Thumbs down CW/BofA refuses to help w/mod after repayment period

I'm just wondering when people contact Barbara Desoer what exactly is included in the e-mail? Should we be extensive on the amount of information we include in the e-mail or keep it brief?
Our situation is basically we started a 4 month repayment plan in January 2009 and in April started the modification process. Since that time we've been assigned four different negotiators and until last month we have been working with the same negotiator Carla Alvarez who hasn't been very helpful in the least bit! Today I spoke with her and basically she told me our payments would revert back to the same amount they were at before we started the repayment plan....how can this be, based on our income and expense form that we also submitted it only showed that we were positive in income after all bills are paid each month by $154. We definitely can't afford a $3100 mortgage payment and that doesn't even include our second loan!
Our first loan is a 6.75% for 30 years and basically our situation is we can afford our home but not the mortgage payment. Any advice from anyone?

Here is what I wrote...

Hi W.Davis,

When we emailed Ms. Desoer, we basically shortened our hardship letter we originally sent in to CW/BofA and added all the steps and attempts taken to try and get a solution to our mortgage and financial situation. I thanked her for taking our situation into consideration and working with us to find a solution.

I made sure all the loan information was on top of the email and loan number was in the subject line by itself: example below...
Loan number
Name
Address
Contact information- phone, cell, email... List the number you want a call back on first or solely.

Dear Ms. Desoer,....


Good Luck!! Keep us posted!

So right now you are +$154 per month with paying the $3100 mortgage and all your other monthly expenses? BOA probably isn't going to want to act too quickly if this is the case. While $154 is not much left over it is still a positive number which means you are way ahead of many others who are running negative each month. So my guess would be that CW/BOA is working with the Negative people first and foremost.

I would take a very close look at your numbers and insure what your true allowable expenses are vs. expenses. Also have you tried NACA? They have a process to figure out exactly what your MOD payment should be based on your expenses and income.

After reading your post again something is not making sense. You say that on your submission form it shows you have a +$154 income versus expense? Then you go on to say that you would not be able to afford the $3100 mortgage payment not even including what the second mortgage payment?

Why then does your sumbmission show +$154 then? Are the numbers right? Do they show all your legit allowable expenses? Something does not add up. I would go back over all you calculations and insure they are right.

The submission was based on what our mortgage payment was before we started the loan mod. process....which by the way was less than what they're offering the loan mod. at.....$2700 on the first loan! So now they're increasing the payment to $3100 so if they reviewed our income submission BofA should take into account that with the mortgage payment at $3100 it would definitely leave us in the negative! But the negotiator won't budge....she keeps saying the investor is the one who is denying it. I could contact NACA but that would take another 4 weeks or more and I'm afraid we really don't have that time to start the process over.
