn't do. Instead, NACA submitted a budget with so many errors that it almost seemed fraudulent. I contacted NACA to ask for the correction and they said to again send in all of my paperwork for review and set up a new appointment which couldn't be scheduled until 8/15. I sent in all paperwork & waited 2 week sfor my telephone appt, which never came. I called NACA and was told by recording that I had to leave a message (no other option) which I did. I also emailed and sent messages thru the website for a week. NO ONE RESPONDED!!.

My new sale date is 9/1/09 and I have been repeatedly calling & emailing NACA and put the info thru the website regarding the sale date. I finally got an email yesterday that I need to update my file and then call for an appointment!

I lost a lot of time the past few weeks because BOA didn't to speak to me because I work with NACA . I emailed Barbara Desouer's office and asked them to work directly with me as I am legally responsible for this matter. Finally David E. for the BOA called and has been working with me, but it may be too late. I may lose my home on Tuesday.

NACA has clearly stepped out from advocating for me and did so without notice. BOA would not accept the "solution" that NACA sent in on my behave because it it just didn't add up. NACA stopped responding to BOA for paperwork on my file. NACA has not responded to me since July.

In my opinion, NACA took on too much, promised too many and can't perform to the standards that they promote.

In the meantime I have been working with David E. from BOA to get another forebearance and postpone the sale date again. As of today, my sale date is still on for Tuesday.

There is another thread here where some of us have been debating NACA fraud. I think you need to post on that thread ALSO.

We have no real recourse against NACA, do we?

Is there a means of reporting this to HUD since they are funding NACA? Should be.

I would also get my butt to a REAL ESTATE ATTORNEY the first thing on MONDAY.

Some may have an after-hours phone system that will allow you to get an appointment worked in. If it is possible, you would need to go to that meeting with your ORIGINAL loan docs and all the letters from the lender plus your materials that you have provided to NACA, also current paystubs, etc.

If there is ANY chance, you need to try so that you are not solely dependant on David E to find time in his schedule to try helping you.

The attorney might be able to advocate for you even louder.

Make sure it is not just one of these 'boiler-room' we-only-process-new-mods-for-everyone places. You need a REAL attorney who specializes in REAL ESTATE law to take an immediate look at this mess. Try to find someone who has been in this area of law from before 2007. Lots jumped on the 'wagon' when the market tanked. Get one with 'real' experience if you can at ALL.

luckydog, its hard to believe sometimes who's telling the truth could be bofa giving you a runaround also.naca said i was submitted in july but when i set a phone appointment to update in 8/17 then the couselor said ok i submitted today.i ask i thought i was submitted in july,he said there was a error and that he fixed it.try to go to one of those save the dream tours maybe that work out better than just waiting and not knowing.they told me if i went to one of those they would have to erase my file then start all over again at the tour but that ill get a solution that day.i dunno what to believe....

From the guidelines I read, they are only to CORRECT, never erase and start over. They were also to stay with the same version of the processing software to handle each data entry change for any particular case. So if you first had info entered into the system under version x of the software, the corrections were to also be processed using that same version x.

Regarding attending the next 'event':
The poster who started this thread, Luckydog, does not have the luxury of time to wait for the next NACA event. The deadline is TUESDAY and that is just 3 days away!

Since I myself do not trust CW/BofA at ALL, and the poster obviously questioned the NACA efforts, and clearly NACA is refusing to respond to the poster, it is best to QUICKLY bring some OTHER knowledgeable negotiator into this particular mess.

TIME is of an essence in this case.

Back in may, we also attempted to work with Naca. We submitted docs online, and then tried calling with no success. Emails produced no results as well. Never managed to schedule an interview or any kind of appointment. After that we went to local non profit called Genesis, who did wonders for us. they even managed to convince BofA to take first MHA trial payment 15 days late, because my husband was out of work 2 months prior.
In regards to trusting BofA, well i agree with that completely. But yesterday, something very unusual happened. Three days ago i was contacted to submit all the documents again because misteriously, they didn`t get them even though they were Fed-Ex-ed along with MHA agreement package on august 1st.
I thought to myself "here we go, circus begins!"
So i faxed everything again on Thursday. Yesterday afternoon they called me from BofA to say that they recieved all the docs i faxed, along with second payment i sent over Western Union, and to tell me i can relax for the weekend because house is pulled out from foreclosure, pending final Loan Mod.
I couldn`t believe it. I wish i have recorded it, because it was an historic moment for BofA.
I did however, got another collection call right after that one, but they told me that will stop after Loan Mod goes thru.
Back to Naca though. I just wanted to say that there are other non profit organizations, with lower volume of clients, capable of producing same, if not better result of saving a home.
I highly recomend Genesis here in Phoenix, AZ, even though they might be little slow in updating you on whats going on.

The thing is sanny, NACA never had any intent on helping you get into the MHA program, They have their own deal with the bank. This is where the fraud comes in, you can see the other people actually helped you get into the MHA program. This is what NACA should be doing and they are not.
