December 1st 08 we got a FedEx with a loan modification package in it. We sent all the information back and were instructed to start making payments in February of 2009. When I received my February loan statement the amount due was much higher than the amount in my loan mod. I went ahead and sent the payment anyway. In March the amount was still higher and I again sent it anyway via certified check. About 4 days after I sent my March payment I received my February payment back in the mail. I called to see why and they told me that I had been denied the modification but that I should be receiving another FedEx with the making home affordable plan. At the end of March I did receive the making home affordable paperwork and resent all the documentation requested to Countrywide. I began making the payments May 1st as stated in the paperwork. June 18th I received a message from the home retention dept. I was out of town and returned the call June 19th. I was told that since I was self employed I would need to send a third party verification of self employment. I was also told that the modification was closed because they were unable to contact me on June 15th and I did not cal back until the 19th. I informed them that the first contact I had was on June 18th and that I had called the next day. I asked for a supervisor and was told that I needed to fax a letter to them that day from someone I did business with or my mod would be closed out on Monday June 22nd. Within 1 hour of my conversation on the 19th I faxed the requested letter to 3 different fax numbers that were given to me. Monday the 22nd I called and was told that the fax was not in my file yet but that it took a few days and that as long as I had proof that it was sent everything would be fine. I was told to call back in 3 days. Wednesday I called back and was told that the mod had been cancelled on Friday June 19th. The rep that was handling the modification put a not in the file not to transfer any calls to him as it was a closed file. I have never actually been able to talk to this person. The person I talked to said she would resubmit and I should call back in 10 days. The next day I called and spoke to someone else and was told that it had been resubmitted and to call back in 10 days. I am frustrated because I complied with everything they asked for in a timely manner and my mod was cancelled even though I send the requested 3rd party verification back within 24 hours of the original phone call request. I have no faith that the agents that I am talking with are giving me correct information as I am told something different every time I call in. I have the money to pay my mortgage and have been paying according to what they requested. I am behind and cannot afford to bring that current in 1 lump sum, but the reason I am so far behind is that they either wouldn’t take my payments in February and March or then told me not to pay again until May which I have been. I am at wits end and don’t know what to do. I am sorry this is so long winded but I could really use some advice. Any help would be greatly appreciated. |

Thus many of us have stopped trying to deal directly with CW/BOA and have used NACA for our loan mods. So...we tend to understand what you are up against. My suggestions are: 1. email the President of Bank of America Home Loans. barbara.j.desoer@bankofamerica.com You should receive a phone call from one of her designates within a few hours so be ready to discuss your issues with that person. Be sure you get all contact infor for him/her so you reach out to them again if needed. 2. If this approach fails you may to try NACA, if this is your only residence. They are a non profit agency and their services are free. Dealing with any company in transition can be difficult, but dealing with CW/BOA is very difficult as many of us on this forum can attest to. Good luck. Keep us posted. There is more information on this site than you can realize. Lots of people here have really good advice. Cobra.....NACA helped me save my home. |

Despite the great intention of the Federal Program "Home Affordable Act" etc....... . Banks are not really geared up to serve home owners that qualified, so they tend to let you run in circle until you are really in distress to loose your home. Homeowners, by themselves, at the end, even successfully complete a Loan Mod, the final terms and rates never as good as when completed by a "honest, professional, and experience" mitigator. But beaware, there are a lot of crooks out there preying on you, so do your homework before taking your next step. |
