I have a long story but will try to keep it short as I can. We purchased our first home in 2006. Both my husband and I are in are early 40's. We went into this home buying thing very confused and lost and not really sure what we were doing and no one really to help us. We have rented for many, many years. We are locked in a ARM home loan at 10.0% a.p.r. Since last fall my husband has lost a lot of commission on his job not very busy with the ecomony the way it is. He gets an hour rate plus commission and he really depends on the commission. My hours got cut from full-time to part-time. We have two children to feed and support. We purchased our home for $130,000 with monthly payments at that time $1,062.00 a month. I have TRIED and TRIED to work with cw/BoA now for a year and a half |

Looks like you are getting the run around from BofA and they are just pushing you away everytime you try and come to them for assistance. If you investor is Fannie or Freddy then check out these links. Should we be extensive on the amount of information we include in the e-mail or keep it brief? Our situation is basically we started a 4 month repayment plan in January 2009 and in April started the modification process. Since that time we've been assigned four different negotiators and until last month we have been working with the same negotiator Carla Alvarez who hasn't been very helpful in the least bit! Today I spoke with her and basically she told me our payments would revert back to the same amount they were at before we started the repayment plan....how can this be, based on our income and expense form that we also submitted it only showed that we were positive in income after all bills are paid each month by $154. We definitely can't afford a $3100 mortgage payment and that doesn't even include our second loan! Our first loan is a 6.75% for 30 years and basically our situation is we can afford our home but not the mortgage payment. Any advice from anyone? |

Hi W.Davis, When we emailed Ms. Desoer, we basically shortened our hardship letter we originally sent in to CW/BofA and added all the steps and attempts taken to try and get a solution to our mortgage and financial situation. I thanked her for taking our situation into consideration and working with us to find a solution. I made sure all the loan information was on top of the email and loan number was in the subject line by itself: example below... Loan number Name Address Contact information- phone, cell, email... I am a victim of the deceptive loan practices of 2007 and have become a victim of the runaround. I do take responsibility, after all, I signed the paperwork. The problem was that CW knew at the time that there was no way I could afford the loan. My wife is recently disabled and the loss of her income was a strain. We signed the documents in order to pay off some credit cards. We were in no way living above our means, but when you have to pay for groceries with credit you know you are in trouble. Unfortunately, that was only the beginning of the problem. By the end of 2008 we were forced to file for Bankruptcy. We had (have) every intention of keeping our home and trying to work something out. The Making Homes Affordable plan didn't work for us due to the bankruptcy, the money out had been reduced but the payment was too high. We tried another modification and two weeks ago we got the paperwork. CW lowered our payment a whole $40. I called and told them that I could not sign something that did so little for me. Then came the Notice of Intent to Accelerate. Now I have until 7-31-2009 to pay it or I'm going into forclosure. Now I'm certain there is a program out there that would suit me. In fact, CW even told me of one that Bush/Obama collaberated on that would allow the government to pay 90% of the amount you are upside down and you could pay 10%. Guess what? CW did not participate in that program. I am a very proud person. I do not like what I have had to do at all. I am not looking for a handout, just help. I have talked to CW about my home and about there misuse of Bailout money. If I walk away now, which I can based on the bankruptcy, I owe them nothing. I have been discharged. I want to stay and raise my kids here. If I do walk out, BoA will attempt to sell my home and in today's market get $120,000 less than what I owe. All I am asking is that they meet me in the middle. I am willing to pay more than their loss if I walk. Unfortunately they don't wish to lose anything. In fact that want to double their money. So, I will most likely lose my home to BoA. It breaks my heart to have to walk away and it hurts even more to take my kids from the only home they have ever known. Oh well, I guess were I a Senator or President I could get a sweet deal!!! |

Go to www.NACA.com a lot of people have received loan modifications with NACA. I believe you have a better chance with them, than working directly with BOA. |

I received a call from someone below Barbara to get the ball rolling with are mod request. I got all the income and paperwork they requested and faxed it to her yesterday she called and left a message on my phone saying that we were assigned to a senior neg. her name is Kristy McGowen from B of A. She called and left a message for me to call her with any questions. That's were I am scared. What do I ask? I am so clueless about this mod. stuff. I do not want to say something that will screw it up for my husband and I. I have to call her back today. Any advise? Thanks. |

Hi Mary2009, I suggest that you be honest as possible when you speak with your negoitator because she will ask for all your financial info including paystubs, tax returns, bank statements, etc. They will most likely run your credit report as well so again be true. Everything should be fine stay strong and keep us posted

I am so happy! Loansafe.org you are a life saver!!! Without your input to contact Barbara from B of A this would have never happened. We went from a.r.m. loan at 10.0% paying $1,462.65 now to a fixed 5.5% for the life of the loan at 966.00 a month escrow included. You do not know what this means for my family. It is great to know that we can keep our home! Loansafe.org thank you! Keep up the great work! Our family is very thankful. |

Isn't it amazing that all it took was one email to the BofA Home loan president to get your approval after your months of trying with CW/BofA through it's regular channels? The Advocacy and Home Retention and Loss Mitigation groups that we initially get routed to just basically lie and deny....think of how many homeowners who never found their way here are losing their homes right now because they couldn't get through to the right people or non-profit orgs to get the help they need..... It's mind-boggling!!!

We are going through the same thing w BoA/Cw. I have been ssooo frustrated,and didnt know what to do. I will be emailing Barbara Desoer right away. Thanks to all who has shared their stories. |
